on the location and identification of the emergency communication participant when calling 911 numbers
The Ministry of Industry and Trade, in cooperation with the Ministry of Interior, provides pursuant to § 150 paragraph 3 of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 310 / 2006 Coll. and Act No. 468 / 2011 Coll., for the implementation of § 33 paragraph 9 of the Act on Electronic Communications:
Definition of terms
For the purposes of this decree:
(a) the base station of the public mobile communications network;
(b) the base station sector of the area operated by one broadcast and one reception system of the base station through which the participant in the emergency communication is connected to the public mobile communications network when it is implemented;
(c) an index of the area by a number identifying the area which has been defined by the operator providing the public communications network and which determines the sector of the base station or part thereof;
(d) a unique number assigned to the mobile device during production by the mobile telecommunications device identifier;
(e) an eCall emergency call service to the single European emergency number 112 carried out either automatically by activating on-board sensors or manually, where a standardised minimum data set is transmitted via public mobile communication networks and a voice link between the vehicle and the emergency communication centre is established;
(f) SIM card identification participant card,
(g) a single international call parameter in the public mobile communications network, which ensures the different routing of the eCall service in the public mobile communications network, is discriminated against by eCall.
Personal, identification and other data for the identification and localisation of an emergency communication participant in a public fixed communications network
(1) Personal data of a participant who is a natural person are the name and, where applicable, the name, surname and telephone number. The participant's identification data shall be the name and telephone number.
(2) Data for the localisation of a participant in a public telephone service are the address of the location of the public telephone machine, including a closer description of its location in the field, its coordinates according to the World Geodetic System 1984 (WGS84) under another legislation (1) (hereinafter "WGS84") and the telephone number of the public telephone service in the network of the public fixed communications network operator.
(3) The data for localisation in the public fixed communications network are:
(a) address (2) of the end point of the network;
(b) the codes of the building object, address, municipality, part of the municipality and street or other public space from the basic register of territorial identification, addresses and real estate (hereinafter referred to as the "territorial identification register") relating to the address of the end point of the network;
(c) the coordinates of the location of the network end point according to WGS84;
(d) other information which is the floor number and the apartment number if this information is available.
(4) If the data referred to in paragraph 3 (a) cannot be ascertained, a replacement address consisting of the address of the nearest end point of the public fixed communications network and the coordinates of the actual location of the telecommunications terminal equipment in the WGS84 system shall be used for the localisation of the emergency communication participant.
Transmission of data to a database manager
The data referred to in § 2 shall be transmitted by the entrepreneur together with his identification number by another legal act (3), electronically in the form of a structured text file with the code Windows-1250. The structure and order of the data are set out in the Annex to this Order.
Transmission of data from the emergency communication centre database
(1) An entrepreneur providing a publicly available electronic communications service enabling end-users to make calls via a public fixed communications network shall transmit to the emergency communication centre at each emergency communication by means of a system signal according to the network signalling plan issued by the Czech Telecommunications Office pursuant to Section 62 of the Electronic Communications Act (hereinafter referred to as the "Network Signalling Plan ') the telephone number from which the communication is made.
(2) The data referred to in Article 2 are collected by the emergency communication centre by asking for a database maintained by the operator providing it with a connection to the public fixed communications network, based on the telephone number from which the emergency communication was made. The HTML or XML format is used for queries into the database.
(1) Where a public mobile communications network is used to connect telecommunications terminal equipment to a public fixed communications network, the emergency communication centre shall transmit the data referred to in Article 6 in the manner specified in Section 7.
(2) If the telephone number referred to in Article 4 (1) is not transmitted during emergency communication, the telephone number identifying the end point of the public fixed communication network to which the telecommunications terminal is connected or the non-public communication network from which the emergency communication has been made shall be transmitted.
