of 23 January 1996
on the method, conditions and procedure for verifying and approving telecommunications terminal equipment
The Ministry of Economy provides, pursuant to Article 4 (1) of Act No. 110 / 1964 Coll., on Telecommunications, as amended by Act No. 150 / 1992 Coll. (hereinafter referred to as "the Act '):
Preliminary provisions
This decree provides for a procedure for verifying and approving telecommunications equipment (1) connected directly or indirectly to the final point (2) of the single telecommunications network.3)
Basic concepts
For the purposes of this Decree, telecommunications terminal equipment ("terminal equipment ') means equipment:
(a) intended or usable to transmit, process, transmit or receive information, both when connected directly to the end point of the single telecommunications network and when connected with a single telecommunications network, directly or indirectly to the end point of the single telecommunications network;
(b) using optical beam information for cable-free transmission and connecting directly or indirectly to the end point of the single telecommunications network;
(c) using electromagnetic wave information in the radio wave band (outside the mobile air service) and connecting directly or indirectly to the end point of the single telecommunications network.
Basic conditions for approval of terminal equipment
(1) Terminal equipment may be approved by the Ministry of Economic Affairs (4) (hereinafter referred to as the "Authorising Authority") as a type only if the following conditions are met:
(a) the safety of users of such facilities;
(b) the safety of operators of the single telecommunications network;
(c) electromagnetic compatibility, if specified for the type of device;
(d) compliance with the specified mode of use of frequencies intended for equipment using them without interference with other frequencies;
(e) synergies (compatibility) with the devices of the relevant part of the single telecommunications network, i.e. the possibility of connecting a device to a designated telecommunications network or networks for the purpose of establishing, modifying, holding or releasing any connection as a prerequisite for the connection of any terminal device to the telecommunications network (if this results from the determination of the terminal equipment);
(f) interaction with other telecommunications equipment through a single telecommunications network (if this results from the identification of the terminal equipment),
(g) an examination by the manufacturer by the approval authority as to whether it is capable of permanently ensuring compliance with the specified technical parameters of the end-equipment corresponding to the type approved;
h) their service in the Czech Republic is secured,
i) the user manual is prepared in the Czech language (it does not concern devices that do not require service and equipment intended only for service by trained staff).
(2) The authorising authority may fully or partially recognise laboratory protocols and certificates issued by foreign bodies accredited on the basis of criteria and procedures comparable to those in force in the Czech Republic.
(3) Individual terminal equipment may be the subject of an approval procedure only exceptionally if:
(a) a unique terminal device which will be operated by its holder in a specified location or in a specified manner; or
(b) the test operation of the terminal equipment in direct or indirect connection or in conjunction with a single telecommunications network in the context of the development or verification of new types of telecommunications equipment, carried out by a natural or legal person authorised for such activities; or
(c) specific terminal equipment intended for State defence and security or for use in the event of natural disasters.
Documentation submitted in the approval procedure
(1) An application for approval of terminal equipment may be submitted to the approval authority only by the manufacturer of the equipment, if it is a business) having its registered office or registered office in the Czech Republic, or by a representative designated by the manufacturer for the Czech Republic with the authority to obtain approval of the terminal equipment in his interest and on his behalf (the applicant).
(2) The application shall be made on a single form issued by the approval authority. The application shall be accompanied by a certified copy of the proof that the applicant fulfils the conditions laid down in paragraph 1.
(3) During the approval procedure, the applicant shall submit the documentation approved by the manufacturer in the Czech or English language containing in particular:
(a) a description of the product type submitted to enable it to be clearly identified;
(b) the design documentation to the extent necessary for the approval procedure, having regard to the nature of the approved terminal equipment;
(c) the descriptions and explanations necessary for a clear understanding of the documentation submitted and the function of the terminal equipment;
(d) a list of basic technical standards and recommendations which the terminal equipment complies with in its activities and whose criteria it meets. Where technical standards have not been applied or do not exist, descriptions of the solutions used to meet the essential requirements referred to in Article 3 (1) shall be provided,
(e) the results of the tests carried out by the applicant, originals or officially certified copies of the product test reports or certificates issued by state tests6) or domestic or foreign accredited laboratories;
(f) without doubt the identification of the types of programmes used, the methods of programming and the introduction of programmes into, the security of end-use equipment, including any measures to prevent or influence the entry of unauthorised persons into software;
(g) software used;
(h) information on installation principles and maintenance methods.
