on the Agreement between the Government of the Czechoslovak Republic and the Government of the Union of Soviet Socialist Republics on the quarantine and protection of agricultural plants against pests and diseases, signed in Prague on 28 November 1947.
On 28 November 1947, the Agreement between the Government of the Czechoslovak Republic and the Government of the Union of Soviet Socialist Republics on the quarantine and protection of agricultural plants against pests and diseases was signed in Prague, which was ratified by the President of the Republic on 18 March 1948 and whose instruments of ratification were exchanged in Moscow on 4 September 1948, which became valid in accordance with Article 9 thereof.
The text of this Agreement shall be published in the Annex to the Collection of Laws. *)

THIS AGREEMENT:
Agreement
between the Government of the Czechoslovak Republic and the Government of the Union of Soviet Socialist Republics on quarantine and protection of agricultural plants against pests and diseases.
The Government of the Czechoslovak Republic and the Government of the Union of Soviet Socialist Republics, intending to conclude an agreement on quarantine and protection of agricultural plants against pests and diseases, appointed by their agents:

who, after submitting their full powers to each other, found them in good and proper form, agreed on the following:
The two Contracting Parties shall undertake:
1. to carry out systematic surveillance on agricultural crops in their territories in order to obtain reports, if pests and diseases of agricultural plants referred to in Article 2 of this Agreement are present or not,
2. to take the necessary measures to locate and destroy outbreaks in Article 2 of this Agreement of listed pests and diseases if they occur in places where they have not been previously.
In the event that particularly dangerous pests appear in the territory of one of the Contracting Parties (Article 2), the Contracting Parties undertake to provide mutual assistance with qualified experts, machines and all other means of combat in order to fully eradicate such pests.
The two Contracting Parties shall draw each other's attention to the occurrence on their territory of dangerous diseases and pests of agricultural plants with the indication of the areas they have taken.
The above mentioned pests and diseases are as follows:
Pears:
1. potato almond - Leptinotarsa decemlineata Say,
2. Potato PWN - Hetirodera rostochiensis Woll,
3rd worm San José - Aspidiotus perniciosus Comst.
Diseases:
1. potato cancer - Synchytrium endobioticum Pers,
2. Phlyctaena linicola Speg.
The list of pests and diseases of agricultural plants which both parties undertake to report to each other may later be amended by mutual agreement of the Parties.
In view of the great danger posed by potato mandelica in the Czechoslovak Republic as well as in the Union of Soviet Socialist Republics, the Contracting Parties have agreed that, from 1947 onwards, the following measures against potato mandeline will be consistently implemented in their territories:
1. They will give details of this pest to the entire population of the Czechoslovak Republic and the Union of Soviet Socialist Republics in the areas adjacent to the Czechoslovak Republic and immediately organise the population for a mass survey of the potato seed in order to detect and then destroy the discovered outbreaks of the named pest.
2. They will inspect all potato seed (in addition to the population survey) by qualified experts within a radius of 10 km from newly discovered and destroyed centres, as well as other particularly vulnerable places to which the potato mandeline could penetrate.
3. Depending on how outbreaks of potato almonds will be discovered, regardless of their size, they will immediately proceed to their destruction by radical means: effective disinfection of the soil and the declaration of quarantine on the municipalities or districts at the discretion of the Phytopathological or relevant quarantine services.
4. They will make the best use of the experience, scientific knowledge and scientific facilities of the Czech Republic's Phytopathological Service and the Quarantine Service of the Union of Soviet Socialist Republics in the joint fight against potato mandelines.
Both Contracting Parties agree that consignments of plant origin, such as: seeds, seedlings, onions, branches, lodges, as well as all consignments for maintenance, feed and industrial purposes, such as: grain, beans and fruits when exported from one country to the other, shall be accompanied by a certificate (certificate) issued by the quarantine or phytopathological service of the agricultural plants of the exporting country confirming that such consignments are not infected with pests or diseases referred to in Article 2 of this Agreement.
If this has not already happened, both Contracting Parties shall, according to their respective jurisdiction, issue rules according to which imports of plant material such as: seeds, onions, branches, seedlings, roots and lodgings from any third State will be carried out only after a check of the phytopathological or quarantine service.
The places and manner of use of this plant material shall also be determined by the authorities empowered to do so.
The two Contracting Parties undertake to specify in their territory border stations through which consignments of plant origin may be imported from third countries, to carry out a careful inspection of such consignments, unless they are infected by pests and plant diseases, to provide the disinfection chambers with the necessary facilities for the disposal of imported plant consignments of the disease and the needs necessary for the accurate identification of pests and diseases.
The Parties agree to notify each other of:
1. All plant protection laws and regulations governing the import of consignments of plant origin as they are to be issued.
2. List of consignments subject to quarantine or phytopathological control on importation into the territory of each Party on 15 January each year.
3. The results of the surveys carried out on the occurrence of pests and diseases referred to in Article 2 of this Agreement, the measures taken against those pests and diseases, as well as the results obtained in the destruction of outbreaks of the diseases. The first report shall be submitted annually on 15 July, the second on 15 October and the third on 31 January.
If outbreaks are detected, a report on the potato mandrel shall be submitted by telegraph immediately.
In order to address issues relating to the practical application of the Agreement and to share information and exchange experience on plant quarantine, the two Parties agree to convene a Czechoslovak-Soviet conference on pest control issues and agricultural plant diseases every year.
The conferences will be convened alternately in Czechoslovakia and the Union of Soviet Socialist Republics; their date and place shall be determined by mutual agreement.
This Agreement shall be subject to ratification as soon as possible and shall become effective after the replacement of the instruments of ratification which will take place in Moscow as soon as possible.
The Agreement shall be concluded for a period of 5 years from the date on which the instruments of ratification are exchanged.
If this Agreement is not terminated in writing at least one year before its expiry, it shall be deemed to be extended for a further five years.
To prove it, the agents signed this agreement and secured their seals.
Dane in Prague on 28 November 1947, in two copies, each in Russian and Czech languages, both of which have the same validity.
