THE LAW
of 25 June 2008
amending Act No. 238 / 2000 Coll., on the Fire Department of the Czech Republic and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 238 / 2000 Coll., on the Fire Department of the Czech Republic and amending certain laws, as amended by Act No. 309 / 2002 Coll., Act No. 362 / 2003 Coll., Act No. 586 / 2004 Coll., Act No. 413 / 2005 Coll., Act No. 189 / 2006 Coll. and Act No. 264 / 2006 Coll., are amended as follows:
1. in Article 2 (1) (b), the word "a" shall be deleted and the following point (c) shall be inserted after point (b):
"(c) rescue services,"
Point (c) shall be renumbered (d).
2. Paragraph 2 (7) reads as follows:
"(7) The Directorate-General shall manage:
(a) fire brigade of regions which are the organisational components of the State and the accounting units; their revenue and expenditure are part of the budget chapter of the Ministry,
(b) a rescue service which is an organisational component of the State and the entity; its revenue and expenditure are part of the budget chapter of the Ministry. ';
3. The following Section 2a is inserted after Section 2:
„§ 2a
In particular, the rescue service shall perform extraordinary tasks of the fire brigade and train for this. It shall also teach and train to obtain a driving licence and improve the professional competence of drivers. ';
Čl. II
Transitional provisions
1. The date of the entry into force of this Act converts systemised locations for professional soldiers from the Military Rescue Service of the Army of the Czech Republic, which is designated by decision of the Government, to the Fire Department of the Czech Republic ("the Fire Department ').
2. A professional soldier assigned to a systematic place which is transferred under point 1 shall cease to be in service of an occupational soldier on the effective date of this Act and shall establish an employment relationship of a member of the Fire Rescue Corps. The termination of the service of an occupational soldier and the creation of a service of a member of the Fire Rescue Corps shall take place on condition that the professional soldier gives his consent to this change and, by his signature, confirms the text of the service of a member of the Security Corps. The termination of service under this Act has the same consequences as the termination of service of an occupational soldier by dismissal pursuant to § 19 (1) (e) of Act No. 221 / 1999 Coll., on professional soldiers.
3. The member referred to in paragraph 2, who shall be appointed to a post for which he fulfils a specified degree of education, shall establish an indefinite service relationship between a member of the Fire Rescue Corps and shall be appointed to the seniority established for that post. A member referred to in paragraph 2 may be appointed to a post for which he does not fulfil the specified degree of education and may be appointed to the rank established for that post, but for a maximum period of 6 years, if he does not meet the higher education in the Master's degree programme, for a maximum of 4 years, if he does not meet the higher education in the Bachelor's degree or higher vocational education, or for a maximum of 5 years, if he does not meet the secondary education with a graduate examination. This member shall become a member of a fixed-term service corresponding to the period of the term of the provision for a post according to the previous sentence.
4. Proceedings concerning the service of professional soldiers referred to in paragraph 2, initiated before the date of entry into force of this Act, shall be completed in accordance with Act No. 221 / 1999 Coll., on professional soldiers, as amended.
5. The effective date of this Act passes the property which served to perform the tasks of the Military Rescue Service of the Army of the Czech Republic, referred to in paragraph 1, from the Ministry of Defence to the Rescue Service of the Fire Rescue Corps. From the Ministry of Defence to the Ministry of Interior, the corresponding part of the state budget spent on this military rescue service is transferred.

Efficacy
This Act shall take effect on 1 January 2009.
