DECLARATION

of 6 September 2011

amending Decree No. 23 / 2008 Coll., on technical conditions for fire protection of buildings

The Ministry of the Interior provides pursuant to § 24 (3) of Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 186 / 2006 Coll.:

Čl. I

This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.

Čl. II

Decree No. 23 / 2008 Coll., on technical conditions for fire protection of buildings, is amended as follows:

1. Paragraph 7, including the title, reads:

„§ 7

Roofing

The roof cover shall be classified according to the Czech technical standard set out in Annex 1, Part 6, point 3. The roof cover located in a fire-hazard area shall be designed with the BROOF classification (t3). The roof cover which is not in the fire-hazard area shall be designed with the BROOF classification (t1). The design of the roof cover shall be based on the required inclination according to the Czech technical standard set out in Annex 1, Part 6, point 3. '.

2. In Paragraph 8 (1), "point 3 'is replaced by" point 4';

3. In Article 8 (2), the words "the Czech technical standard referred to in Annex 1, Part 7, point 2 'are replaced by the words" the Czech technical standards referred to in Annex 1, Part 7, points 2 and 3';

4. Paragraph 9 (1) reads as follows:

"(1) The electrical equipment which operates in a fire necessary for the protection of persons, animals or property shall be designed in such a way as to ensure the supply of electricity during the fire, under the conditions laid down in the Czech technical standards set out in Annex 1, Part 1, points 1, 2 and 12 and Part 4, point 1. The types and characteristics of freely guided conductors and cables of electricity distribution are set out in Annex 2."

5. In Section 10, at the end of the text in paragraph 5, the words "or by means of the Czech technical standard referred to in Annex 1, Part 1, point 13 'shall be added.

6. Paragraph 14 (2), including footnote 6, is deleted.

Paragraph 3 shall become paragraph 2.

7. Paragraph 15 (5) reads as follows:

"(5) The family house shall be equipped with an autonomous detection and signalling device. For a family house with multiple apartments, each apartment must be equipped with this facility. The autonomous detection and signalling equipment shall be located in a part leading to an exit from the apartment and, in the case of an apartment with a floor area of more than 150 m2, a mezonet or multi-floor apartment, additional autonomous detection and signalling equipment shall be located in another suitable part of the apartment. In the case of a family house with multiple apartments, additional autonomous detection and signalling facilities shall also be located at the highest point of the common corridor or space. '

8. in Articles 17 (4), 17 (8), 17 (10) and 18 (3), the words "more than three" are replaced by the words "three or more."

9. Paragraph 17 (5) is deleted.

Paragraphs 6 to 10 shall be renumbered paragraphs 5 to 9.

10. In Article 17 (6), the words "with the exception of common areas without fire risk 'shall be inserted after the words" common areas'.

11. in Articles 17 (8) (b), 18 (6) (b) and 19 (3) (b), "upholstery" is replaced by "upholstered."

12. After Paragraph 17, the following Section 17a is inserted:

„§ 17a

Rooms designed for accommodation of persons

(1) The space intended for accommodation of persons in buildings other than accommodation facilities must always be a separate fire station. No more than 20 beds may be placed in this fire station.

(2) The space intended for accommodation of persons in buildings other than accommodation facilities must be equipped with an autonomous detection and signalling facility. ';

13. in Paragraph 19 (2), "construction" is replaced by "walls, ceilings and ceilings."

14. in Paragraph 19 (4):

"(4) The design of the bench or seat in the assembly spaces firmly incorporated, or to be incorporated into or intended to be installed in such spaces, shall be designed from products of the reaction to fire class at least D. ';

15. in Article 20, the following paragraph 1 is added:

"(1) The design of the observation tower shall be carried out according to the Czech technical standard set out in Annex 1, Part 1, point 1, unless otherwise specified. ';

Paragraphs 1 to 5 shall be renumbered paragraphs 2 to 6.

16. in Paragraph 20 (4), "1 and 2" is replaced by "2 and 3";

17. in Paragraph 21 (2):

"(2) The garage, which also serves for the parking of gaseous fuel vehicles, shall be equipped with gas leakage detectors and efficient ventilation in accordance with the Czech technical standard referred to in Annex 1, Part 1, point 2 and Part 17. The requirement set out in the first sentence also applies to the access and exit areas of a mass garage serving also the parking of gas-powered vehicles, if this space is longer than 30 m and is surrounded by construction structures from at least three sides. The assessment of the garage also serving the parking of gas-fuelled vehicles and its equipment by electrical equipment with regard to the risk of explosive atmosphere shall be carried out in accordance with the Czech technical standards set out in Annex 1, Part 16, points 2 to 4. ';

18. In Article 22 (3), the word "i 'is added after the word" serving'.

19. in Article 23 (3), the second sentence is deleted;

20. In Article 23, the words "and 17a 'shall be added at the end of paragraph 8.

21. in Article 24 (2), "D-s1-d0" is replaced by "D-s2-d0";

22. in Article 25 (3), the words "the total capacity of the warehouse" shall be deleted;

23. in Paragraph 28 (1):

"(1) The design of the construction site installation shall be carried out in accordance with the Czech technical standard set out in Annex 1, Part 1, point 2. ';

24. in Paragraph 30 (2), "points 1 and 2" are replaced by "points 1, 2 and 5."

