amending and supplementing Decree No. 104 / 1964 Coll., implementing the Law on the security of cooperative peasants in sickness and on the security of the mother and child
The Federal Ministry of Labour and Social Affairs provides pursuant to § 144 of Act No. 103 / 1964 Coll., on the security of cooperative peasants in sickness and on the security of the mother and child, as amended by Act No. 116 / 1967 Coll., Act No. 103 / 1988 Coll. and Act No. 180 / 1990 Coll.:
Decree of the State Social Security Office No. 104 / 1964 Coll., implementing the Act on the security of cooperative peasants in sickness and security of mother and child, as amended by Regulations No. 142 / 1965 Coll., No. 117 / 1967 Coll., No. 92 / 1968 Coll., No. 180 / 1968 Coll., No. 76 / 1970 Coll., No. 128 / 1975 Coll., No. 54 / 1976 Coll., No. 164 / 1979 Coll., No. 80 / 1982 Coll., No. 153 / 1983 Coll., No. 74 / 1984 Coll., No. 133 / 1984 Coll., No. 58 / 1987 Coll., No. 150 / 1988 Coll., and No. 237 / 1988 Coll., is amended as follows:
1. In Article 12, paragraphs 4 and 5 are inserted after paragraph 3:
"(4) The provisions of the preceding paragraphs shall also apply to the member of the cooperative whose security has ended, but at least on the day on which the call order was delivered to him or the order containing the collective call order concerning him was published.
(5) The provisions of paragraphs 1 to 4 shall apply mutatis mutandis to members of the cooperative after the completion of the civil service. "
2. Article 15 reads:
(1) The fact that it is an incapacity for work for active tuberculosis is evidenced by a certificate of incapacity for work certified by the competent medical professional department or, where appropriate, other authorised medical establishments.
(2) The sickness allowance for active tuberculosis is granted from the beginning of the second month of the period of incapacity for active tuberculosis for the period during which the cooperative is unable to work for that reason, but no longer than until the end of the support period, or until the end of the period for which he was allowed to extend the sickness payment pursuant to Article 8 (4) of the Act. "
3. Paragraph 16, including the title, is deleted.
4. In Article 23 (1) (c), the words "as well as civil services' shall be inserted after the words" in the armed forces'.
(5) Article 32 shall be added to the following paragraph 2:
"(2) The placement of a child in an institution (establishment) for such children shall not be considered as the duration of the interruption of the child's stay in an institution (establishment) during the school holidays which shall last for the whole calendar month. ';
paragraphs 2 and 3 shall become paragraphs 3 and 4.
6. In Article 32 (4), "§ 35 (1) 'is replaced by" § 35b (1)';
7. In Section 34, the words "District National Committee 'are replaced by the words" Competent State Authority'.
8. In Paragraph 81, the words "district national committees' are replaced by the words" competent state authorities'.
9. Section 13 reads:
K § 113 and 116 of the Act
Agricultural cooperatives provide for their own costs of administrative work needed to carry out the security of cooperative peasants in sickness and the security of the mother and child. The cooperative shall check whether a benefit to which there is a legal entitlement can already be provided on the basis of the application and the documents submitted. If not, they will arrange the necessary supplements. Otherwise, the cooperative shall submit the application, including the necessary supporting documents, to the competent social security authority (hereinafter referred to as the competent authority):
The competent authority shall decide on cash sickness security benefits and on the mother and child security benefits in particular where:
(a) there is a doubt or dispute concerning entitlement to the benefit or the amount thereof;
(b) the benefit is voluntary;
(c) the required benefit is not to be granted either at all or to the desired extent;
(d) the levy awarded must be withdrawn or its amount reduced or its payment discontinued or, where appropriate, a decision on the duration of entitlement to it for any other reason;
(e) it is to be decided that the cooperative or other recipient of the benefit is obliged to repay the benefit unduly. "
10.
The decision of the competent State authority on the levy shall also be notified by the service of its written copy to the cooperative which carries it out.
(1) Proceedings for the reimbursement of the levy resulting from the fault of the recipient of the benefit (26) are initiated on the basis of a proposal from the cooperative paying the benefit or at the initiative of the competent State authority. the cooperative is also involved in the proceedings.
(2) The decision on the obligation to repay the excess levy shall determine that the recipient of the levy is obliged to pay it to the cooperative in which the levy was granted. '.
11. the following Section 87a is inserted after Section 87:
At the request of a party, the payment of the necessary cash expenses, including compensation for the loss of earnings and fare other than local transport, shall be granted by means of means of sickness and security for the mother and the child, provided that they are related to a personal participation in the proceedings to which he has been called by the competent State authority and that his request has been accepted at least in part. ';

"(1) The benefits awarded shall be paid by the cooperative as decided by the competent authority."
13. in Paragraph 90 (1) (f), the words "and civil" shall be inserted after the words "military."
This Decree shall take effect on 1 July 1990, with the exception of point 3, which shall take effect on 1 September 1990.
