determining the amount of the recruitment allowance, the transfer and subsistence allowance and the procedure for granting travel and other compensation to professional soldiers
According to § 70, § 73 (1), § 78 and 89 of Act No. 221 / 1999 Coll., on professional soldiers:
Recruitment allowance amount
(1) The recruitment allowance may be granted to an occupational soldier (hereinafter referred to as "soldier"), where the duration of the professional service is set at 2 years, at:
a) 30,000 CZK when achieving secondary vocational education. If the duration of the service is longer, this amount shall be increased by CZK 10 000 for each additional year up to CZK 60 000,
b) 40 000 CZK in full secondary or secondary vocational education. If the duration of the professional service is longer, this amount shall be increased by CZK 10 000 for each additional year up to CZK 70 000,
c) 50 000 CZK in higher vocational education. If the duration of the service for the service is longer, this amount shall be increased by CZK 10 000 each year up to CZK 80 000,
d) 60 000 CZK when achieving higher education in bachelor's study programme. If the duration of the professional service is longer, this amount shall be increased by CZK 15,000 for each additional year up to CZK 120,000,
e) CZK 70,000 in higher education in Master's degree programme. If the duration of the service for the service is longer, this amount shall be increased by CZK 15,000 for each additional year up to CZK 130,000.
(2) The recruitment allowance may be awarded only as the highest level of education achieved.
(3) A recruitment allowance may be granted to a soldier on reemployment if he has not been paid in an earlier occupation, or if he is involved in cases under special legislation. 1) If the recruitment allowance still paid has not reached the maximum amount, determined according to the level of training achieved in paragraph 1, in respect of the reoccupation, the soldier may be paid only up to the difference between the maximum amount of the recruitment allowance in accordance with the training achieved and the amount of the recruitment allowance previously paid.
Amount of diet
The food that is given to a soldier on business trips is for every calendar day
a) 73 CZK, if the business trip lasts 5 to 12 hours,
b) 111 CZK, if the business trip lasts more than 12 hours but not more than 18 hours,
c) 173 CZK, if the business trip lasts longer than 18 hours.
Reimbursement of evidence of necessary incidental expenditure
The necessary ancillary expenditure shall be declared to have been incurred in connection with the performance of mission duties, such as transport and storage charges for service and personal luggage, parking of road motor vehicles, telephone and highway charges.
Procedure for granting compensation on mission
(1) The service authority which sends a soldier on a mission shall determine the place of embarkation, the mode of transport, the place of completion of the mission, the duration, the termination of the mission and, where appropriate, other conditions of the mission.
(2) As the place of departure and the place of termination of the mission, the service authority may designate a designated place of service or another place where the soldier is present on the day on which the mission takes place, if more economical.
Replacement during daily commuting
(1) A soldier to whom daily commute compensation is due (2) shall be provided:
(a) reimbursement of travel expenses for daily commuting from the place of permanent residence of the family to the municipality of the performance of the service, equivalent to proven travel expenses for the second class of passenger train or bus. A higher-quality train supplement or a replacement for bus use, including a seat, shall be paid at a distance of at least 101 km in one direction and the travel costs of local public transport shall be borne when transferring from one mass means of long-distance transport to another. If a soldier uses a private road motor vehicle after prior approval of the service authority to travel on daily commute, he shall be compensated for the amount of travel expenses due to him when using a train or bus,
(b) a diet supplement of 25% of the amount of the diet referred to in Article 2 (c). When providing free breakfast, the diet supplement is reduced by 85%. The period of 11 hours 2) is calculated from the time of leaving the apartment to return to it.
(2) The refund referred to in paragraph 1 shall be granted if the soldier:
(a) has submitted an application for reimbursement; and
(b) his family lives outside his community of service only because he does not have an apartment in this village.
(3) The refund referred to in paragraph 1 shall be granted from the date of service or from the date of transfer if the application for reimbursement is made within 30 days of the date of admission to service or transfer. Where an application has been submitted at a later date, the refund shall be granted from the date on which the application for a refund was lodged.
(4) The total daily amount of the refund referred to in paragraph 1 may not exceed the maximum amount of the diet referred to in Article 2 (c).
(5) A soldier who has not been allowed to return to the family for an important interest in the service, (4) shall be provided for each calendar day of separation from the family according to § 2, depending on the duration of separation from the family.
Compensation as in business travel
(1) Compensation as in the course of a business trip shall be granted if the soldier has applied for their admission and his family lives outside the municipality of his service only because the soldier does not have an apartment in the municipality and the transport connections or service do not allow him to commute daily to the place of residence of the family.
(2) A soldier to whom compensation is due as in the course of a business trip shall be provided with the allowance provided for in Section 2, depending on the duration of the separation from the family in a single calendar day, and the reimbursement of travel expenses provided for in Section 5 (1) (a). Paragraph 5 (3) shall apply mutatis mutandis to the granting of compensation as in the course of a business trip.
Amount of the transfer allowance
(1) A soldier who moves to another apartment in the important interest of the service shall be granted a transfer allowance of 90% of the minimum wage (5) valid on the day of the transfer to the kitchen, the basic accessories (6) and each living room and 45% of the minimum wage for incomplete basic accessories. 6)
(2) The number of rooms shall be determined according to the rental agreement for the apartment, the sublease agreement or any other written legal act under which the apartment is used.
(3) A soldier who moves to an apartment of which he is the owner, co-owner or tenant shall be granted a transfer allowance in accordance with paragraph 1 for a maximum of 5 living rooms, one kitchen and one basic accessory; Where more than one soldier moves to an apartment owned, co-owned or rented by a soldier, they shall be granted an equal transfer allowance from the amount fixed in accordance with paragraph 1.
(4) When moving to an apartment where, after its approval, a soldier becomes its first owner, co-owner or tenant, and when moving to an apartment in sublet or apartment owned, co-owned or in the rental of his wife (spouse), partner (partner) or other person with whom he creates a common household, a transfer allowance equal to one half of the amount determined in accordance with paragraph 1 shall be granted; if more than one soldier moves to the apartment, they shall be granted an equivalent transfer allowance.
(5) The transfer allowance shall be paid to the soldier on a written request after the service authority has confirmed in writing, after assessing the facts contained in the request, that the transfer is in the important interest of the service.
Transitional provision
Compensation as in the course of a business trip and daily commute compensation granted under the current rules shall be deemed to have been granted under this Order. Entitlements arising from travel and transfer operations carried out before the entry into force of this Order shall be assessed in accordance with the provisions in force before 1 December 1999.
This Decree shall take effect on 1 December 1999.
