DECLARATION
of 6 August 2003
amending Decree No. 326 / 2001 Coll., implementing § 18 (a), (d), (g), (h), (i) and (j) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, as amended, for meat, meat products, fish, other aquatic animals and their products, eggs and their products
According to Article 18 (a), (d), (g), (h), (i) and (j) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, as amended by Act No. 119 / 2000 Coll., Act No. 306 / 2000 Coll. and Act No. 146 / 2002 Coll., ("the Act ') and in accordance with European Community law, *) for meat, meat products, fish, other aquatic animals and their products, eggs and products thereof:
Decree No. 326 / 2001 Coll., implementing § 18 (a), (d), (g), (h), (i) and (j) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related acts, as amended, for meat, meat products, fish, other aquatic animals and their products, eggs and their products, shall be amended as follows:
1. Article 1, including footnotes 1), 2), 3) and 4) shall read as follows:
For the purposes of this decree:
(a) meat - all parts of animals which are fit for human consumption, (1) the applicability of which has been decided in accordance with specific legislation, (2)
(b) poultry meat - all edible parts of bodies of domestic avian species belonging to the fowl, turkey, guinea fowl, duck and goose families meeting the requirements of the specific legislation, 3)
(c) fresh meat - meat with the exception of poultry meat, including meat packed in vacuum or in a protective atmosphere for which no treatment other than cooling or freezing has been used for preservation, complying with the requirements of the specific legislation, 2)
(d) fresh poultrymeat - poultrymeat, including meat packed in vacuum or in a protective atmosphere for which no treatment other than cooling or freezing has been used to preserve it, complying with the requirements of the specific legislation, 3)
(e) carcase - whole carcase of the slaughtered slaughter animal except for poultry under special legislation, 2)
(f) carcase of poultry - whole body of poultry under special legislation, 3)
(g) meat of cuts - broken down, cuts of carcases of animals resulting from the processing of fresh meat to be put into circulation,
(h) mechanically separated meat - meat intended for the manufacture of heat-treated meat products, obtained by the machinery separation of the residues of meat remaining on bones after boning, excluding bones from frozen meat, head bones, bones of the limbs under the wrists and forequarters, the tail vertebrae of pigs and the bones of bovine, ovine and caprine animals, in establishments where the bone is horny and the cell structure of the meat is broken;
(i) poultry meat mechanically separated - poultry meat intended for the manufacture of heat-treated meat products, obtained by the machinery separation of the residues of meat remaining on bones other than bones of frozen meat, bones of poultry head, bones of the limbs under the wrists and forequarters, feet of poultry and tail vertebrae, as well as of the neck skin of poultry, in establishments where the bone is horny and the cell structure of the meat is broken;
(j) minced meat - meat referred to in point (a) cut or ground by a mill,
(k) offal - fresh meat other than carcases under special legislation, 2)
(l) offal of the thoracic, abdominal and pelvic cavities according to special legislation, 2), 3)
(m) poultry offal - fresh poultrymeat other than poultry carcases under special legislation, 3)
(n) bones - bones obtained by cutting carcases,
(o) blood - blood obtained at the time of slaughter of animals for slaughter by an approved technological procedure, 2)
(p) raw fat or raw tallow - fatty tissue obtained by working the carcases of animals for slaughter or cutting meat,
q) beef - meat of young bovine animals, young bull, bull, bullock, heifer, cow,
(r) calf - bodies of animals, regardless of sex, weighing less than 160 kg of carcase and 1 to 7 months of age;
(s) young bovine animals - male and female animals with a carcase weight exceeding 160 kg and aged from 8 to 12 months inclusive;
(t) young bull - uncastrated male animals older than 12 months and up to and including 24 months,
(u) bull - uncastrated male animals from the age of 9 months,
(v) bullock - male castrated animals over 12 months of age,
(w) heifers - unheated female animals over 7 months of age,
(x) cow - female animals that have already calved,
(y) veal - meat of calves,
(z) pigmeat - pig meat,
(aa) sheep meat - sheep meat,
(bb) lamb meat - meat of lambs aged not more than 12 months,
(cc) goat meat - goat meat,
(dd) kid - no more than 5 months old,
(ee) horse meat - horse meat,
(ff) foal meat - foal meat not exceeding 18 months old,
(gg) chicken meat - meat of chickens aged not more than 3 months,
(hh) rabbit meat - all edible parts of the domestic rabbit,
(ii) farmed game meat - all edible parts of wild land mammals and wild birds, including quails, pigeons, pheasants, partridges and runners, bred and slaughtered in captivity;
(j) game - all edible parts of wild game bodies, 4)
(kk) fresh rabbit meat, fresh farmed game meat and fresh game meat - rabbit meat, farmed game meat and game meat, including meat packed in vacuum or in a protective atmosphere for which no treatment other than cold treatment has been used to preserve it.
