Decree on the concept of radioactive waste management and spent nuclear fuel

DECLARATION
of 16 October 2019
on the concept of radioactive waste and spent nuclear fuel management
The Ministry of Industry and Trade (hereinafter referred to as "the Ministry ') and the State Nuclear Safety Authority provide, pursuant to § 237 (1) of Act No. 263 / 2016 Coll., Atomic Act, for the implementation of § 108 (3) (a) to (c):
§ 1
Subject matter
This decree implements the relevant regulations of the Euraton1) and provides for:
(a) the content of the concept of radioactive waste management and spent nuclear fuel (hereinafter referred to as the concept);
(b) the method of evaluation and updating the concept; and
(c) a way of informing the European Commission of the evaluation and updating of the concept.
§ 2
Content of the concept
The concept contains
(a) justified and scientifically, technologically, ecologically, financially and socially acceptable targets for the management of radioactive waste and spent nuclear fuel in the Czech Republic;
(b) the milestones for the achievement of the objectives referred to in (a) and the timetable for their achievement;
(c) an inventory of radioactive waste and spent nuclear fuel and an estimate of future quantities, including radioactive waste generated during decommissioning of a nuclear installation, indicating the location and quantity of radioactive waste and spent nuclear fuel in accordance with the corresponding classification of radioactive waste;
(d) strategies or plans and technical solutions for the management of radioactive waste and spent nuclear fuel from generation to storage;
(e) strategies or plans for the life-cycle phase of the radioactive waste storage site after its closure, including the duration of its institutional control, and a description of the long-term retention of knowledge of the radioactive waste storage site;
(f) a description of the research, development and demonstration activities necessary to address radioactive waste management;
(g) the responsibilities of the administrative authorities in implementing the concept and significant performance indicators for monitoring progress in its implementation;
(h) an assessment of the cost of implementation of the concept and the supporting documents and hypotheses for that assessment, which must include a time profile;
(i) a scheme for financing the implementation of the concept;
(j) a description of ensuring transparency in the implementation of the concept; and
(k) a list of contracts concluded with a Member State of Euratom or with another State concerning the management of radioactive waste or spent nuclear fuel, including the use of radioactive waste storage.
§ 3
Method of evaluation and updating of the concept
(1) In assessing and updating the concept, the Ministry takes into account the development and current level of science and technology and recommendations, the experience gained and best practices resulting from the international peer review of the management of radioactive waste and spent nuclear fuel.
(2) In assessing the concept, the Ministry shall analyse the achievement of the objectives of the concept and the state of management of radioactive waste and spent nuclear fuel.
§ 4
Information to the European Commission on the evaluation and updating of the concept
If the European Commission asks for an explanation of the concept or if it expresses its opinion on the concept, the Ministry shall inform it in writing and without undue delay, but no later than six months after receipt of the request. The first sentence shall apply mutatis mutandis to information on evaluation and updating of the concept.
§ 5
Efficacy
This decree shall take effect on the 15th day following its publication.
