laying down the method and procedure for verifying the organisation's safety reliability
According to § 54 (5) of Act No. 148 / 1998 Coll., on the protection of classified information and on the amendment of certain laws, hereinafter referred to as "the Act":
§ 1
Subject matter
This Decree sets out the manner and procedure for verifying the security reliability of organisations as defined in the provisions of Section 2 (8) of the Act to which classified information is provided or for which classified information is generated, the model of the organisation's security questionnaire and the manner in which it is completed and the models of other forms.
§ 2
Request for certification
The model of the application for a certificate pursuant to Section 54 (4) of the Act is set out in Annex 1.
§ 3
Organisation Security Policy
(1) The Security Policy of the Organisation defines the objectives of the Organisation in the field of the protection of classified information, specifies the classified information in the Organisation and its expected scope in the realisation of business plans, their locations, the assessment of possible risks to the security of classified information and the methods of using the means of protecting classified information provided for in Sections 47 to 54 of the Act.
(2) The organisation's security policy within the meaning of Article 59 (4) (b) of the Act is a written document containing a summary of the organisational, management and control measures to ensure the protection of classified information.
(3) In order to implement the security policy, the organisation processes the security project of the organisation in accordance with the provisions of Section 60 of the Act.
§ 4
Organisation Security Project
The safety project of the organisation, other than those provided for in the provisions of Paragraph 60 (2) of the Act, includes:
(a) the nature, scope and degree of secrecy of classified information to be provided to the organisation or to be generated within the organisation;
(b) the workplace and the places where classified information will occur;
(c) potential risks to classified information;
(d) ways of using the means of protecting classified information and determining the responsibility for their application;
(e) organisational recommendations for the implementation of the security project;
(f) control measures;
(g) the timetable for implementation;
(h) material and financial claims;
(i) for persons who are familiar with classified information, the classification level for which they have been designated in accordance with the provisions of Section 38 of the Act.
§ 5
Safety questionnaire of the organisation
(1) The completed safety questionnaire of the organisation, the model of which appears in Annex 2, is the basis for verifying the organisation's safety reliability.
(2) The completed safety questionnaire of the organisation is used only for the purpose of carrying out the organisation's security clearance.
§ 6
Method and procedure for verifying the organisation's safety reliability
Verification of the safety reliability of the organisation, as one of the conditions for issuing a certificate under § 55 (c) of the Act, is carried out by implementing the measures referred to in § 59 (4) of the Act. The purpose of this verification is to determine whether there are facts for an organisation that can be classified as a security risk under the provisions of Section 58 (2) of the Act and, in the assessment provided for in Section 59 (4) (e) of the Act, whether the facts found are a security risk.
§ 7
Confirmation and notification
(1) The National Security Authority (hereinafter "the Office") shall issue and send a certificate to the organisation in accordance with the provisions of Section 62 (1) of the Act within 30 days of the end of the organisation's security clearance. The model of the certificate is set out in Annex 3.
(2) The Office shall send the organisation a notification of the non-issuance of a certificate pursuant to Article 62 (2) of the Act within 30 days of the date of completion of the organisation's security clearance. The model of the notification is set out in Annex 4.
§ 8
Efficacy
This decree shall take effect on the day of its publication.
