DECLARATION
of 6 September 2010
amending Decree No. 140 / 2009 Coll., on the method of regulating prices in energy sectors and price regulation procedures
According to Section 98a (2) (f) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of Public Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., and pursuant to Section 12 (3) of Act No. 180 / 2005 Coll., on the Promotion of Electricity Production from Renewable Energy Sources and on the Amendment of Certain Laws (Act on the Promotion of the Use of Renewable Resources), on the implementation of Section 4 (10) of the Act on the Promotion of Renewable Resources:
Čl. I
Decree No. 140 / 2009 Coll., on the method of regulating prices in energy sectors and price regulation procedures, is amended as follows:
1. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) For the purposes of this decree, in the field of gas:
(a) the regional distribution system of the distribution system to which 90 000 or more customer demand points are connected;
(b) a local distribution system of a distribution system to which less than 90,000 customer demand points are connected. ';
2. In Article 2, at the end of paragraph 4, the sentence "The price for the use of the distribution system may be divided into the price for the quantity of electricity distributed in a high tariff and the price for the quantity of electricity distributed in a low tariff."
3. Paragraph 2 (7) is deleted.
Paragraphs 8 and 9 shall be renumbered paragraphs 7 and 8.
4. In Article 3 (1), the words "the distribution of electricity and the activities of the electricity market operator 'are replaced by the words" the distribution of electricity'.
5. in Article 3 (2) (b) (4), "in the distribution system" is replaced by "at individual voltage levels of the distribution system."
6. In Article 3 (2) (b) (5), the words "broken down by voltage levels' are deleted.
7. in Paragraph 3 (2) (b), point 6 shall be deleted;
Point 7 is renumbered point 6.
8. in Articles 3 (2), 3 (4) and 4 (1), the comma shall be replaced by a dot at the end of point (b) and (c) shall be deleted;
9. in Articles 3 (4) (a) and (b) and 7 (4) (a) and (b) (4):
"4. depreciation correction factor,"
10. in Articles 3 (4) (a) (9) and 7 (4) (a) (9), the words "the regulatory base of assets" shall be replaced by "profit."
11. in Article 3 (4), the following points 22 to 26 are added at the end of point (a):
"22. correction factor of the asset base;
23. profit correction factor,
24. correction factor using the transmission network;
25. correction factor for system services,
26. correction factor related to the promotion of electricity from renewable sources, cogeneration and secondary energy sources; ';
12. in Article 3 (4) (b), the following points 19 to 23 are added:
"19th adjustment factor of the asset base;
20. Profit correction factor,
21. Correction factor for electricity distribution activity;
22. correction factor for grid-level support services;
23. correction factor related to the promotion of electricity from renewable sources, cogeneration and secondary energy sources. ';
13. in Article 3 (5), the sentences of the second and third paragraphs are replaced by the following: "If the Authority decides on the different determination of the permitted revenues and cost variables of the distribution system operator under the Energy Act, it shall proceed accordingly to adjust the electricity distribution prices of the local distribution system operator in accordance with Annexes 3 and 4 to this Decree."

