on the procedure for the service evaluation of professional soldiers and their aspects
According to § 17 (3) of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
§ 1
Professional evaluation of professional soldiers
(1) A professional soldier ("soldier") is the assessment and value of the results achieved. The soldier is evaluated by his closest superior (the "evaluator ').
(2) The evaluation shall be carried out by an evaluator who has known the rated soldier from his professional grade and service for at least 6 months. If the assessor fails to comply with this condition, the assessment shall be carried out by his nearest superior or designated assessor from a level of management of one degree higher than that of the rated soldier who has known the rated soldier from his professional qualification and service for at least 6 months. Soldiers directly subordinate to the Minister of Defence of the Czech Republic, to its Deputy and Chief of Staff of the Army of the Czech Republic are evaluated regardless of the period of direct subordination.
(3) The written evaluation shall be carried out on the prescribed forms, the models of which appear in Annexes 1 to 6. It shall be made out in one copy which shall be entered in the personal file of the soldier.
§ 2
Types of service evaluations
The staff evaluation shall have the following types:
(a) continuous evaluation;
(b) periodic evaluation;
(c) career evaluation,
(d) special evaluation;
(e) physical fitness assessment.
§ 3
Continuous evaluation
Continuous evaluation shall be an assessment of the way in which the service tasks are performed and the conduct of the soldier. It is the basis for other types of military assessment. This evaluation is conducted by the evaluator in interview with the soldier. The assessor shall decide if the results of the interim evaluation are recorded.
§ 4
Periodic evaluation
(1) Periodic evaluation is a regular written assessment of the professional qualities of the soldier as set out in Annex 1.
(2) The professional quality of a soldier is evaluated in a system of eighteen aspects using a five-point scale. A soldier shall be evaluated in relation to the requirements imposed on him in the performance of his service in the service of classification and performance of the duties imposed. It shall be processed once a year at the end of the training year, no later than 31 January of the following calendar year.
(3) A special form of periodic evaluation is the evaluation of soldiers who study daily in military schools. These soldiers are evaluated in writing at the end of each school year.
(4) Periodic evaluation not for soldiers
(a) directly subordinate to the Minister of Defence of the Czech Republic, Deputy Minister of Defence and Chief of the General Staff of the Czech Army,
(b) who have been seconded to courses with a study period of more than 6 months;
(c) who, during the evaluation period, have served in the service for a period of less than 6 months;
(d) who have been unable to serve for sickness or accident for more than half of the period under assessment or who have been granted leave without a right to cash requirements for that period;
(e) for which a career evaluation has been carried out in a given year which is not more than 6 months old;
(f) for which a decision has been taken to release from service or who have applied for release from service or who, by the end of the calendar year, the specified duration of the service expires.
(5) The periodical evaluation also does not apply to professional soldiers who have been on maternity leave or other maternity leave for more than 6 months during the evaluation period.
(6) If a soldier has been assessed in at least six aspects of the last periodic evaluation at 0, he is not fit for further service.1)
§ 5
Career evaluation
(1) Career assessment is a written assessment of the professional competence of a soldier in accordance with Annex 2. It shall assess the soldier's personality, performance, ability, knowledge and overall competence for the expected future of the service and changes in the service classification. Processing
(a) prior to the decision to change the duration of the service;
(b) prior to the official assignment of a soldier to a systemised place of a higher rank;
(c) at completion of studies at military school,
d) once every 2 years, to soldiers directly subordinate to the Minister of Defence of the Czech Republic, Deputy Minister of Defence and Chief of the General Staff of the Army of the Czech Republic,
(e) as a result of a long-term failure to fulfil duties imposed or serious deficiencies in the service activities;
(f) if there is to be a change in the subordination of the rated soldier and the rated time exceeds 6 months.
(2) Career evaluation shall not be processed if less than 1 year has elapsed since the previous career evaluation; in that case, only the addition to the career evaluation referred to in Annex 3 shall be processed.
§ 6
Special evaluation
A special evaluation is a comprehensive assessment of a soldier's personality by means of a psychological examination or assessment of language knowledge. It shall be processed in writing, depending on the service classification, which, by its nature, requires a soldier to have special mental fitness for the performance of his or her duties or a specified degree of linguistic knowledge, in accordance with Annex 4 or Annex 5.
§ 6a
Physical fitness assessment
Physical fitness assessment is an assessment of the ability of a soldier to perform his duties physically. It shall be verified annually in the first half of the calendar year in the case of compulsory annual checks. The evaluation shall be carried out in writing in accordance with Annex 6 to this Order. If, on the basis of an annual examination, a soldier is assessed as having "failed 'or has not participated in the assessment due to temporary incapacity for a disease or accident or for other official reasons, he shall be required to participate in the further examination in the second half of the calendar year concerned.
§ 7
Efficacy
This Decree shall take effect on 1 December 1999.
