DECLARATION
Ministry of Industry and Trade
of 29 December 1998
on the method of implementation and labelling of packaging of dangerous chemicals and preparations
According to Article 13 (3) of Act No. 157 / 1998 Coll., on Chemicals and Chemical Products and on the amendment of certain other laws, hereinafter referred to as "the Act ', the Ministry of Industry and Trade provides:
The indication of the particulars referred to in Article 12 (2) of the Act shall be given directly on the packaging of a dangerous chemical (hereinafter referred to as "substance ') or a dangerous chemical preparation (hereinafter referred to as" the preparation') or on a label fixed on one or more sides of the packaging in such a way that the data can be read horizontally at the usual position of the packaging and that the proper handling of the substance or preparation does not cause damage to the labelling and prevent the identification of the substance or preparation.
(1) The dimensions of the marking are:
(a) at least 52 x 74 mm if the volume of packaging does not exceed 3 l,
(b) at least 74 x 105 mm if the packaging volume is more than 3 l and does not exceed 50 l,
(c) at least 105 x 148 mm if the packaging volume is more than 50 l and does not exceed 500 l,
(d) at least 148 x 210 mm if the packaging volume is more than 500 l.
(2) If the packaging is too small or otherwise not suitable for marking the packaging directly on the packaging or on the label, the label may be affixed to the package leaflet or tag.
The chemical name of the substance shall be indicated:
(a) the name of the substance, including the code name according to the list of hazardous chemicals still classified, 1); or
(b) the name of the substance, including the code name according to the List of Substances issued pursuant to Article 6 (2) (a) of the Act; or
(c) the name of the substance in accordance with the International Union for Pure and Applied Chemistry (IUPAC), unless the substance is listed in the List of previously classified hazardous chemicals or in the List of Substances.
(1) For the purposes of this Decree, the chemical name of the preparation is the chemical name of the substances contained in the preparation. The product designation shall include:
(a) chemical names of substances classified in accordance with Section 2 (8) of the Act which are ingredients of the preparation when present in concentrations greater than or equal to the concentration referred to in
1. in the list of still classified hazardous chemicals,
2. in the conventional calculation method, 2)
(b) for a preparation assigned R-phrases R 42, R 43 or R 42 / 43, only the chemical names of the substances to which they are assigned and which are present in the preparation at concentrations greater than or equal to the concentrations specified in the list of previously classified hazardous chemicals or in the conventional calculation method;
(c) the chemical name of the substance or substances on the basis of which at least 1 of the R-phrases is assigned: R 39, R 40, R 42, R 43, R 42 / 43, R 45, R 46 or R 48.
(2) If the chemical name of the substance itself or as a constituent of the preparation does not have the wrong 1 or more R phrases referred to in paragraph 1 (c), the group name of the substance which identifies the most important chemical functional group or trivial name of the substance may appear on the label of the substance or preparation. 3) If the manufacturer, importer and distributor make use of this option, the Ministry of Health shall inform them by submitting a safety data sheet.
(3) If the product contains more than 4 substances, it is sufficient to indicate in its labelling the chemical names of 4 substances presenting the most serious hazard to human health on the basis of which they are assigned to R-phrases.
(1) A hazard pictogram shall be indicated on the label of the substance or preparation. 4) A letter expression (symbol) may also be used to express dangerous properties of substances and preparations.
(2) Where a substance or a preparation is assigned several hazard pictograms for one group of dangerous properties and unless otherwise specified in the List of previously classified hazardous chemicals, it shall:
(a) when assigning the symbol "T" ("T +") simultaneously with the symbols "X" ("Xn," "Xi") and "C" the symbol "T" ("T +") is used;
(b) the symbol "C" shall be assigned simultaneously with the symbol "X" ("Xn," "Xi"),
(c) when assigning the symbol "E" simultaneously with the symbol "F" ("F +") and "O", the symbol "E" shall be used.
(3) Each graphic hazard symbol shall cover at least one tenth of the area of the marking, but not less than 1 cm2 of that area. The graphic symbol of danger is made in black on yellow and orange background.
(1) The indication of the specific risk of the substance or preparation shall indicate on the packaging:
(a) the R-phrase assigned to the substance listed in the list of still classified hazardous chemicals; or
(b) R phrase assigned to the substance or preparation based on the classification of the substance or preparation.
(2) A maximum of 4 R phrases are used to describe the specific risk of the substance or preparation.
(3) The phrases should not appear on packages of a substance or preparation of less than 125 ml.
(1) The instructions on the packaging for safe handling of the substance or preparation shall be provided:
(a) the world sentence assigned to the substance listed in the list of still classified hazardous chemicals; or
(b) the sentence assigned to the substance or preparation on the basis of the classification of the substance or preparation.
(2) Not more than 4 S phrases shall be used as instructions for safe handling of the substance or preparation.
(3) The sentences should not appear on packages of less than 125 ml of the substance or preparation.
(1) In the chemical name of concentrated preparations intended for the cosmetic industry, only 1 substance may be included on the packaging, on the basis of which the product is classified as sensitising. In the case of natural substances, the chemical name of the product may be used instead of the names of the individual ingredients of the product: "essence of..," "extract of...."
(2) Odorised or non-deodorised propane, butane or liquefied petroleum gas, placed on the market in metal containers meeting the requirements of EN 417 only for combustion purposes, shall be labelled on the packaging with hazard pictograms and R-phrases indicating flammable. Data on human health effects need not be provided. The manufacturer and importer shall indicate all the information that should appear on the label of the packaging in the safety data sheet.
(3) The labelling of packaging of products classified as harmful to health on the basis of hazards to respiratory organs when ingested does not need to indicate sentence R 65 if the packaging is equipped with a sprayer.
(4) Metals placed on the market in a solid form in which they do not pose a risk to human health by inhalation, ingestion or contact with skin are not identified under this Decree.
(1) "Contains lead. Shall not be used on surfaces exposed to chewing or licking by children '; The label" Warning. Contains lead. "
(2) The words "Cyanoacrylate. Danger. It sticks to the skin or eyes immediately. Keep out of the reach of children 'and the instructions for safe handling shall be marked with a cyanoacrylate-based adhesive packaging.
(3) "Contains isocyanates. See information supplied by the manufacturer 'shall be labelled as packaging of products containing isocyanates in the form of monomers, polymers and other chemical compounds or mixtures thereof.
(4) "Contains epoxy components. See information supplied by the manufacturer 'shall be labelled as packaging of products containing epoxy constituents of an average molecular weight of less than 700.
(5) "Attention! Do not use with other products. It may release hazardous gases (chlorine) 'shall be labelled with preparations containing more than 1% active chlorine.
(6) "Attention! Contains cadmium. Dangerous fumes occur when used. See information supplied by the manufacturer. Keep the safety instructions" marked with or directly designed to be used when soldering hard or soft alloys containing cadmium.
(1) The tactile warnings are considered to be equivalent in accordance with § 11 (2) (e) and (f) of the Act if they meet the requirements of the CSN EN ISO 11683.
(2) Testing of child-resistant fastenings shall be considered to be appropriate in accordance with Article 11 (2) (e) of the Act if they meet the requirements of the CSN ISO 8317.
This decree shall take effect on the day of its publication.