1) Decree No. 273 / 2000 Coll., laying down the maximum permitted residues of veterinary medicinal products and bioactive substances used in animal production in food and food materials, as amended by Decree No. 106 / 2002 Coll.
2) Decree No. 201 / 2003 Coll., on animal health requirements for fresh meat, minced meat, meat preparations and meat products.
3) Decree No. 202 / 2003 Coll., on animal health requirements for fresh poultrymeat, rabbit meat, farmed game meat and wild game meat.
4) Act No. 449 / 2001 Coll., on hunting, as amended by Act No. 320 / 2002 Coll. and Act No. 59 / 2003 Coll. '.
2. In Article 2 (1), the words "poultry and cuts' are deleted.
3. in Article 2 (2) (a), the words "for poultry not cut" shall be replaced by the words "for poultry carcases not cut into pieces."
4. in Article 2 (2) (b):
"(b) for poultry cuts and fresh poultrymeat, see Annex 1, Table 3."
5. in § 3 (1) (a), the words "under § 1 (l) to (t), (v) and (w)" shall be replaced by "under § 1 (b), (q), (y) to (ii)";
6. the following shall be added to Article 3 (1) (b) and (c), including footnote 6:
"(b) cutting meat by a market-based species referred to in the relevant technical standards, (6)
(c) cuts, fresh poultrymeat, meat packed, rabbit meat and game cuts and packaged, offal, bones, blood, raw fat and minced meat, if not frozen, date of application,
6) ČSN 57 6510 Beef for the section. ČSN 57 6540 Pork meat for cutting. ČSN 57 6570 Veal meat for part. '
7. in Article 3 (1) (d), the words "and offal" shall be inserted after the words "offal."
8. in Article 3 (1) (e), the words "undivided poultry" shall be replaced by the words "undivided carcases of poultry";
9. in Article 3 (1) (f), "poultry cuts" shall be replaced by "poultry carcases cut."
(10) Paragraph 3 (2), including footnote 7, reads:
"(2) Meat of bovine animals packed, packed or unpacked when put into circulation, in addition to the particulars referred to in paragraph 1, shall also bear:
(a) the words "young bovine animals," "young bull," "bull," "steer," "heifer" or "cow,"
(b) the registration number of the animal or group of animals;
(c) the approval number of the slaughterhouse in which the animal was slaughtered or a group of animals slaughtered and the name of the country where the slaughterhouse is situated; the particulars shall be indicated in the form "Place of slaughter: (name of country) (approval number) ',
(d) the approval number of the cutting plant where the carcase was cut and the name of the country where the cutting plant is situated; the particulars shall be indicated in the form "Place of cutting: (name of country) (approval number) ',
(e) the name of the country where the animal was born, where it was fattened and where it was slaughtered; where the name of the country is identical in all cases, the particulars may be indicated by the words "Origin: 'and the name of the country shall be added,
in such a way as to ensure a demonstrable link with the accompanying list of bovine animals. 7)
7) Act No 154 / 2000 Coll., on the breeding, breeding and registration of livestock and amending certain related laws (Breeding Act), as amended by Act No 309 / 2002 Coll. '
11. in Article 3, the following paragraph 4 is added:
"(4) In the case of non-pre-packaged fresh beef, the required data shall be placed in a visible place in the store in writing. '
12. in Paragraph 4 (1), the word "modified" is replaced by the word "worked."
13. In Paragraph 4, the dot is deleted at the end of paragraph 1 and the sentence "and shall comply with the requirements of specific legislation.2), 3) 'is added.
14. in Article 4 (2), the word "modified" is replaced by "worked."
15. in Article 4 (2) (a):
"(a) they must be free from incisions, bruising, bruising, abrasions, bruising and unnecessary injection,"
16. in Paragraph 4 (3), the word "modified" shall be replaced by "worked."
17. Paragraph 4 (4) reads:
"(4) The milk glands and nipples of sows in lactation must be removed."
18.Paragraph 4 (6) reads as follows:
"(6) The uncut carcase of the rabbit is put into circulation withdrawn and gutted."
19. Paragraph 4 (7) reads as follows:
"(7) The uncut carcase of poultry shall be put into circulation without heads and feet. ';
20. in Paragraph 4 (8), the words "Undivided poultry" shall be replaced by the words "Undivided carcases of poultry";
21. In Article 5 (1) and (2):
"(1) After slaughter, the meat referred to in Article 1 (a) must be cooled in accordance with the procedures laid down in the specific legislation.2), 3)
(2) The technological requirements for frozen unsplit poultry carcases, chilled poultry carcases and certain poultry carcases groups are set out in Tables 1 and 2 of Annex 3. '
22. in Section 5, paragraph 3, including footnote 8, reads:
"(3) Checks on the quantities of absorbed water for poultry carcases in the cooling process or checks on the quantities of water released from frozen poultry by defrosting shall be carried out according to the relevant technical standard. 8) The inspection shall be carried out regularly at the slaughterhouse every eight hours. In the case of frozen chickens exposed during chilling to the effects of substances resulting in increased water absorption, the amount of water released by defrosting cannot be checked, but the total quantity of water chemically must be determined in the manner specified in the technical standard. 8) The results of the checks shall be recorded and kept for a period of one year.
