laying down certain conditions for the implementation of exceptional financial support for the fruit sector affected by adverse climatic events in 2024
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
§ 1
Subject matter
This Regulation provides for certain conditions for the implementation of exceptional financial support for the fruit sector affected by adverse climatic events in 2024 by the State Agricultural Intervention Fund (hereinafter referred to as the Fund) following the directly applicable European Union1.
§ 2
Application for exceptional financial support for fruit growers
(1) The Fund will grant exceptional financial aid to fruit growers (hereinafter referred to as "exceptional aid") at the request of a natural or legal person pursuant to Article 3 (1).
(2) The applicant shall submit to the Fund an application for emergency support by 31 October 2024 at the latest.
(3) At the same time as the application referred to in paragraph 2, the applicant shall deliver to the Fund an agricultural insurance document for the year 2024.
§ 3
Conditions for granting exceptional aid
(1) The applicant for emergency aid may be a natural or legal person who manages the agricultural land on the land in the land use register according to user relations as a type of agricultural culture
(a) fruit orchards registered under Section 3q of the Agriculture Act;
(b) standard arable land in the case of growing strawberries; or
(c) the container area in the case of fruit species.
(2) The Fund shall grant to the applicant the exceptional support referred to in paragraph 1 on the basis of the area of the cultivated part of the soil block or part thereof held in the land use register according to the user relations of the applicant with the type of agricultural culture on 1 June 2024.
(a) fruit orchards registered under Section 3q of the Agriculture Act;
(b) standard arable land in the case of growing strawberries; or
(c) the container area in the case of fruit species.
(3) Exceptional support will be granted to the applicant for an area of a cultivated part of the soil block or part thereof with a specific type of fruit held by the applicant in the land use register under the user relations referred to in paragraph 2, for which the damage to a particular type of fruit was more than 50% on the basis of the Fund's information on the estimation of damage to fruit caused in direct connection with spring frost in 2024.
(4) Exceptional support shall be granted in full by the Fund to the applicant only if the applicant provides proof of the document referred to in Article 2 (3) with insurance cover covering at least 50%
(a) the total areas registered to the applicant in the land use register according to the user relations of a particular type of fruit for which he has requested exceptional support; or
(b) the size of all fruit species referred to in paragraph 1 registered to the applicant in the land use register according to the user relations for which he has requested exceptional support.
(5) The area shall also be considered to be insured under paragraph 4 where the applicant has been established on a cultivated part of the soil block or part thereof kept in the land use register according to the user relations referred to in paragraph 2 of the technical measure on the basis of the information provided by the Fund on the estimation of damage to fruit caused in direct connection with the spring frost in 2024 which serves to protect against climatic phenomena and which is:
(a) an anti-hail or anti-rain system, including supporting structure; or
(b) covering fabrics in the case of growing strawberries.
(6) Exceptional support shall be granted by the Fund to the applicant only in half if the applicant has not fulfilled the condition laid down in paragraph 4 or 5.
§ 4
Publication of exceptional aid rates
The amount of the exceptional support rates shall be published by the Fund by 30 November 2024 at the latest in a way that allows remote access.
§ 5
Refusal of an application for emergency aid
The Fund shall reject an application for emergency support if it finds that the applicant:
(a) it has served the application after the period laid down in Paragraph 2 (2); or
(b) has failed to fulfil the conditions for granting it.
§ 6
Efficacy
This Regulation shall take effect on 1 October 2024.