14. in Article 4 (1) (a) and (3), "10 September" is replaced by "5 October."
15. in Article 4 (1) (b), (3) and (4), "10 October" is replaced by "25 October."
16. Paragraph 4 (2) is deleted.
Paragraphs 3 to 7 shall be renumbered paragraphs 2 to 6.
17. in Paragraph 4 (4), "31 October" is replaced by "5 November."
18. in Paragraph 7 (4), the following points 20 to 24 are added at the end of point (a):
"20. Correction factor for the asset base;
21. Profit correction factor,
22. correction factor for gas transport activity;
23. coefficient of allocation of actual gas transmission revenue at entry points;
24. value of permitted sales for the activity of international gas transport at entry points, '.
19. in Article 7 (4), the following points 12 to 14 are added at the end of point (b):
"12. adjustment factor for the asset base;
13. profit correction factor,
14. correction factor for gas distribution activity; ';
20. In Article 7 (5), the sentences of the second and third paragraphs are replaced by the following: "If the Authority decides on the different determination of the permitted revenues and cost variables of the distribution system operator under the Energy Act, the adjustment of the gas distribution prices of the local distribution system operator shall be made in accordance with Annex 9 to this Decree. '
21. In Article 8, the words "and gas distribution prices' shall be added at the end of the text of paragraph 2.
22. The following Section 9a is inserted after Section 9, including the title:
„§ 9a
Method of regulation and pricing procedure for evaluation, clearing and settlement by the market operator in electricity and gas
(1) The Authority regulates the price for the activities of the market operator in electricity and gas as set out in Annex 5 to this Decree.
(2) The pricing process for the evaluation, clearing and settlement of derogations by the market operator in electricity and gas is set out for a regulatory period using a regulatory formula.
(3) For the regulatory period, the Authority shall determine and notify to the licence holder the parameters of the regulatory formula separately for electricity and gas activities to the following extent:
(a) the starting value of the authorised costs;
(b) the annual value of the efficiency factor;
(c) price index coefficient of business services;
(d) the price index of the services provided in the field of programming and consultancy.
(4) Changes to the parameters of the regulatory formula referred to in paragraph 3 shall only be possible during the regulatory period where:
(a) amendments to the legislation directly related to the licensed activity of the licence holder which have a significant impact on the parameters of the regulatory formula;
(b) exceptional changes in the electricity or gas market or other exceptional changes in the national economy which are of particular concern;
(c) setting parameters on the basis of incorrect, incomplete or false supporting documents or data.
(5) For a regulated year, the Authority shall determine and notify the parameters of the regulatory formula to the licence holder for the activities of the market operator, to the following extent:
(a) the value of the consumer price index;
(b) the value of the business services price index;
(c) the value of the price index of services provided in the field of programming and consultancy;
(d) the value of the planned depreciation of fixed assets for electricity activities and the value of the planned depreciation of fixed assets for gas activities;
(e) depreciation correction factor for electricity activities and depreciation correction factor for gas activities;
(f) the adjustment factor for the evaluation, clearing and settlement of variations in electricity and the correction factor for the evaluation, clearing and settlement of variations in gas;
(g) the estimated value of electricity collection and consumption for the calculation of the prices of the regulated year;
(h) the planned quantity of gas for the determination of the price per regulated year in the gas industry;
(i) revenues from other electricity activities and revenues from other gas activities;
(j) the market factor for electricity activities and the market factor for gas activities;
(k) the rate of return on authorised costs for energy elective activities and the rate of return on authorised costs for gas activities.
(6) The Authority shall notify the market operator of the parameters of the regulatory formula no later than 5 months before the start of the regulatory period, if it is the parameters referred to in paragraph 3, and no later than 15 September before the beginning of each regulated year, if it is the parameters referred to in paragraph 5.
(7) By 30 September of the calendar year preceding the regulated year, the Authority shall notify the market operator of the calculated price for the regulated activities. '
23. in Paragraph 10 (6), the word "final" shall be deleted;
24. Paragraph 11 (2) is deleted and paragraph 1 is deleted.
(25) Annexes 1 to 5 shall read as follows:

PZTpei [MWh] is the allowed amount of transmission loss for the regulated year, determined by the relationship

KFpepsi [CZK] is the transmission system operator's correction factor for the electricity transmission activity resulting from the use of transmission networks in i-2, converted to year level even with the application of the time value of the money determined in accordance with Annex 7 to this Decree,
RPME2peoi [MWh] is the assumed amount of electricity carried over (electricity from the transmission system for a regulated year subject to the transmission system use price); It consists of direct purchases from the transmission system (without transit, without export), of pump-operated pumps and of producers, including their purchases for the production of electricity or for the production of electricity and heat, and of a balance sheet transformation to lower voltage levels.
The annual payment for booking the capacity of the transmission network to the RPRK customer (PS- VVN) ki in CZK is calculated by the regulatory formula

The calculation average single component price for transmission of electricity cpei in CZK / MWh, including correction factor, is determined as informative.

RPME1peoi [MWh] is expected to transfer the amount of electricity (electricity from the transmission system) for a regulated year, which consists of direct consumption from the transmission system (without export, without the consumption of pumped-in hydropower plants in pump operation, without transit and without the purchase of producers, except for producers of the second category, to cover consumption on the premises of the production plant) and the balance sheet of transformation to lower voltage levels.
No rounding is carried out during the calculations.
