GOVERNMENT REGULATION
of 18 June 2025
establishing the spa site Karviná and the status of the spa site Karviná
The Government orders pursuant to § 28 (2) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Places and on the amendment of certain related laws (Spa Act):
Subject matter
This Regulation lays down the spa place Karviná and the status of the spa place Karviná.
Spa place
(1) The spa place of Karviná is hereby established.
(2) The territory of the spa area consists of the designated territory in the urban areas of Karviná - Fryštát, Spa Darkov, Paradise, Mizerov and Hranice, in the cadastral territories (hereinafter referred to as "K.") of the Karviná- town, Paradise and Darkov referred to in paragraph 3.
(3) The area of the spa site is on the basis of the basic topographical map of the Czech Republic on the scale 1: 10 000 with the distinction of the external and internal territories of the spa site graphically indicated in Annex 1 to this Regulation. The external territory of the spa site is defined verbally in Annex 2 to this Regulation. The list of refraction points of the external boundaries of the spa site in the coordinate system of the Single Trigonometric Catastral Network (S-JTSK) is set out in Annex 7 to this Regulation.
(4) The spa area includes the internal territory of the spa area of the border and the internal territory of the spa area of Darkov.
(5) The internal territory of the Boundary spa area consists of zone A, zone B and other demarcated areas. The internal territory of the Boundary spa site is graphically marked in Annex 3 and defined verbally in Annex 4 to this Regulation. The list of refraction points of the boundaries of the internal territory of the Boundary Spa Point in the coordinate system of the Single Trigonometric Network (S- JTSK) is set out in Annex 8 to this Regulation.
(6) The internal territory of the Darkov spa area consists of zone A, zone B and other demarcated areas. The internal territory of the Darkov spa site is graphically marked in Annex 5 and defined verbally in Annex 6 to this Regulation. The list of refraction points of the boundaries of the internal territory of the Darkov spa site in the coordinate system of the Single Trigonometric Network (S-JTSK) is set out in Annex 9 to this Regulation.
Spa site status
In the external territory of the spa site, it is prohibited to carry out structures, facilities and their changes which could adversely affect the provision of spa rehabilitation care in the internal territory of the spa site by physical, chemical or biological pollutants or by the effects of noise and vibration; This does not apply to the repair and maintenance of transport infrastructure structures.
In the inner territories of the spa site is prohibited
(a) carry out the construction and installation of agricultural production and associated storage facilities;
(b) to carry out and modify the construction and installation of industry, warehouses, wholesale and maintenance equipment and infrastructure;
(c) carry out construction of first-class motorways, roads and local roads;
(d) disseminate sound ads from mobile devices and stationary sources;
(e) to disseminate illuminated advertisements dazzling, flashing and otherwise harassing; for the purposes of this Regulation, the designation of spa buildings and buildings of medical facilities, including the lighting logo of spa facilities and medical facilities, as well as the navigation system of spa facilities and medical facilities, is not considered as a light advertisement;
(f) to feed stray and wild animals in places related to health facilities;
(g) carry out activities and work using machinery and equipment exceeding the limits of noise or vibration laid down by the Government's regulation on the protection of health against adverse effects of noise and vibration on working days and on Saturdays between 18: 00 and 08: 00, on Sundays and on public holidays or other holidays all day; and
h) operate discos, gambling rooms, casinos and night clubs.
In zones And the inner territory of the spa is forbidden
(a) keeping livestock and animals requiring special care as provided for in the Ordinance on the protection of species of animals requiring special care;
(b) to carry out construction and changes in construction, changes in purpose, use of areas or parts thereof not related to the purposes of the spa or sports and relaxation activities of spa guests, providing health services and corresponding spa and civic facilities and transport and technical infrastructure or not related to the protection of the green area;
(c) to carry out construction and changes to the buildings of the family and residential houses, except for the necessarily necessary housing units of spa staff owned by the operators of the facilities for providing health services on the territory of Karviná.
(1) In zones B of the internal territory of the spa site, the entry, operation and parking of vehicles, excluding vehicles of the components of the integrated rescue system and the municipal police, vehicles of a spa or other medical facility, medical devices for disabled persons and mechanisation for the maintenance of green and spa buildings and facilities and cleaning of such premises are prohibited outside the areas intended for parking of spa guests. Cyclists are allowed to enter only on marked cycling paths or cycling routes.
(2) The free movement of animals is prohibited in zones B of the internal territory of the spa site. This restriction does not apply to animals of the integrated rescue system, municipal police and the Czech Army.
Efficacy
This Regulation shall take effect on the 15th day following its publication.