Localization of the geographical location of the emergency communication participant in public mobile communications networks
(1) In the case of emergency communication via a call from a public mobile communications network, the operator providing a publicly available interpersonal communication service based on the numbers of the emergency communication centre shall transmit data determining:
(a) the area index;
(b) the geographical location of the emergency communication participant's base station in the WGS84 system; or
(c) the geographical location of the sector centre of gravity of the last known base station of the emergency communication participant in the WGS84 system.
(2) On request from the emergency communication centre, the operator providing the public mobile communication network in which the emergency communication network was established shall transmit the geographical location of the primary station of the emergency communication participant in the WGS84 system or the geographical indication of the identified sector of the base station in the WGS84 system, including the azimuth of antenna routing, by means of a data network. In order to identify an emergency communication participant, the emergency communication centre shall use the emergency communication participant's telephone number, the international mobile communications network participant identifier, or the mobile telecommunications device identifier.
Transmission of data from public mobile communications networks
(1) The data referred to in Article 6 (1) shall be provided through the signalling system according to the network signalling plan.
(2) If the data referred to in Article 6 do not allow the participant to be located in an emergency communication or if it is not possible to detect the data referred to in Article 6, the emergency communication centre shall proceed in conjunction with the relevant workplace of the operator providing the public mobile communications network.
An operator providing a public mobile communications network providing emergency communication centre with location data pursuant to Article 6 (1) (a) shall transmit to it at least every three months data on the geographical definition of all base stations operated by it, including their sectors, indicating their designation and, where applicable, any other identifiers used.
Localization of the geographical location of a participant in emergency communication via the Internet
If a public fixed or public mobile communication network providing emergency communication via the Internet does not allow the localisation of a participant in an emergency communication pursuant to § 2 or 6, the emergency communication centre shall proceed in conjunction with the relevant operator providing that network in order to transmit the existing necessary information for the localisation of the emergency communication participant.
Localization and identification of caller using e Call
(1) In the case of the use of eCall, when establishing the connection, the discriminator of eCall4 is transferred), on the basis of which the operator providing the public mobile communications network directs this call to the most appropriate emergency communication centre for receiving eCall. The eCall routing codes shall be published by the operator ensuring the connection of the emergency communication centre intended for receiving the eCall service to the public communications network.
(2) When the call is connected in case of use of the eCall service, the operator providing the public mobile communications network shall transmit to the emergency communication centre a data message generated by the eCall on-board vehicle unit with the essential vehicle and accident data, which are:
(a) management information:
1. automatic activation or manual activation; and
2. vehicle type,
(b) road vehicle identification number (VIN) 5;
(c) fuel type,
(d) the activation time of the unit;
(e) location data;
(f) direction of travel;
(g) the number of persons in the vehicle.
(3) The data report referred to in paragraph 2 may also contain additional data in accordance with a specified standard or part thereof under another law (6), as notified in the Bulletin of the Office for Technical Standardisation, Metrology and State Testing, which contains more detailed technical requirements.
(4) The location data referred to in paragraph 2 (e) are the coordinates of the location of the vehicle at the time of activation of the call in the WGS84 system. If it is not possible to send the coordinates of the location of the vehicle at the time of activation of the call, the coordinates of the last known location of the vehicle shall be sent.
Call for emergency numbers without using a SIM card
When calling an emergency number without using a SIM card, the emergency communication centre shall transmit the mobile telecommunications device identifier from which the call is made through a signalling system according to the network signalling plan.
Transitional provision
The operator providing the connection to the public mobile communications network of the transmitting entity shall define the localisation data referred to in Article 6 (1) (a) according to the requirements of this decree within 6 months of the date of entry into force of this decree.
Repeal
Decree No. 238 / 2007 Coll., on the scope, form and manner of transmission of personal and identification data, the form of the database of such data and the extent, form and manner of transmission of such data to the entity which operates the emergency call reception centre (Emergency Call Number Order) shall be deleted.
Efficacy
This Regulation shall enter into force on 1 September 2017.
