amending Act No 155 / 1995 Coll., on Pension Insurance, as amended, Act No 582 / 1991 Coll., on the Organisation and Implementation of Social Security, as amended, and Act No 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended

Parliament has decided on this law of the Czech Republic:

Čl. I

Amendment to the Pension Insurance Act

Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 134 / 1997 Coll., Act No. 289 / 1997 Coll., Act No. 224 / 1999 Coll., Act No. 18 / 2000 Coll., Act No. 118 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 220 / 2000 Coll., Act No. 116 / 2001 Coll., Act No. 188 / 2001 Coll., Act No. 353 / 2001 Coll., Act No. 198 / 2002 Coll., and Act No. 264 / 2002 Coll., is amended as follows:

1. In the second sentence of Article 11 (2), the words "unless otherwise specified" shall be inserted after the words "to pay this premium."

2. In Article 11, the following sentence is added at the end of paragraph 2: "During the period of insurance referred to in paragraph 1 (a), the persons referred to in Article 5 (1) (a), (d) and (f) shall not be considered as persons referred to in Article 5 (1) (d) and (f) for whom their employer has failed to pay the premiums which he was obliged to pay if the employer is a trading company and such persons are members of the company's statutory body or supervisory board; for the purposes of part of the sentence in front of the semicolon, debt periodic penalty payments shall not be considered to be due. The provisions of the third sentence shall not apply if premiums due per calendar month have been paid within three years of the due date of such premiums. ';

Amendment of the Act on the organisation and implementation of social security

Act No. 582 / 1991 Coll., on the organisation and implementation of social security, as amended by Act No. 590 / 1992 Coll., Act No. 37 / 1993 Coll., Act No. 160 / 1993 Coll., Act No. 307 / 1993 Coll., Act No. 241 / 1994 Coll., Act No. 118 / 1995 Coll., Act No. 160 / 1995 Coll., Act No. 134 / 1997 Coll., Act No. 220 / 1997 Coll., Act No. 238 / 2000 Coll., Act No. 93 / 1998 Coll., Act No. 140 / 1999 Coll., Act No. 133 / 1999 Coll., Act No. 155 / 2000 Coll., Act No. 118.

1. In Paragraph 37 (1), at the end of point (g), the dot is replaced by a comma and the following point (h) is added:

"(h) if the company is a commercial company, the list of members and members of the statutory body and supervisory board of that company for each calendar month and an overview of the calendar months for which the company did not pay social security contributions and the contribution to the State employment policy which it was obliged to pay."

2. In Paragraph 37, the following paragraph 7 is added:

"(7) If a commercial company [paragraph 1 (h)] does not have a legal successor, it shall transmit the information referred to in paragraph 1 (h) to the district social security administration referred to in the first sentence of Paragraph 39 (1). ';

Čl. III

Amendment of the Social Security Insurance Act and contribution to the State Employment Policy

In Section 12 of Act No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by Act No. 307 / 1993 Coll. and Act No. 160 / 1995 Coll., the following paragraph 3 is added:

"(3) The premium owed by the company may also be paid by a member of the company's statutory body or supervisory board; This shall also apply to the person who was this partner or member. ';

Čl. IV

Transitional provision

The period of pension insurance before the date of application of this Act shall be assessed in accordance with the provisions in force before that date.

Čl. V

Efficacy

That law shall take effect on the first day of the calendar month following its publication.
