DECLARATION

of 10 March 1960
on catching musk musk and collecting its skins
The Ministry of Agriculture, in agreement with the participating ministries, provides pursuant to Section 16 of Act No. 62 / 1952 Coll., on Fisheries, and pursuant to Section 10 (3) of Act No. 63 / 1958 Coll., on the Second Five-Year Plan for the Development of the National Economy of the Republic of Czechoslovakia:
The purpose of this decree is to ensure for our economy valuable and undamaged musk leather and to regulate its condition in a way that eliminates the threat of fish farming and other aquatic animals.
The following are permitted to catch musk ondatra:
1. owners or users of land, water works and equipment on which musk ondatra occurs,
2. Fishermen in the areas for which they have been established,
3. persons authorised to exercise fishing rights in the fishing zones for which fishing permits have been issued to them;
4. hunting and hunting operators for whom they were appointed,
5. Holders of hunting tickets for which hunting permits have been issued to them by hunting farms.
(1) In addition to the persons referred to in § 2, musk ondatras may be caught by other persons to whom the management authority of the district national committee shall issue a permit to catch musk ondatras (hereinafter referred to as the "permit") for the design of the undertaking responsible for collecting and purchasing the raw materials.
(2) Before issuing the permit, the Executive Authority of the District National Committee shall request comments on the proposed persons from the Regional Committee of the Czechoslovak Hunting Unity and from the Regional Branch of the Czechoslovak Union of Fisheries.
(3) The authorised persons are authorised to fish for musk musk on the territory of the district national committee which issued the authorisation. The management authority of the District National Committee may withdraw the authorisation at any time.
(1) Persons authorised (Section 3) may enter the land and places where they are present in order to catch musk trees. These persons are obliged to make good any damage they cause, in particular on land, waterworks and facilities, hunting and fishing.
(2) In ponds or on waterworks and facilities under management or, where appropriate, in the use of socialist sector organisations, persons referred to in Sections 2 to 5 and 3 (1) may only catch musk ondatra with the consent of such organisations.
(1) Shooting of musk musk is prohibited.
(2) Only from 1 October to 31 March are allowed to fish musk ondatra.
(3) Breeding, possession and transport of live musk ondaters are prohibited.
The persons referred to in Sections 2 and 3 are obliged to offer musk ondater skins for purchase to undertakings responsible for collecting and purchasing raw materials.
The Ministry of Agriculture may provide for derogations in the agreement with the central authorities involved or, where appropriate, allow exemptions from the provisions of Sections 4 (2) and 5 of this Decree.
This decree shall take effect from the date of its publication.
