of 23 October 2014
amending certain financial market laws
Parliament has decided on this law of the Czech Republic:

ČÁST DRUHÁ

Amendment to the Cash Limitation Act
Čl. III
Act No. 254 / 2004 Coll., on the limitation of payments in cash and amending Act No. 337 / 1992 Coll., on the Administration of Taxes and Fees, as amended, as amended, as amended, Act No. 303 / 2008 Coll., Act No. 281 / 2009 Coll., Act No. 139 / 2011 Coll., Act No. 428 / 2011 Coll., Act No. 18 / 2012 Coll. and Act No. 407 / 2012 Coll., is amended as follows:
1. In Section 1, the word "cashless' is deleted.
2. in Article 2 (1) (a) and (b):
'(a) by payment of the transfer or transfer of funds by the payment provider to the payee;
(b) by cashless payment payment made by the transfer of funds in the territory of the Czech Republic through a money institution in Czech or foreign currency or by the transfer of funds by a money institution in Czech or foreign currency from the territory of the Czech Republic to the territory of another State. "
3. Paragraph 2 (2) reads as follows:
"(2) For the purposes of this Act, payment shall not be regarded as:
(a) the transfer of funds in cash to an account with a money institution and their withdrawal from an account with a money institution;
(b) exchange of banknotes or coins for other banknotes or coins through a money institution;
(c) transmission of non-standard damaged domestic banknotes or domestic coins to the Czech National Bank,
(d) retention of banknotes or coins which are reasonably suspected of being falsified or altered and their surrender to the Czech National Bank;
(e) the transfer or transfer of funds in the course of exchange transactions by the person authorised to conduct the exchange activity;
(f) the transfer or transfer of funds in the provision of services consisting of the carriage of banknotes and coins by the person authorised to provide such services; or
(g) the transfer or transfer of funds when providing banknote and coin processing services by the person authorised to provide such services. ";
4. Paragraph 2 (3) is deleted.
5. in Article 3 (2), point (e) shall be deleted;
Point (f) shall be renumbered as point (e).
6. In Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following points (f) and (g) are added:
"(f) payments made by the Czech National Bank for the sale of commemorative coins; or
(g) payments made by the court executive, court or administrative authority in the execution or enforcement of the decision. ";
7. In Paragraph 4 (1), the amount "CZK 350 000 'is replaced by" CZK 270 000'.
8. In Article 4 (1), the part of the sentence behind the semicolon, including the semicolon and footnote 2, is deleted.
9. In Paragraph 4, the following paragraph 2 is inserted after paragraph 1:
"(2) The payee whose amount exceeds the limit may not accept this payment if it has not been made without cash. ';
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
10. in Article 4 (3), the words "Czech or any" shall be deleted and the words "EU currency" shall be replaced by the words "Czech crowns."
11. in Article 4, paragraph 5 is deleted;

EFFECTIVE
Čl. V
This law shall take effect on the first day of the calendar month following the date of its publication, with the exception of the provisions of paragraph 1 (a) of this Article. I points 15 to 35, which shall take effect on the first day of the third calendar month following the date of its publication, and the provisions of Article IV which shall take effect on the day of its publication.