Definition of the external territory of the spa site Karviná
The outside area of the spa area Karviná is located in k. ú. Karviná- town, Paradise and Darkov. The total area of the outer area is 1434,4 ha. The border of the outer territory begins on its west side at the intersection of the I / 67 road with the street Whitelišlo in the cadastral territory (hereinafter referred to as "K. ú.") Karviná- the city and from there it runs in a northeast direction along the street Bělidlo and along the streets Ostrava and the 3rd of November to the intersection with the street Red Army. Here it turns north along Red Army Street and continues this way to the intersection with U Vodárny Street. Here the border turns and runs in the northeast direction along U Vodárny street to the intersection with Mickiewicz street, from there it continues in the southeast direction along the cadastral border between K. Ou. Karviná- town and Lower Marklovice first parallel to the street Mickiewicz street, later from the property no. 2383 in K. Karviná- town continues northeast along the border of the cadastral territory and the border of the Borek forest to the state border with the Republic of Poland (the U Vodárny and Mickiewicz streets are part of the spa place).
The border of the outer territory follows the national border with the Republic of Poland first in the southeast, then south and southwest direction around the town of Karviná- town and Paradise to the street of Borovský v ok. ou. Paradise and from there it continues northwest to the intersection with U Farma (Borovský street is part of the spa place). It continues along U Farma street in the south direction to the intersection with Polish street and from there it runs along the Polish street southeast and again connects to the state border with the Polish Republic (Polish street is part of the spa place, U Farma street is not part of the spa place). It continues in the southwest direction along the state border to the range between K. Darkov and Louky nad Olší. From there it runs along this cadastral border, intersecting the Olše river trough and continues to the east edge of the I / 67 road. Here the border turns and takes place along this road in the northwest direction, around 340 m turn west towards the plot No 819 / 15 in K. Darkov and further along the reinforced area with asphalt surface until the intersection with the special purpose road on the plot No 2446 / 1.
The outer edge of the area is first turned north, later west and continues southwest to west along the field road, the above-ground line and along the north-west edge of the plot No 835 (K. Darkov), then along the south edge of the plot No 1122 / 13 and No 1115 / 1 (K. Darkov). At the next intersection of the field roads on the plot No 1151 / 1 (k. ú. Darkov), the border turns northwest and takes place along the field road and later along the northern and northwest paths along the west bank of the water tank Karvinska Sea to the edge of the road III / 4687. From there it continues in a northeast direction along the edge of the road III / 4687 and III / 4687h until the intersection with the street Tesínská. Here it turns northwest along the Těšínská street, undergoes the tunnel embankment of the road I / 67 and continues along the north-east to east edge of the embankment of the road I / 67 north-west towards the starting point of the boundary of the outer area at the intersection of the road I / 67 with the street Whitidlo in the k.

Definition of the internal territory of the Karviná spa site border
The inner area of the spa area Hranice is located in the k. u. Karviná- town. Its total area is 63.2 ha. The border of the inner territory begins on the street Žižkova on the edge of the sidewalk near the property no. 1793 / 43, heading along the street Žižkova northeast towards the intersection with the street Čsl. army. At the intersection point with the street of the Czechoslovak army near the plot No 3988 / 9, it turns north and continues along the eastern edge of the street of the Czechoslovak army in the northwest direction to the point of the plot No 2762, where it turns north and continues according to the forest path to the fence at the border of the plot No 2472 and 2798. Here it turns and takes place northeast along the edge of the forest and fencing the land up to the edge of the communication on Mickiewiczova street near the property No 2744 / 3. The border from here continues along the road on Mickiewicz Street southeast to the intersection with Zizkov Street.
From there the border of the inner territory is facing southwest along the northern edge of the road on Zizkov Street to the intersection with Chodská Street, here it turns southeast, continues to the intersection with Forest Street, here it turns southwest along the street to the forest park Dubina. The border passes along the pavement of the forest park Dubina in the southwest direction, later connecting to the road Stavbari, along the north edge of the street Stavbari up to the south edge of the pavement on the plot no. 4169, here it turns northwest and along that direction along the pavement along the edge of the forest park Dubina back to the starting point of the border of the internal territory on the street Žižkova.

Definition of the internal territory of Darkov spa site Karviná
The internal area of the spa site Darkov is located at the interface of K. Darkov and Paradise. Its total area is 26.3 ha. The border of the inner territory begins east of the Sokolovska Heroes Bridge near the concrete flood wall on the Spa Park street at the west border of the property No. 6 in K. Darkov and from there it runs in the north direction along the eastern edge of the communication street Spa. In the case of plot No 2423 / 1, it turns in a northeast direction along that plot and the elevated terrain wall of the former tram track and later along the eastern edge of the pavement on the grounds No 45 and No 4009 / 6 to the bridge over the water stream Mlýnka. Here the border turns south to south-easterly along the axis of the water flow Mlýnka and heads up to near the property No. 430 / 1 in K. paradise. Here the border of the inner territory diverts from the water stream Mlýnka to the southwest along the fenced west edge of the garden settlement to the pavement on the plot No 488 / 1 in K. paradise. From there, the west to south-west continue along the pavement and the plot No 488 / 1 in the Czech Republic and later along the plot No 4 / 1 in the Czech Republic. Darkov to the concrete wall on the plot No 2411 / 5 (part of the right-cut flood dam of the river Olše) and along this concrete wall takes place in the western direction towards the starting point at the Sokolovska Heroes Bridge.
