The Ministry of Foreign Affairs states that the Trade Agreement between the Czech Republic and the Republic of Cyprus was signed in Nicosia on 23 June 1995.
The Agreement entered into force on 3 January 1996 on the basis of Article 9 thereof. The Trade Agreement between the Czechoslovak Socialist Republic and the Republic of Cyprus of 30 June 1978, published under No 51 / 1979 Coll.
The Czech translation of the Agreement is announced simultaneously. The English version of the Agreement can be consulted at the Ministry of Foreign Affairs and the Ministry of Industry and Trade.
TRADE AGREEMENT
between the Czech Republic and the Republic of Cyprus
Government of the Czech Republic and Government of the Republic of Cyprus ("the Contracting Parties')
- recognising that long-term commercial relations are in the interests of both States, and
- wishing to promote and develop economic relations between the two States and, in particular, to help further increase mutual trade on the basis of equality and mutual benefit,
they have agreed as follows:
The Parties shall make every possible effort to promote the sustainable and balanced development of trade between the two States in both goods and services. To this end, the Contracting Parties are committed to ensuring favourable conditions for such development.
The supplies of goods and services between the two States shall be made in accordance with the provisions of the Agreement establishing the World Trade Organisation and this Agreement, as well as the internal laws and regulations in force in both States.
None of the Contracting Parties shall impose restrictions or prohibitions on the importation of any product from the territory of the State of the other Contracting Party or on the export of any product intended for the territory of the State of the other Contracting Party, unless such prohibitions or restrictions are applied against all third States or are authorised by the provisions of the General Agreement on Tariffs and Trade and by the laws in force in both States.
Commercial ships flying the flag of a State of one Contracting Party, with or without cargo, shall enjoy the most favourable treatment granted in accordance with the internal laws, regulations and regulations of any third State during the anchoring or leaving ports of the State of the other Contracting Party. However, these principles will not apply to coastal vessels.
Supply of goods and services according to this Agreements will be made on the basis of contracts negotiated between natural and / or legal persons of the Czech Republic and the Republic of Cyprus.
(1) In order to expand trade between the two States, the Contracting Parties will facilitate the participation of their organisations, firms and firms in trade fairs and trade fairs which take place in the territory of their States.
(2) Products intended for such fairs and exhibitions as well as small tools and apparatus used in the assembly of stands shall be exempt from customs duties in accordance with the relevant laws and regulations in force in the State of each Contracting Party; However, they shall not be disposed of without prior authorisation from the competent authorities of the importing State and without payment of the corresponding customs duties.
(3) Samples without trade value, catalogues, price lists and materials without trade value intended for commercial and tourist promotion will also be exempted from customs duties in accordance with the relevant laws in force in the State of each of the Contracting Parties.
All payments for supplies of goods and services under this Agreement shall be made in freely convertible currencies in accordance with the laws and regulations in force in both States at the time when the payments are made.
Representatives designated by both Contracting Parties will meet at the request of one of the Parties alternately in the Czech Republic and the Republic of Cyprus.
In these negotiations, both Parties shall evaluate the application of this Agreement, assess the problems that may arise in the exchange of goods and services, and consider the manner and means of achieving further development of trade relations between the two States.
This Agreement shall be subject to the national approval of each Contracting Party and shall enter into force on the date of service of the second communication of such approval.
This Agreement shall remain in force for a period of five years and shall then be automatically extended for a further period of one year, unless one of the Contracting Parties notifies the other Contracting Party, at least six months before the expiry of the period of validity, in writing, of its intention to terminate it.
For contractual obligations entered into during the period of validity of this Agreement and not fully fulfilled at the date of termination of this Agreement, the provisions of this Agreement shall remain in force until such obligations have been fulfilled.
The Trade Agreement between the Czechoslovak Socialist Republic and the Republic of Cyprus of 30 June 1978 in respect of the Czech Republic will expire with the entry into force of this Agreement.
Done at Nicosia, 23 June 1995, in two original copies in English, the two texts being equally authentic.
