DECLARATION
of 6 October 2015
amending Decree No. 5 / 2011 Coll., on the definition of hydrogeological ramifications and bodies of groundwater, the method of assessment of groundwater status and the details of groundwater survey and assessment programmes
The Ministry of the Environment and the Ministry of Agriculture provides pursuant to § 21 paragraph 3 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 150 / 2010 Coll.:
Čl. I
Decree No. 5 / 2011 Coll., on the definition of hydrogeological zones and bodies of groundwater, the method of assessment of groundwater status and the requirements of groundwater survey and assessment programmes, is amended as follows:
1. in Paragraph 2 (d):
"(d) the environmental quality standard as set out in Table 1 of Annex 5 to this Decree,"
2. Paragraph 7 (3), including footnote 10, reads:
"(3) The groundwater quality standards are used to evaluate the chemical status of bodies of groundwater. Where the river basin administrator or the authorised expert body referred to in Article 21 (4) of the Water Act considers that the groundwater quality standards could thwart the achievement of the environmental objectives relating to the related surface water bodies referred to in Section 23a of the Water Act or lead to a significant deterioration of the ecological or chemical quality of those bodies or to significant damage to terrestrial ecosystems directly dependent on the groundwater body, it shall introduce more stringent thresholds in accordance with Table 1 of Annex 5 to this Regulation. The programmes and measures relating to these thresholds also apply to the activities covered by the Water Law and the Government Decree on the establishment of vulnerable areas and the Action programme10).

3. Part of Annex 3 And including the title reads:

„Část A: Kritéria dobrého a nevyhovujícího chemického stavu podzemních vod

(1) The chemical status of the groundwater body is considered to be good if:
(a) results of groundwater monitoring programmes:
1. show no signs of salting or other intrusion of pollutants into the body of groundwater;
2. Inputs of pollutants are not such as to cause failure to achieve the objectives of water protection of related surface water bodies, deterioration of the chemical or ecological status of these surface water bodies or damage to directly dependent terrestrial ecosystems;
(b) the values of the groundwater quality standards or thresholds set out in Table 1 of Annex 5 to this Decree are not exceeded at any monitoring site of the body or group of bodies of groundwater.
(2) Where the value of the quality standard or threshold set out in Table 1 of Annex 5 to this Regulation is exceeded at one or more monitoring points, an investigation shall be carried out for this body of groundwater in accordance with the procedure laid down in Part B of this Annex.
(3) The chemical status of the body of groundwater is considered to be good if the investigation carried out pursuant to paragraph 2 shows that:
(a) the concentrations of pollutants in excess of the groundwater quality standards or thresholds set out in Table 1 of Annex 5 to this Decree do not pose a significant risk to the environment, taking into account the extent of the impact of the groundwater service;
(b) the conditions set out in (a) (1) of this Annex are fulfilled;
(c) the requirements for protected areas established under specific legislation8 are met; and
(d) the function of the body of groundwater from which groundwater is used for the various needs of society, especially for the supply of drinking water to the population, has not been significantly disturbed by pollution.
(4) The chemical status of the groundwater body shall be considered not to be satisfactory if the conditions of good chemical status of the groundwater body as defined in paragraphs 1 to 3 of Part A of this Annex are not met.

4. Part of Annex 5 And including the title reads:

„Část A: Postup hodnocení jakosti podzemních vod

(1) The results obtained from the situation or operational monitoring programmes (hereinafter referred to as the "monitoring programme ') and data obtained through the requirements of other legislation2 shall be used for the evaluation of groundwater quality.
(2) The evaluation of groundwater quality is carried out for all monitoring sites of the groundwater monitoring network of the relevant monitoring programme.
(3) The groundwater quality assessment shall be carried out for the indicators set out in the relevant monitoring programme, at least for all indicators set out in Table 1 of this Annex.
(4) The evaluation of groundwater quality for monitoring sites which are not part of the groundwater monitoring network is carried out for all indicators obtained through the requirements of other legislation2), while at the same time setting out the relevant monitoring programmes.
(5) The assessment of groundwater quality is based on a comparison of the average annual value (arithmetic mean) at individual monitoring points with an appropriate quality standard or threshold. Where only one measurement value is available, the mean shall not apply.
(6) The evaluation of groundwater quality for substances and group A indicators (Table 1 of this Annex) results in a satisfactory or unsatisfactory groundwater quality.
(7) The quality of groundwater shall be considered satisfactory if no average annual value of the indicator exceeds the limit of the quality standard or threshold set out in Table 1 of this Annex at the monitoring site.
(8) The result of the groundwater quality assessment for group B indicators (Table 2 of this Annex) is the presence or absence of a possible human activity.
(9) The assessment of groundwater quality for group C parameters (Table 3 of this Annex) results only in the determination of their average annual value.
