THE LAW
of 24 May 2002
amending Act No. 84 / 1990 Coll., on the right of assembly, as amended by Act No. 175 / 1990 Coll., and certain other laws
Parliament has decided on this law of the Czech Republic:
Amendment to the Act on the right of assembly
Act No. 84 / 1990 Coll., on the right of assembly, as amended by Act No. 175 / 1990 Coll., is amended as follows:
1. The following Section 2a is inserted after Section 2:
The delegation of power shall be tacitly extended for periods of an identical duration.
(a) the municipal office in whose territorial district the assembly is to take place;
(b) by an authorised municipal authority, if the place of assembly exceeds the territorial district of the municipal office;
(c) the Regional Office where the place of assembly exceeds the administrative district of the entrusted municipal office;
d) Ministry of the Interior if the venue of the assembly exceeds the border of the region
(hereinafter referred to as the Office) '.
2. In Section 3, the words "Czechoslovak legal person 'are replaced by the words" legal person established in the Czech Republic'.
3. In Article 4 (1), the words "(Article 16) 'are deleted.
4. In Article 4 (3), the words "the National Committee may designate a place in a municipality 'shall be replaced by the words" the Council of the Municipality may designate a place in its territorial area by a regulation'.
5. in Article 5, the following paragraph 2 is inserted after paragraph 1:
"(2) No account shall be taken of the notification to be made by the caller less than 6 months before the date of the assembly."
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
6. In Article 5 (3) (c), the words "necessary 'shall be inserted after the words" necessary' and the words "older than 18 years' shall be inserted after the words" organisers'.
7. in Article 5 (3) (e), the words "the birth number" shall be deleted and the words "residence" shall be replaced by the words "permanent residence."
8. In Article 5 (3) (f), "residence 'is replaced by" residence'.
9. In the last sentence of Article 6 (1), the words "National Committees and other State bodies and organisations' shall be replaced by" Office 'and the words "provide' shall be replaced by the words" provide '.
10. in Article 6 (4), the words "be entitled to issue" shall be replaced by the words "issue."
11. in Paragraph 6 (6):
"(6) If the caller fails to make amends in the event of disruption of the peaceful course of the assembly, the Office or the competent department of the Police of the Czech Republic shall, without undue delay, ask the participants to resume the peaceful course of the assembly. It may also do so if the participants do not disperse peacefully after the meeting has been concluded. '
12. in Article 7, the following paragraph 4 is added:
"(4) The participants of the assembly shall not have a face covered in a way which makes it difficult or impossible to identify them if an operation of the police department of the Czech Republic is carried out against the assembly. '
13. The heading above Section 8 reads: "Scope of the Office."
14. In Article 11 (2), the following sentence shall be inserted after the first sentence: "If the convener so requests, the Office shall send him a written copy, at the same time as the decision is posted on the official record. '
15. In Paragraph 12 (6), the second sentence is: "In the absence of a representative of the Office, the commanding member of the Police of the Czech Republic may do so."
16. in Paragraph 14 (1):
"(1) A fine of up to CZK 5,000 may be imposed on those who convene or hold a meeting without complying with the notification requirement or hold a meeting which has been prohibited or infringes the obligation laid down in Article 6 (4) and (6)."
17. in Article 14 (2), the words "The same fine may be imposed on that person" shall be replaced by the words "The transfer shall be further committed by that person."
18. in Paragraph 14 (2), the following point (d) is inserted after point (c):
"(d) as a participant in the assembly, the face is covered in a way which makes it difficult or impossible to identify, if an operation is carried out against the assembly by the police department of the Czech Republic,"
Points (d) to (f) shall be renumbered as points (e) to (g).
19. in Paragraph 14 (2), at the end of point (g), the dot is replaced by a comma and the following point (h) is added:
"(h) unjustly intentionally prevent another person from exercising the right of the gatherer to a substantial extent."
20. In Paragraph 14, the following paragraph 3 is inserted after paragraph 2:
"(3) The offence referred to in paragraph 2 (a) and (b) may be fined up to CZK 5,000, the offence referred to in paragraph 2 (c) and (d) may be imposed up to CZK 10,000 and the offence referred to in paragraph 2 (e) to (g) may be fined up to CZK 7,000."
Paragraph 3 shall become paragraph 4.

22. In Paragraph 19, the words "exceptional circumstances or wars' are replaced by the words" declaration of a state of danger, an emergency, a state of threat to the state or a state of war '.
23. in § 4 (1) and (2), § 5, § 6 (3) and (5), § 8 to 11, § 12 (1) and (2), § 12 (6) first sentence and § 16, the words "National Committee" are replaced by the words "Authority."
24. in Sections 6 (3) and 12 (2), the words "Public security" are replaced by the words "Police of the Czech Republic."

Amendment of the Road Act
In Article 25 (6) (e) of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 102 / 2000 Coll., the words "and assembly 'are deleted.
TRANSITIONAL PROVISIONS
Notifications submitted before the date of application of this Act shall be deemed to have been made under this Act. Notices submitted in accordance with existing legislation notifying the assembly to be held after a period of 6 months from the date of entry into force of this Act shall not be taken into account.
EFFECTIVE
This Law shall take effect on 1 July 2002.
