GOVERNMENT REGULATION
of 18 June 2025
on the establishment of the Hodonin spa site and the status of the Hodonin spa site
The Government orders pursuant to § 28 (2) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Places and on the amendment of certain related laws (Spa Act):
Subject matter
This Regulation establishes the spa place Hodonin and the status of the spa place Hodonin.
Spa place
(1) The spa place of Hodonin is hereby established.
(2) The territory of the spa site consists of the designated territory of the cadastral territory of Hodonín in accordance with paragraph 3.
(3) The area of the spa site is on the basis of the basic topographical map of the Czech Republic on the scale 1: 10 000 with the distinction of the inner and outer territory of the spa site graphically indicated in Annex 1 to this Regulation.
(4) The internal territory of the spa site is graphically indicated on the basis of the cadastral map in Annex 2 to this Regulation. The outside of the spa area includes the rest of the spa area. Medical facilities providing spa rehabilitation care and public areas related thereto shall be graphically indicated on the basis of the cadastral map in Annex 3 to this Regulation. The list of refraction points of the boundaries of the internal territory of the Hodonín spa site in the coordinate system of the Single Trigonometric Network (S- JTSK) is set out in Annex 4 to this Regulation.
Spa site status
In the outer territory of the spa site, it is prohibited to carry out structures and equipment which could adversely affect the provision of spa rehabilitation care in the inner territory of the spa site by physical, chemical or biological damage or the effects of noise and vibration.
(1) The internal territory of the spa is prohibited
(a) to carry out structures and facilities not related to the purposes of the spa and the operation of the premises in which the health facilities, housing and accommodation are located, and the corresponding spa and civil facilities and transport and technical infrastructure;
(b) to carry out construction, facilities and activities not related to the purposes of the spa, housing and accommodation, as well as the corresponding spa and civic equipment or to the protection of the green, which would result in a permanent reduction in the area of parks and public green areas;
(c) carry out structures which would cause increased transport loads;
(d) to operate structures which would be the source of noise, emissions of pollutants and odour released into the air;
(e) to implement structures and their changes which would not respect preserved urban, architectural and historical values and which would lead to excessive thickening of the building;
(f) carry out construction of garages;
(g) to carry out the construction of agricultural production facilities and associated storage facilities;
(h) to carry out construction and equipment of industry, warehouses, wholesale and maintenance equipment for technical equipment and infrastructure;
(i) carry out waste facilities;
(j) to carry out the construction of entertainment or sports facilities not related to the purposes of the spa;
(k) keeping livestock and animals requiring special care as provided for in the Ordinance on the protection of species of animals requiring special care;
(l) carry out activities and work using machinery and equipment exceeding the limits of noise or vibration laid down by the Government Regulation on the protection of health against adverse effects of noise and vibration on working days and on Saturdays between 20: 00 and 07: 00, on Sundays and on public holidays or other holidays on a day-round basis;
(m) use pyrotechnic articles and objects with sound and light effects for entertainment purposes; the prohibition does not apply to 31 December and 1 January;
n) disseminate sound ads from stationary sources and mobile devices;
(o) to spread glare, blinking and otherwise harassing advertising; for the purposes of this Regulation, the designation of spa buildings and buildings of medical facilities, including the lighting logo of spa facilities and medical facilities, as well as the navigation system of spa facilities and medical facilities, is not considered as a light advertisement;
(p) feed stray and wild animals at sites related to health facilities.
(2) In the inner territory of the spa site, the construction of parking lots and parking homes may be permitted only for the purpose of providing spa rehabilitation care and ensuring the operation of medical facilities.
(1) The entry, operation and parking of vehicles shall be prohibited for spa colonnades and public spaces related thereto, with the exception of infrastructure, with the exception of vehicles of components of the integrated rescue system and the municipal police, medical devices for disabled persons and mechanisation for the maintenance and cleaning of such premises.
(2) The free movement of animals is prohibited in the spa colonnades and in public areas related thereto. This restriction does not apply to animals of the integrated rescue system, municipal police and the Czech Army.
Efficacy
This Regulation shall take effect on the 15th day following its publication.
