DECLARATION
of 6 August 2009
on the publication of the National Natural Monuments of Maple Hill and the establishment of its closer protection conditions
The Ministry of the Environment provides pursuant to § 79 (3) (c) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 218 / 2004 Coll. and Act No. 312 / 2008 Coll., ("the Act '):
Subject matter
(1) The National Natural Monument of Maple Hill ("the National Natural Monument") is announced.
(2) The subject of protection is:
(a) the complex of the former medieval subsurface ore mine, including all its underground and surface parts forming a significant geological profile in the rock complex of the willow series, as well as the biotope of the collective aircraft (Chiroptera), including their populations, and the fragment of the flowery beech on the surface in the eastern part of the Massif Hruby Jeseník; and
(b) habitat types and species for which another legislation1) has been declared a European-important locality of Maple Hill and situated in the territory of the national natural heritage.
Definition of national natural heritage
The national natural monument is located in the cadastral territory of Malá Morávka. The boundaries of the national natural monument shall be determined by a closed geometric pattern with direct sides, the vertices of which are determined by the coordinates of the single trigonometric network of the cadastral2). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 1 to this decree. An indicative graphical representation of the territory of the national natural monument is given in Annex 2 to this decree.
Closer protection conditions
Only with the consent of the competent nature conservation authority can the national natural monument
(a) to make changes to the type of land or the way in which it is used (3);
(b) make changes to completed structures or changes to buildings before they are completed;
(c) enter the sub-surface areas of the former ore mine;
(d) carry out research or research in sub-surface areas of the former ore mine or research into parts of the mine on the surface associated with the sub-surface areas of the mine which do not cause changes or damage to the national natural monument;
(e) to carry out geological work linked to interference with the earth's surface which does not cause changes or damage to the national natural heritage;
(f) indicate cycling or pedestrian routes; or
(g) establish hunting facilities.
Efficacy
This Decree shall take effect on 1 October 2009.
