of 28 April 1992
amending and supplementing the Civil Code, repealing the Law on state notaries and proceedings before state notaries and amending and supplementing certain other laws
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Act No. 403 / 1990 Coll., on the mitigation of the consequences of certain property injustices, as amended, is amended as follows:
1. Article 5 (3) reads as follows:
"(3) If the property is the subject of an agreement to issue the case, Paragraph 133 (2) of the Civil Code shall apply. '
2.
(a) proof of the withdrawal of the amounts referred to in Article 7 or, where appropriate, of the conclusion of a repayment agreement. ';
Note 6a) below the footnotes are as follows:
"(6a) Act No. 265 / 1992 Coll., on Minutes of Owners and Other Property Rights. '.
Act No. 87 / 1991 Coll., on extrajudicial rehabilitation, is amended as follows:
In Paragraph 5 (3), the second sentence reads: "Where a property is the subject of an agreement to issue a property, Paragraph 133 (2) of the Civil Code shall apply. '
Act No 528 / 1990 Coll., Foreign Exchange Act, is amended as follows:
In Paragraph 31 (2) (a), the words "public notaries' are replaced by the words" court '.
Act No. 21 / 1992 Coll., on Banks, is amended as follows:
Paragraph 38 (4) is deleted.
Act No. 92 / 1991 Coll., on the Conditions for Transfer of State Assets to Other Persons, as amended by Act No. 92 / 1992 Coll., is amended as follows:
In Paragraph 19 (3), the words "registration under special regulations (8)) shall not be required 'shall be replaced by the words" property ownership right is transferred by deposit into the property register'.
Note 8) to Paragraph 19 (3) is deleted.
(1) Act No. 95 / 1963 Coll., on State notaries and proceedings before state notaries (notarial order), as amended, is hereby repealed.
(2) The special laws lay down who carries out activities falling within the competence of state notaries under the existing rules.
(3) The District Court, in the district of which the State notaries were active, shall take over the files, documents, articles, storage facilities and official stamps of the State notaries from the date of application of this Law, unless otherwise provided for in the Special Law.
(4) Government Regulation No 15 / 1953 Coll., on the verification of documents and signatures on documents by national committees, is hereby repealed.
This Law shall take effect on 1 January 1993.
