Decree of the Federal Ministry of Agriculture and Nutrition on the reserve fund in uniform agricultural cooperatives and joint farms

Federal Ministry of Agriculture and Nutrition
of 27 March 1986
on the reserve fund in single agricultural cooperatives and common agricultural holdings
The Federal Ministry of Agriculture and Nutrition in agreement with the Federal Ministry of Finance, the State Arbitration of the Czechoslovak Socialist Republic, the Ministry of Agriculture and Nutrition of the Czech Socialist Republic and the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic pursuant to § 14 (4) and § 97 (1) (b) of Act No. 122 / 1975 Coll., on Agricultural Cooperatives, provides:
§ 1
Subject matter and scope of the adjustment
The reserve fund in the single agricultural cooperatives and the reserve fund in the common agricultural holdings (hereinafter referred to as "the Fund ') shall serve to concentrate the funds to bridge fluctuations in the production of resources and cover needs, both in the plan and in fact, where such fluctuations are not covered by statutory or contractual insurance or other special purpose fund.
§ 2
Creation of the Fund
The fund shall be made up of a profit allocation to be made by:
(a) a single agricultural cooperative equal to the remaining part of the profit after the payment obligations and after allocation to all funds, including other use of the profit;
(b) a joint agricultural holding at the level specified in the approved annual accounts.
§ 3
Application of the Fund
Fund resources shall be used:
(a) to supplement the sources of distribution;
(b) allocations to other funds in accordance with the specific provisions applicable to those funds;
(c) to cover losses from the physical disposal of unused stocks and the sale of unused stocks up to 100% of such losses;
(d) to cover 20% of the participation in statutory insurance, 1)
e) for further purposes determined by the Ministry of Agriculture and Nutrition of the Czech Socialist Republic or by the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic in agreement with the Federal Ministry of Agriculture and Nutrition.
§ 4
Management of the Fund
(1) The Fund may be supplemented from other sources provided for in specific provisions.
(2) The funds of the Fund are kept in an overdraft (current) account with the Czechoslovak State Bank.
(3) The balance of the Fund at the end of the year shall be transferred in full to the following year.
Final and repeal provisions
§ 5
The Ministry of Agriculture and Nutrition of the Czech Socialist Republic and the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic may, on a case-by-case basis, allow an exemption from the provisions of Section 3 of this Decree.
§ 6
The Federal Ministry of Agriculture and Nutrition Decree 111 / 1976 Coll., on the reserve fund of the single agricultural cooperative is hereby repealed.
§ 7
This Decree shall take effect on 1 April 1986.
