DECLARATION
of 1 September 2022
amending Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and implementation of certain other provisions of the Air Protection Act, as amended
The Ministry of the Environment provides pursuant to Sections 4 (9) and 6 (9) of Act No. 201 / 2012 Coll., on Air Protection, as amended by Act No. 369 / 2016 Coll. and Act No. 284 / 2021 Coll.:
Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and on the implementation of certain other provisions of the Air Protection Act, as amended by Decree No. 155 / 2014 Coll., Decree No. 406 / 2015 Coll., Decree No. 171 / 2016 Coll., Decree No. 452 / 2017 Coll., Decree No. 190 / 2018 Coll. and Decree No. 216 / 2019 Coll., is amended as follows:
1. In Paragraph 14, the following paragraph 5 is added:
"(5) In order to maintain energy supply, for the duration of an emergency or emergency situation under the Energy Act (9) for the entire territory of the State, a stationary source with a total rated thermal input of between 50 MW and 200 MW shall be used for the purpose of maintaining the total rated thermal input, including, for which the first operating permit was issued before 27 November 2002 or for which a full application for a first operating permit has been submitted before that date and which was put into service no later than 27 November 2003, the specific emission limits, emission ceilings and technical operating conditions applicable on 24 February 2022 in the operation permit, provided that at least 50% of the heat supplied for use from the stationary source, expressed as a rolling average over a period of 5 years, are delivered in the form of steam or hot water to the thermal energy supply system under the Energy Code (9). '
2. Paragraph 14 (5) is deleted.
3. In Article 16, the following paragraph 3 is added:
"(3) For the entire territory of the State, the duration of an emergency or emergency in accordance with the Energy Act (9) is not included in the fixed operating hours limit for combustion stationary sources which, according to Part I of Annex No 2 to this Regulation, are subject to specific emission limits for combustion stationary sources with operating limits of up to 1,500 operating hours per year expressed as a rolling average over a period of 5 years, or to combustion stationary sources with a traffic limitation of up to 1,500 operating hours per year for which specific emission limits are set in the operating authorisation under another legislation6."
4. Paragraph 16 (3) is deleted.
5. In Annex No 2, Part II, point 2, point 2.1, Table 2.1.2, in Explanatory Note 1, under the table, the figure "3 200 'is replaced by" 3 600'.
Transitional provision
Until 31 May 2024, the provisions of Section 8 (1) (d) and Section 9 (7) of Decree No. 415 / 2012 Coll., as amended by Decree No. 452 / 2017 Coll. and Decree No. 216 / 2019 Coll., shall not apply to the combustion stationary sources referred to in Section 14 (5) of Decree No. 215 / 2012 Coll., as amended by Decree No. 216 / 2019 Coll., as long as the state of emergency or emergency prevention under the Energy Act persists for the entire territory of the State.
Efficacy
This Decree shall enter into force on the day following that of its publication, with the exception of the provisions of Article 5 (1) (a) and (b). I (1) and Article II, which shall take effect on 1 January 2023, and I, points 2 and 4, which shall take effect on 1 June 2024.