25. in Paragraph 30, paragraph 8 shall be deleted;

Paragraphs 9 and 10 shall be renumbered paragraphs 8 and 9.

26. In Paragraph 30, the sentence "In an underground mass garage which is not intended to be used for the parking of gas-fuelled vehicles, a gas-fuelled handling trolley shall not be used which does not have a fuel tank fixed in it. '

27. Point 10 of Part 1 of Annex No 1 reads as follows:

"10. ČSN 65 0201 Flammable liquids - Spaces for production, storage and handling."

28. In Annex No 1, Part 1, the following points 12 to 15 are added:

"12. ČSN 73 0848 PBS - Cable wiring

13. ČSN 27 4014 amendment Z1 Safety regulations for the construction and installation of lifts - Special modifications to lifts intended for the transport of persons or persons and goods - Evacuation lifts

29. In Annex 1, Part 2, point 8 reads as follows:

30. In Annex 1, Part 3:

31. In Annex 1, Part 4, the current text becomes point 1 and the following point 2 is added:

Freely guided conductors and cables are unprotected electrical lines (not variable) which are exposed to potential fire effects and whose storage and protection does not comply with the conditions laid down in Czech technical standards set out in Annex 1, Part 1, points 1, 2, 14 and 15 and Part 4.

If more than one compartment is present in the fire compartment, all requirements for each compartment shall be met for the fire compartment.

Fires and conductors shall be classified by function class P15 (30, 60, 90,120) -R or PH15 (30, 60, 90,120) -R in minutes. The cable or wire functionality classes shall be demonstrated by testing.

Cables and conductors functioning in a fire shall be installed in such a way that, for at least the duration of the required maintenance of the function, the surrounding elements or systems, such as other installation and pipeline lines, construction structures and components, are not disturbed by the fire. ';

42. In Annex 3, point 3 reads:

'3. Any non-accessible single-track access communication longer than 50 m, if the communication is the only one, shall be designed at the end with a loop-around or area enabling the vehicle to turn. The length and size of the loop loop or area allowing rotation shall not be counted to the total length of the single-track access communication. The area allowing the vehicle to rotate may be in the shape of a T-point at the end of a one-track communication with arms of at least 10 m in each side in a width of one lane of communication from the axis of the one-track access communication or may be made by extending the lane at the end of the communication to a width of at least 20 m at a minimum length of 20 m '.

43. In Annex 3, point 5, including footnote 16, reads:

"5. The construction and entry area for fire-fighting equipment shall be located and designed outside the protection zone of the high-voltage overhead line with conductors without isolation16) in such a way as to allow for the arrival and execution of an intervention outside the protection zone.

44. In Annex 3, point 9 is added:

'9. The voltage converter with the disconnect shall be positioned in the installation of the photovoltaic power plant in such a way that the direct part of the distribution remaining under constant voltage is as short as possible. The roof or façade installation of photovoltaic panels shall not prevent the ventilation of the building or space, the operation, repair and maintenance of the combustion routes, or prevent access to fire protection units during the intervention. '

45. in Annex 6 (B) (B.1) (b):

"(b) the flammable substances referred to in (a) shall not be used under the ceiling and in other areas intended for more than 10 persons, provided that the total area of use includes more than 30% of the area under the ceiling. Flammable substances shall not be further used in the space below the ceiling in front of the door and behind the door, in an area corresponding to three times the width of the door, as defined by the part of the circle to the axis of the door. ';

Čl. III

Transitional provisions

1. In a garage the construction of which started or started to be used before the date of entry into force of this Decree, vehicles powered by gaseous fuels may be parked under the conditions set out in Section 21 (2) of Decree No 23 / 2008 Coll., as effective from the date of entry into force of this Decree.

2. In the implementation of the construction, the location of which was definitively decided in the territorial proceedings or the territorial consent granted under another legislation before the date of entry into force of this decree, the construction, for which the project documentation was drawn up and for which the consent was given under another legislation, and the construction, the use of which started before the date of entry into force of this decree, shall be carried out after the date of entry into force of this decree in accordance with Decree No. 23 / 2008 Coll., as amended by the date of entry into force of that decree.

Čl. IV

Efficacy

This Decree shall take effect on the 15th day following its publication.
