amending Decree No. 238 / 2011 Coll., laying down the hygiene requirements for swimming pools, saunas and sanitation limits of sand in outdoor playing areas, as amended
According to Article 108 (1) of the Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 274 / 2003 Coll., Act No. 151 / 2011 Coll., Act No. 223 / 2013 Coll., Act No. 267 / 2015 Coll., Act No. 205 / 2020 Coll. and Act No. 152 / 2023 Coll., ("the Act ') for the implementation of § 6a (6), § 6c (2), § 6f (3), § 18 (3) and § 82a (5) Act:

Decree No. 238 / 2011 Coll., laying down the hygiene requirements for swimming pools, saunas and sanitation limits of sand in sandboxes of outdoor playing areas, as amended by Decree No. 97 / 2014 Coll., Decree No. 1 / 2016 Coll., Decree No. 568 / 2020 Coll. and Decree No. 305 / 2022 Coll., are amended as follows:
1. in Article 1 (d), the words "or artificial swimming pools or saunas' are replaced by the words" swimming pools';
2. in Paragraph 1 (e), the words ", microclimatic conditions" shall be deleted and the word "breakdown," shall be replaced by "internal."
3. footnote 3 shall read:
"3) Decree No. 146 / 2024 Coll., on construction requirements. '.
4. In Paragraph 8 (1) of the introductory part of the provision, a comma is inserted after the word "fixed '.
5. In Article 9 (4) of the introductory part of the provision, a comma is inserted after the words "as referred to in paragraph 1 '.

„§ 17
Hygienic requirements for swimming and bath pools
(1) The immediate capacity of visitors to an area covered by artificial swimming pools is determined as a maximum of twice the capacity of the swimming pools. The immediate capacity of the area of exposed artificial swimming pools is determined as a maximum of five times the capacity of the swimming pool. The determination of capacity from the water surface of pools does not concern artificial swimming pools with exclusively bath pools or pools for infants and toddlers. The capacity of the water area shall be determined by the area for non-swimmers, determined by the depth of the water not exceeding 160 cm, being 3 m2 for one swimmer and 5 m2 for one swimmer. For pools with water attractions, the pool operator shall determine in the operating order the water area for one visitor depending on the nature of the individual water attractions and the safety of the visitors.
(2) The operator shall ensure that the quantity of dilution water is measured and recorded daily.
(3) The pool shall provide for the possibility of impact disinfection of the pool water and any equipment directly related to it.
(4) Visitors' brodits for switching to pool stands at exposed pools or between outdoor and indoor pools must be equipped with showers which only serve to rinse the body without using soap and detergent. The initial height of the water shall be 10 cm to 15 cm. The constant flow rate in the broddle shall ensure water exchange at least once per hour. The brownies are regularly mechanically cleaned and disinfected daily.
(5) The tidal grooves must be adjusted and dimensioned so that the water does not return to the pool. The tidal grooves, the pool walls and the bottom of the pool must be intact and easily cleaned and mechanically cleaned so that they are permanently free from traces of contamination or algae.
(6) Children under 1 year of age are not allowed in swimming pools, if not for infants and toddlers. Children between the ages of 1 and 3 can only enter the pool in swimwear with an adhesive rubber around their legs, unless otherwise specified by the pool operator. "
7. Article 18 shall be deleted;
8. The title of § 19 reads: "Properties of equipment and materials of indoor equipment of artificial swimming pool and sauna."
9. Paragraph 19 (3) reads as follows:
"(3) Lockers shall be made of smooth, moist, defiant material and shall be easily ventilated in indoor swimming pools and saunas. '
10. Article 20 shall be deleted;
11. in Article 22 (1) (a):
"(a) children's dressing rooms shall be equipped with a changing table or washable mat,"
12. in Article 22 (1) (b), the part of the sentence in front of the semicolon, including the semicolon, is deleted;
13. in Paragraph 22 (1) (f), the word "pure" is replaced by "fulfilling."
14. in Paragraph 23 (1):
"(1) The capacity of the paddling area for children shall be determined by a factor of 1 m2 per child. During operation of the paddling ground, the water depth shall not exceed 40 cm. ';
15. in Paragraph 23 (2), the first sentence is deleted;
16. in Article 23 (3), the words "Article 18 (1) and" shall be deleted;
17. Article 29 to 32 shall be deleted, including the headings.
18. In Section 33, the word "lighting 'is deleted.
19. in Article 33 (1), the word "lighting" shall be deleted;
20. Paragraph 33 (2) and (3) are deleted and paragraph 1 is deleted.
footnote 11 is deleted.