Approval procedure
(1) The type-approval authority shall determine, in accordance with the procedure and according to the type of end-machine approved, the extent of the tests and the number of representatives required to be submitted in the test sample for the type-test and inform the applicant accordingly. The applicant shall ensure that the tests are carried out with laboratories authorised by the authorising authority (hereinafter referred to as the laboratory).
(2) Approval authority:
(a) provide the applicant with information on the conditions of approval and the approval process;
(b) require additional supporting documents from the applicant, including additional samples of the type of terminal equipment, where necessary for the proper and complete execution of the approval procedure;
(c) check compliance with the conditions resulting from this Regulation and those laid down in the type approval decision or one terminal installation;
(d) keep the information obtained during the approval procedure and do not provide it to third parties;
(e) records during the lifetime of the terminal equipment, but for at least 10 years, all documents on the basis of which the approval decision was issued.
Technical tests of the terminal equipment
(1) During the tests, the laboratory verifies the conformity of the technical characteristics and parameters of the final equipment sample with the technical standards and specifications applicable in the Czech Republic at the time of the tests.
(2) During the tests, the laboratory
(a) verify the technical documentation and verify that the test sample of the type has been produced in accordance with this dossier;
(b) verifies the unambiguity of the labelling of the product on the application, on the sample label and on the dossier;
(c) carry out the necessary tests for the objective identification of the utility characteristics and technical parameters of the product, including its software;
(d) verify the accuracy of the other parts of the dossier.
(3) On the basis of the results of the individual tests and the assessment of the documents submitted, the laboratory shall issue a test report which is the basic technical basis for the approval procedure. It shall include the name and address of the manufacturer, the results of the tests, the conditions for their validity and other information necessary for the unambiguous identification of the approved terminal equipment. Each individual protocol shall be accompanied by a list of the relevant parts of the technical documentation and a complete photo-documenting of the representative of the specific terminal equipment taken by the laboratory.
Demonstration of equipment not yet approved
The connection of the terminal equipment to the telecommunications network at the site of its demonstration at exhibitions, fairs and similar events is possible only on the basis of a one-off authorisation of the operator of the telecommunications network concerned, limited in time for the duration of the event. In addition, a storage and operation permit issued by the authorising authority is necessary for radio equipment. 7)
Identification of approved terminal equipment
(1) The manufacturer of the device shall indicate each approved terminal equipment, the documentation attached thereto and the packaging of the product with the symbol of the approval authority (the symbol).
(2) The symbol may be used only for terminal equipment for which a approval decision has been issued. Each decision shall bear the relevant symbol.
(3) The symbol can be placed:
(a) in the case of portable terminal equipment, in particular on the bottom or rear of the apparatus so that the whole symbol is visible after turning the apparatus;
(b) in the case of non-portable terminal equipment, such that the symbol is accessible in a simple manner.
The symbol shall also be placed on the non-replaceable essential functional parts of the apparatus.
(4) The symbol can be used in one of the following ways:
(a) by pressing into the apparatus housing,
(b) indelible printing of the device cover and its removable parts;
(c) by incorporation into the manufacturer's label containing the full type designation of the product;
(d) by means of a self-adhesive label or a label containing, in addition to the symbol, the type designation of the product. The self-adhesive label shall be so designed that when the label is removed, it is always damaged and that, to the extent of the moisture and temperature values in which the device can be stored or operated according to the technical documentation, the label cannot be self-peeled. The label shall be so placed as to avoid mechanical damage during normal operation and maintenance;
(e) printing on the first page of the documentation (s) supplied with the product where the delivery of the documentation (s) with the product is provided for in the type approval decision.
The design referred to in points (b) and (c) shall use a dark font on a bright background. The design referred to in points (d) and (e) uses black font on white background.
The list of approved terminal equipment shall be published in the Telecommunications Bulletin issued by the Ministry of Economy.
Transitional and final provisions
(1) Decisions concerning the approval of terminal equipment issued by the approval authority as from 1 June 1992 shall remain in force.
(2) Certificates of approval of terminal equipment issued before 1 June 1992 are no longer valid six months after the date of entry into force of this Decree, unless their holders request, within that period, a new decision to approve terminal equipment under the conditions laid down in that Decree.
Efficacy
This Decree shall take effect on 1 March 1996.