8) ČSN 57 3100 Poultry whole and cut, fresh and frozen. Test methods. Determination of free water content. '
23. in Article 5 (4), the words "for cuts of poultry meat shall be carried out as specified in the technical standards" shall be replaced by "including footnote 8 (a)" for cuts of poultry carcases shall be carried out as specified in the relevant technical standards (8), (8a);
8a) ČSN 57 6023 Meat and meat products. Determination of nitrogen content (Reference method). '
24. in Paragraph 6 (2), including footnote (7a),
"(2) Modification of meat and handling of meat must take place for a period of time strictly necessary from a technological point of view and conditions laid down by specific legislation.2), 3), 7a)
7a) Decree No 287 / 1997 Coll., on animal health requirements for animal products. '.
25. in Article 6 (3), the reference to footnote 8 shall be renumbered as a reference to footnote 8b:
"8b) Decree No. 326 / 1997 Coll., implementing § 18 (a), (d), (j) and (k) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related acts, for frozen foodstuffs, as amended by Decree No. 44 / 2000 Coll. and Decree No. 160 / 2002 Coll. '
26. in Article 6 (5), the words "Undivided poultry" shall be replaced by the words "Undivided carcases of poultry";
27th Paragraph 6 (6) reads:
"(6) The poultry carcases shall be put into circulation with or without skin and with or without bones. ';
28. in Paragraph 7 (1):
"(1) For the storage of meat as referred to in Article 1 (a), the conditions laid down in specific legislation2, 3, 7a shall apply and the meat shall be protected from direct sunlight."
29. in Paragraph 8 (1):
"(1) Meat referred to in Article 1 (a) must be transported under the conditions laid down in a specific legislation. 7a) '.
30. in Article 8 (2) (a), the words "unpacked fresh meat" shall be inserted after the words "unpackaged meat."
31. in Article 8 (2) (b) and (c):
"(b) carcases of poultry, fresh poultrymeat and poultrymeat and other meat groups,
(c) carcases of poultry, fresh poultrymeat, poultrymeat and meat products. "
32. in Paragraph 8 (3):
"(3) Unpacked meat, unpackaged fresh meat, fresh poultrymeat and meat products may be transported in one means of transport only if they are stored separately in separate solid transport packages; in the case of unpacked meat, in the case of unpackaged fresh meat, the fresh poultrymeat must be stored in an impermeable solid container. ';
33. in Article 9 (1), the words "pursuant to Article 1 (a)" shall be inserted after the words "When meat is sold."
34. in Article 9 (3), the word "fresh" shall be inserted after the word "cut."
35.
For the purposes of this decree:
(a) meat product - a technologically worked product containing, as the predominant basic raw material, meat, the applicability of which has been decided pursuant to a specific legislation, 2)
(b) meat for the manufacture of meat products - the skeletal muscle of individual mammalian species and birds intended for human consumption, the applicability of which has been decided pursuant to specific legislation, (2), (3) with naturally contained or adjacent tissue, the total fat and connective tissue content not exceeding the levels laid down in Annex 4, Table 2, and the diaphragm and chewing muscles are also considered as part of the skeletal muscle; the use of this definition only applies to the labelling of meat as a constituent contained in a meat product and does not apply to the labelling of meat from which meat is to be sold without further processing and defined as meat under Article 1 (a),
(c) meat mechanically separated - meat mechanically separated for human consumption and meeting the requirements of specific legislation, 2), 3)
(d) heat-treated meat product - a product for which at least a heat effect corresponding to a temperature plus 70 ° C has been achieved in all parts for 10 minutes;
(e) heat-treated meat product - a product intended for direct consumption without further treatment for which no heat treatment of raw materials or products has taken place,
(f) a durable heat-treated meat product - a product for which at least the heat effect of a temperature of plus 70 ° C has been achieved in all parts for 10 minutes and resulting technological treatment (maturing, smoking or drying under defined conditions) has been reduced by the water activity of aw (max.) = 0,93 and the minimum shelf life of 21 days at a storage temperature of plus 20 ° C;
(g) fermented durable meat product - a product not heat-treated for direct consumption for which during fermentation, maturing, drying, or smoking under defined conditions the water activity with a value aw (max.) = 0,93, with a minimum shelf life of 21 days at a temperature plus 20 ° C has been reduced;
(h) meat preparation - uncooked meat as referred to in Article 1 (a), which has been preserved by the internal cell structure of meat and the characteristics of fresh meat and to which food, seasoning preparations or additives have been added, 8c) and which are intended for heat treatment prior to consumption and comply with the requirements of specific legislation; 2), 3) meat preparation shall also be considered as a minced meat product with an added edible salt of more than 1% by weight;
(i) kitchen meat preparation - partially heat-treated prepared meat or mixtures of masses, additives and aids, or other raw materials and flavourings, 8c) intended for heat treatment;
(j) technological packaging - packaging in which the process of processing of the product is carried out and which usually remains part of it;
(k) insert - cut or grain part of the work,
(l) technological processing - any treatment of meat other than cold use;
(m) preserved - product sealed in immediate packings, sterilised under conditions laid down by special legislation7a) to guarantee commercial sterility, 9)
(n) semi-preserved - product sealed in immediate packings, pasteurised under conditions laid down by special legislation, 7a)
(o) pure muscle protein - protein free of binding tissue and protein of plant origin.
