of 30 November 1994
on the remuneration of members of councils in municipalities
The Government orders according to § 32 paragraphs 1 and 3 of the Act of the Czech National Council No. 367 / 1990 Coll., on Municipality (municipal establishment):
Remuneration of members of the municipal council
(1) The vacant members of the municipal council shall be remunerated monthly in accordance with the type of office to be performed, at the rate laid down in column 1, 2 or 3 of Annex 1 or column 1, 2 or 3 of Annex 2 to this Regulation.
(2) The monthly remuneration shall include a surcharge according to the population of the municipality, calculated in accordance with column 6 of Annex 1 or column 4 of Annex 2 to this Regulation.
(3) In municipalities with entrusted municipal authorities (1), a monthly fee of CZK 1000 is included.
(4) The vacant members of the municipal councils referred to in paragraph 1 shall be remunerated at the rate of the monthly remuneration laid down in the preceding paragraphs, provided that they have actually performed a function of at least 90 calendar days in the calendar half-year.
(5) Until the period referred to in paragraph 4, the period during which a member of the municipal council referred to in paragraph 1 did not perform his duties due to sickness, accident, pregnancy or maternity shall not be counted. No entitlement to further remuneration by a member of the municipal council referred to in paragraph 1 shall arise:
(a) in the first half of the calendar year, where the performance of his duties has ceased before 31 May;
(b) in the second half of the calendar year, if the performance of his duties has ceased before 30 November.
Remuneration of non-authorised members of the municipal council
(1) The municipality may grant, according to the type of function performed, monthly remuneration to the members of the municipal council, up to the amount set out in column 4, 5 or 7 of Annex 1 or to the amount set out in column 5 or 6 of Annex 2 to this Regulation.
(2) The monthly remuneration provided under column 4 or 5 of Annex 1 to this Regulation may be granted by reference to the population of the municipality, up to the amount calculated in accordance with column 6 of Annex 1.
(3) In determining the amount of the monthly remuneration and the allowance by population, account shall be taken of the complexity and responsibility of the duties performed, the personal assumptions and results of the work of a member of the municipal council.
(4) Where an unreleased member of the municipal council performs simultaneously several separate functions listed in column 7 of Annex No 1 or column 5, 6 of Annex No 2, he may receive a cumulative remuneration from the municipality equivalent to the sum of the amounts of each monthly remuneration determined for the performance of those functions in accordance with paragraphs 1 and 3. This does not apply if an unreleased member of the municipal council performs the function of mayor or deputy mayor.
Disposable remuneration of members of the municipal council
(1) An exceptional one-off remuneration may be granted to a member of the municipal council for the fulfilment of exceptional and particularly important tasks of the municipality, the total amount of which in a given calendar year may not exceed four times the remuneration due to him under the functions performed and determined in accordance with § 1 or § 2.
(2) Unreleased members of the municipal council performing functions not listed in column 4, 5 or 7 of Annex No 1 or in column 5, 6 of Annex No 2 may receive an exceptional one-off remuneration for the fulfilment of the exceptional and particularly important tasks of the municipality from the municipal budget. Its total amount in a given calendar year shall not exceed four times the maximum amount of monthly remuneration indicated in column 7 of Annex 1 or column 6 of Annex 2.
(3) In determining the amount of this remuneration, account shall be taken of the complexity and responsibility of the duties performed, the personal assumptions and results of the work of a member of the municipal council.
Common provisions
(1) In determining the surcharge by population, the number of inhabitants resident on 1 January of the relevant calendar year shall be based on the number of inhabitants resident on the territory of the municipality. A hundred people are counted.
(2) Compensation paid to a member of the municipal council who is not long-term relieved of his duties shall be paid by the municipality to his employer in accordance with a special regulation.2)

This Regulation shall enter into force on 1 January 1995.
