on the provision of study leave to professional soldiers
According to § 42 (2) of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Subject matter
This decree regulates the scope of the study leave of an occupational soldier ("soldier ') who studies in the course of a service in the form of a study at work, a distance study or a combined study (" study in the course of service') at a secondary school, a higher vocational school or at a conservatory, a university or another studio.
Scope of study leave of a soldier studying in the performance of his duties
A high school student is entitled to study leave in the
(a) 3 hours per week to study;
(b) set out in the curriculum for each school year for participation in study centres;
(c) 3 days in each school year to prepare and carry out tests;
(d) 20 days for the preparation and performance of the final examination.
A soldier who has obtained a full secondary or full secondary vocational education and studies in the performance of his or her duties at a higher vocational school or at a conservatory shall be entitled to study leave within the scope of:
(a) 3 hours per week to study;
(b) set out in the curriculum for each school year for participation in study centres;
(c) 5 days in each school year to prepare and carry out tests;
(d) 20 days for preparation and discharge.
A soldier studying at a university in a Bachelor's and Master's degree programme shall be entitled to study leave in the
(a) 14 days in each school year to study,
(b) a fixed study programme for each school year to participate in study centres;
(c) 2 days to prepare and carry out each test;
(d) 30 days to prepare and carry out the state final examination in the Bachelor's study programme;
(e) 80 days for the preparation and performance of a state final examination in a master's study programme or 60 days if they have already passed a state final examination in a bachelor's degree programme.
A soldier studying in the performance of his duties at a secondary school or in other (additional) education at a university shall be entitled to study leave within the scope of:
(a) set out in the curriculum or study programme for each school year to participate in study centres;
(b) 2 days to prepare and carry out each test;
(c) 20 days for the preparation and performance of the graduation examination or the examination to which the completion of the studies is linked.
A soldier studying in the course of a doctoral study programme shall be entitled to study leave within the scope of:
(a) 7 days in each school year to study,
(b) a fixed study programme for each school year to participate in study centres;
(c) 2 days to prepare and carry out each test;
(d) 40 days for the preparation and performance of the state doctoral examination and for the processing and defence of dissertation.
(1) For a period exceeding 3 months but not exceeding 6 months, a soldier studying in a study other than those referred to in § 2 to 6 shall be entitled to study leave within the scope of:
(a) 2 hours per week for study;
(b) a fixed study programme for each school year to participate in study centres;
(c) 3 days to prepare and carry out the final examination.
(2) A soldier studying in the course of a service for a period exceeding 6 months but not exceeding 2 years for studies not covered by Sections 2 to 6 is entitled to study leave within the scope of:
(a) 7 days in each school year of study;
(b) a fixed study programme for each school year to participate in study centres;
(c) 2 days to prepare and carry out each test;
(d) 5 days to prepare and carry out the final examination.
(3) A soldier studying in the performance of his duties for a period exceeding 2 years in a study not covered by Sections 2 to 6 is entitled to study leave in the
(a) 10 days in each school year to study,
(b) a fixed study programme for each school year to participate in study centres;
(c) 2 days to prepare and carry out each test;
(d) 10 days to prepare and carry out the final examination.
Further study leave
A lone soldier who has permanent custody of at least one child of the age of up to the end of compulsory education and who is entitled to study leave under § 2 to 7 shall be entitled to a further leave of five days in each school year.
Drawing of study leave
(1) The study leave of a soldier, determined by the number of hours per week, can be combined and drawn in whole with the consent of the superior, but not more than 4 weeks. Study leave is drawn on days that are otherwise usual days of service of a soldier.
(2) Study leave can only be taken in the relevant school year. Only study leave for the preparation and completion of examinations may be transferred to another school year.
(3) The study leave cannot be used to prepare for the correction test.
(4) Study leave shall be suspended if, at the time of study leave, a soldier has been recognised as unfit for service for sickness or accident or has treated a sick member of the family; leave of study shall also be interrupted by taking maternity leave. If the study leave is interrupted for more than 1 month, the study leave is for the soldier, determined by the number of hours per week, but no more than 1 month.
(5) The study leave provided for by the number of hours per week is not for the soldier during the period of regular leave during the period of study.
Transitional and final provisions
(1) A soldier who has started his studies before the entry into force of this decree and is studying in the performance of his duties is entitled to study leave under this decree.
(2) A soldier studying in the field of scientific education until 31 December 2001 is entitled to study leave to the extent provided for in Section 6.
Decree of the Ministry of Defence No. 113 / 1996 Coll., implementing certain provisions of Act No. 76 / 1959 Coll., on certain service conditions of soldiers, as amended, is hereby repealed.
Efficacy
This Decree shall take effect on 1 December 1999.
