DECLARATION
of 22 July 2016
amending Decree No 222 / 1995 of the Ministry of Transport Coll., on waterways, navigation in ports, common accidents and the transport of dangerous goods, as amended
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll., Act No. 118 / 2004 Coll., Act No. 309 / 2008 Coll. and Act No. 187 / 2014 Coll.:
Decree No 222 / 1995 Coll., on waterways, navigation in ports, common accident and transport of dangerous goods, as amended, is amended as follows:
1. Paragraph 8 (1) reads as follows:
"(1) The minimum underpass height of newly built or reconstructed bridges which are replaced or substantially modified by the structure is 7,0 m above the highest level of navigation determined by the navigational authority (hereinafter referred to as the" highest level ') on the waterway. In the case of newly built arc bridges, this height shall be maintained in a width of at least two thirds of the fairway according to § 5.'
2. In Article 8, the following paragraphs 2 to 4 are inserted after paragraph 1:
"(2) If, for reasons not on the side of the builder, it is not possible for a newly built or reconstructed bridge to maintain the smallest underpass height referred to in paragraph 1, the underpass height at such a bridge may be smaller when the bridge structure is established as movable. In the case of a reconstructed bridge, its structure may not be established as movable if the underpass height at such a bridge is the same as before the reconstruction, but at least 5.25 m above the highest level of navigation. At the same time, the constructional technical solution of the lower structure and the bridges shall allow, without demolition work, the additional height of the reconstructed bridge referred to in paragraph 1 to be reached after the ground for which it was not possible. Compliance with the terms of the first to third sentences shall be included in the documentation of the construction transmitted to the navigational office for the purpose of issuing a binding opinion under the law.
(3) When reconstructing bridge structures where there is no replacement or major structural modification of the structure, the underpass height must be maintained before the reconstruction.
(4) Bridge objects shall be so designed as not to cause reflections which are dangerous for radar navigation on the waterway. ';
Paragraphs 2 to 6 shall be renumbered paragraphs 5 to 9.
3. At the end of paragraph 6, the phrase "The smallest underpass height of newly built bridges on the waterway is added to the transport-significant classification class 0. in the river section is 4,0 m above the highest level of navigation. In the case of reconstruction of existing bridges on the waterway, the transport significant classification class 0. in the river section must be maintained at least the current underpass height before reconstruction. '
Transitional provision
For buildings for which the building permit was granted under Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended, before the date of entry into force of this Decree, the procedure is followed by the existing legislation.
Efficacy
This Decision shall enter into force on 1 September 2016.
