DECLARATION
of 4 October 2007
laying down the conditions of employment for school and school staff set up by the Ministry of Education, Youth and Sports, Region, Municipality or voluntary association of municipalities
In agreement with the Ministry of Labour and Social Affairs, the Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry ') provides, pursuant to § 306 paragraphs 1 and 5 of Act No. 262 / 2006 Coll., the Labour Code:
Scope of legislation
This decree applies to school and school staff set up by the Ministry, Region, Municipality or voluntary association of municipalities.
Procedure relating to termination of employment and dismissal or surrender of the post of Head of Staff
(1) Before termination of employment, the staff member shall inform the employer of the state of performance of the duties imposed. The pedagogical staff shall submit the relevant educational documentation and documentation for the evaluation of pupils and students. An alert shall be made on the transfer of tasks and the surrender of items.
(2) The Director of the School or the School Institute shall, at the end of the term of office, at the end of the term of office of the Director or at the end of the term of office of the Director, forward the agenda relating to the performance of the post of Director to the newly appointed Director; where this is not possible, it shall transmit it in the same way to its representative or to a natural person designated by the founder. An alert shall be made on the transfer.
Working hours of teaching staff
(1) In working time, teaching staff shall:
(a) direct pedagogical activity (1);
(b) other work related to direct pedagogical activity agreed with a pedagogical worker, such as the preparation for direct pedagogical activities, the preparation of teaching aids, the evaluation of written, graphic and other work of pupils, and the work resulting from the organisation of education and education in schools and educational establishments, such as the supervision of children and minors (hereinafter referred to as "pupils") at school and at school-organised events, cooperation with other pedagogical staff, with the educational advisor, with the school prevention methodology, with the methodology of information and communication technology, the study and participation in further training of teachers.
(2) In the absence of direct pedagogical activity, the pedagogical staff may also work at another agreed place (2).
(3) At the same time, when working time is divided into shifts, the principal of the school or school establishment shall schedule direct teaching activities.
(4) Where there is an agreement with a pedagogical worker (3) for a different period of time for his / her appointment of working hours by shift, he / she shall notify him / her of the schedule of working hours no later than 3 days in advance; in the event of a change in the layout of the direct pedagogical activity, it shall, as a general rule, notify it 3 days in advance.
(5) The number of hours of direct pedagogical activity carried out over the weekly period of the hours laid down by the school or educational establishment director shall also be entered in the register of work.
Drawing holidays
The time of taking leave is determined by the school or school establishment director according to the schedule of drawing leave 5)
(a) teaching staff, as a rule, for school holidays;
(b) teachers of nursery schools, taking into account the specific conditions at the workplace, to draw on it mainly at the time of the interruption or limitation of the operation of the kindergarten (6);
(c) teaching staff at school establishments with annual operation throughout the school year.
Free to self-study
The principal of the school or school establishment shall determine the teaching staff taking the leave for further educationin the form of self-studies7), as a general rule, for a period of
(a) autumn, Christmas, midsummer, spring or Easter holidays (8);
(b) the interruption or limitation of the operation of the schools6) or of the school facilities 9); or
(c) where, for exceptional reasons, education and education are not carried out and education services are not provided).
Supervision of pupils
(1) In order to ensure the safety and health of pupils in school or school establishments in education and education and related activities, and in the provision of school services, it is carried out in order to prevent damage to health, property, nature and the environment (12).
(2) Director13) The school or school establishment provides for the supervision of pupils. It shall be based on specific conditions and shall take account in particular of the activities carried out, the age of pupils and their reasonable maturity, transport and other risks.
(3) The pedagogical staff shall, according to the timetable, supervise pupils mainly at the school before the school is taught, during breaks between the teaching hours, as appropriate when crossing between school buildings, school meals and the school staff. If the school director authorises pupils to stay at the school before the school, between the morning and afternoon teaching or after school, he shall ensure that they are supervised. School supervision shall begin at least 15 minutes before the beginning of the morning teaching and 15 minutes before the beginning of the afternoon teaching and end at the earliest by the end of education and education or by providing school services.
(4) The pedagogical staff shall, as instructed by the Director, also supervise outside the school and school establishments, in particular for courses, excursions and other activities resulting from school training programmes or teaching documents, taking part in competitions, shows and, where appropriate, in their preparation and other events organised by the school or school establishment.
(5) During events outside the school or school establishment where the assembly is not a school or school establishment, supervision shall begin no later than 15 minutes before the assembly period at the designated place. At the end of the operation, the surveillance shall end at a predetermined location and at a predetermined time. The place and time of the assembly of pupils and the termination of the event shall be notified at least one day before the event to the legal representatives of pupils.
(6) In addition to a pedagogical worker, supervision may be exercised by other mature staff members of a school or school establishment, provided that they have been duly instructed to exercise such supervision. This lesson shall be recorded.
Efficacy
This Order shall take effect on the first day of the first calendar month following its publication.