„§ 34
Sauna heating room
(1) No wood material in the sauna heating room shall be impregnated, impregnated or painted, except for the outdoor area of doors and walls.
(2) The immediate capacity of the sauna heating plant is at least 2 m3 per person. The sauna heating room shall be equipped with at least one degree of seating area at least 50 cm wide, the highest degree being located at least 120 cm from the ceiling. Depending on the capacity of the sauna heating room, 1 m of seat space is calculated. The seat surfaces shall be made of bars fixed from below or with screw heads embedded and covered. Individual parts of the seats shall be removable with a maximum mass of 15 kg. There shall be no metal items or components in the sauna heating room with which the saunter could come into contact.
(3) The floor entrance is usually located outside the sauna heating room, the sauna door does not have a threshold built up or there is space left under it to allow water to drain from the sauna heating room during cleaning.
(4) The sauna heater must be secured against accidental contact of the saunters, in particular by cover, safety fence or protective frame. '
22. In the title of § 35, the words "and the rest room 'shall be inserted after the word" Chilly'.
23. Paragraph 35 (2) reads as follows:
"(2) The indoor cooling room consists of a cooling shower, possibly in combination with a cooling pool or other cooling device. During the operation of the swimming pool, the water must be permanently brought to the bottom and drained by an ambush. The gout must have a gradient to the discharge hole. '
24. In Article 35, paragraph 6 is added:
"(6) The rest room shall be equipped with couches or armchairs corresponding to the capacity of the sauna heating room, with washable surface. The floor in the break room must be easy to clean. '
Article 25 (36) and (37) are deleted.
26. in Paragraph 38 (1), the words "and lighting" shall be deleted;
27. in Paragraph 38 (2), the word "sauna" shall be inserted after the words "in the heating room."

„§ 39
Cleaning and cleaning of artificial swimming pools and saunas and other requirements
(1) Artificial swimming pools and saunas must be kept clean. The toilets, including seats, shower rooms and cloakrooms must therefore be cleaned and disinfected as necessary, when the equipment is operated at least once a day. The disinfectants used shall be rotated according to the active substance represented and the exposure period prescribed for their application.
(2) To store cleaning and disinfectants, a cleaning room is set up, ventilated, equipped with a tap with a water supply battery for hot and cold water. Walls shall have an easily washable surface up to at least 180 cm from the floor.
(3) At least once a day, especially after the end of operation, all rooms of the sauna must be washed with water with detergent and disinfected. The floor and seat surfaces of the sauna heating plant shall be wiped regularly with drinking water or filling water, at least twice daily during operation. Doors, washable walls, closets, furniture, radiators and other sauna equipment shall be disinfected as required, at least once a week. The sauna heating room shall be cleaned, disinfected and wind normally after the end of operation and shall remain open until the following day.
(4) Water from the cooling pool without recirculation is released daily, walls and bottom are mechanically cleaned, disinfected with disinfectant and properly sprayed with filling water. Cooling pools with recirculation must be mechanically cleaned at least once a week.
(5) In saunas with the discharge of laundry, clean and used linen must be stored separately in a separate space. If the used laundry is not dispatched daily to the laundry room, the possibility of drying it in the room reserved for that purpose must be ensured; the operating areas may also be used after the end of the operation for visitors, except for the space of the sauna heating plant. ';

Efficacy
This Decree shall take effect on the day following that of its publication.
