of 24 July 2017
on the promotion of electricity and heat from supported energy sources

Subject matter
This Regulation lays down the procedure for determining the amount of aid for electricity or heat under the Law on Supported Energy Sources and the manner in which it is to be paid for the period from the entry into service of an electricity or heat plant until the Energy Regulatory Authority, following a decision by the European Commission on the compatibility of aid with European Union1 (hereinafter the "Commission Decision '), establishes the scope and amount of the aid by price decision.
Amount of aid and method of payment
(1) Where the Energy Regulatory Authority has determined for a given calendar year the amount of aid only during that calendar year, that amount shall apply for the whole calendar year.
(2) If the Energy Regulatory Authority has not determined the amount of aid for producers of electricity or heat for a given calendar year and that calendar year has already expired, the amount of aid fixed by the Energy Regulatory Authority for the following calendar year shall apply for that calendar year at the earliest.
(3) The aid for electricity or heat referred to in paragraphs 1 and 2 shall be paid within 120 days of the date:
(a) the Commission's decision if the amounts of electricity or heat have been transmitted before it is issued; or
(b) transmission of electricity or heat values in other cases.
Transitional provision
Where a Commission decision has been issued and the amounts of electricity or heat have been transmitted before the date of entry into force of this Regulation, the aid shall be paid within 120 days of the date of entry into force of this Regulation.
Repeal
Government Regulation No 402 / 2015 Coll., on the promotion of electricity and heat from supported energy sources, is repealed.
Efficacy
This Regulation shall enter into force on the 15th day following its publication.