8c) Decree No. 53 / 2002 Coll., laying down the chemical health requirements for each type of food and food raw material, the conditions of use of additives, auxiliary and food supplements, as amended by Decree No. 233 / 2002 Coll.
9) Decree No 294 / 1997 Coll., on microbiological requirements for foods, their method of control and evaluation, as amended by Decree No 91 / 1997 Coll. '.
36. In Paragraph 12, the dot is replaced by a comma at the end of paragraph 1 and the following point (c) is added:
"(c) the use of meat mechanically separated, including poultry meat mechanically separated, swine or poultry hides, raw fat or raw fat fat; the marking of meat mechanically separated or poultry meat mechanically separated in the composition of the product shall be indicated by the words" meat mechanically separated "or" poultry meat mechanically separated. "';
37.Paragraph 12 (3) reads as follows:
"(3) The labelling of meat by animal species in the name of the meat product may be used if the meat product contains more than 50% by weight of that meat from the total meat content. This requirement shall not apply to the products listed in Annex 4, Tables 3 to 13. ';
38. In Section 12, paragraphs 5, 6 and 7 are added:
"(5) The packaging of meat products shall indicate the meat content, or meat and meat heat-treated products in the case of meat cans - prepared meals, expressed as a percentage corresponding to their quantity at the time of processing.
(6) Where the meat product is marked with the name "ham ', it shall comply with the requirements set out in Annex 4, Table 3 and shall also be marked with a quality class.
(7) Meat products shall be identified by the name of the species and group referred to in Annex 4, Table 1. The names of meat products for which compositional requirements, sensory requirements and chemical and physical characteristics are specified in Annex 4 to Tables 4 to 13 shall not be used for other products which do not comply with those requirements, in any derived form, including detail and various attributes which might mislead consumers. ';
39. In Article 13 (1), the last sentence is replaced by the following: "In the case of raw parts, solid hides and collagen parts, clusters of spices or other ingredients, unless they are a characteristic of the product."
40. In Article 13, at the end of paragraph 2, the sentence "The taste of meat products must be typical of the product in question and must not show foreign flavours or flavours after the damaged raw material."
41.Paragraph 13 (3) reads as follows:
"(3) The quality and composition requirements of selected meat products are specified in Annex 4 to Tables 3 to 13."
42. Paragraph 13 (4) is deleted.
43.In Paragraph 14 (3), the words "laid down by specific legislation.2) 'are replaced by the words" laid down by specific legislation.2), (3), (7a)';
44. in Article 14 (4), the words "the temperature laid down by specific legislation.2)" shall be replaced by the words "the temperatures laid down by specific legislation.2), (3), (7a)";
45. in Article 14 (7), the words "for standard and consumer classes, pig hams may be used" shall be replaced by the words "for standard hams may be used";

"(8) Further conditions and requirements for meat products and raw materials for their manufacture are laid down in specific legislation.3) '.
47. in Article 15 (1), the words "laid down by special legislation.2)" shall be replaced by the words "laid down by specific legislation.2), (3), (7a)";
48. In Article 15 (4), the following footnote 10 is added after the words "packed or packed ':

EGGS
(1) The quality and marking requirements for eggs are adapted to and governed by the provisions directly applicable in the European Communities. 11)
(2) The code identifying the distinguishing number of the producer, 12) which shall appear on eggs as provided for in the Regulation of the European Communities, 13) shall consist of:
(a) the farming method to be indicated by the appropriate code:
1. "1" for free range laying eggs,
2. "2" for laying eggs in halls,
3. "3" for eggs of laying hens in cages, or
4. "0" for eggs of laying hens kept in accordance with organic farming requirements, 14)
(b) State registration code;
