DECLARATION
National Security Office
of 30 October 1998
on object safety
According to Section 49 (2) of Act No. 148 / 1998 Coll., on the protection of classified information and on the amendment of certain laws, the National Security Authority provides:
§ 1
Subject matter
(1) Object security is a system of measures determining the conditions, means and means of ensuring the protection of objects from the disclosure of unauthorised persons with classified information and of measures to ensure the protection of classified information in the event of a threat to the object.
(2) The purpose of implementing the object security is to prevent the unauthorised person entering the premises, to detect the unauthorised person entering the premises, to take measures to minimise the consequences of the unauthorised person entering the premises and to prevent the release, loss, destruction or destruction of classified information as a result of an emergency.
§ 2
For the purposes of this decree:
(a) a building or other building or other enclosed space where classified information is stored or processed;
(b) the boundary of the building's mantle or other physical boundary of the space;
c) entry into the building a place intended for the entry of persons into the building and their departure from the building and a place intended for the entry of means of transport into and exit from the building,
(d) means of transport by means of land, underground, air and water transport of persons, objects and materials;
(e) the operator of the premises, the authority of the State or organisation using the object to carry out its activities;
(f) keys also include means of identification and media used for code and release locks.
§ 3
Object categorisation
(1) Objects are classified in the following categories according to the importance of the subject of the protected interest:
(a) objects of category A, if they are intended for the protection of classified information in a classified level of top secret;
(b) objects of category B where classified information is classified for the protection of classified information;
(c) objects of category C, if they are intended to protect classified information in a confidential manner;
(d) objects of category D, if they are intended for the protection of classified information, of a classified classification level reserved.
(2) Objects classified in each of the categories referred to in paragraph 1 may contain classified information of a relevant classification level or a lower classification level.
(3) The establishment of the object and its boundary and the classification of the object in the relevant category shall be carried out by the statutory authority of the operator of the object.
§ 4
Object protection
(1) The protection of the building is ensured by means of security measures, which are:
(a) physical surveillance of the premises,
(b) mechanical means of defence;
(c) technical means of security;
(d) arrangements;
(e) a reciprocal combination of the measures referred to in (a), (b), (c) and (d).
(2) The scope, manner and conditions of application of security measures are determined by the statutory authority of the operator of the premises.
(3) In order to protect the object, security measures shall be applied to allow for appropriate rapid action against the unauthorised person when attacked.
§ 5
Physical security of the object
(1) Physical surveillance of the premises shall be provided by designated and trained personnel of the operator of the premises or personnel entrusted with security protection services.
(2) For category A objects, category B objects and category C objects, physical surveillance of the object is ensured continuously. For category D objects, physical surveillance shall be ensured during working time, unless the statutory authority decides that physical surveillance of this object shall be ensured beyond working time.
(3) Physical surveillance of category A objects and of category B objects is provided by at least 2 physical surveillance personnel at the post designated for the permanent exercise of surveillance of the object.
§ 6
Mechanical defence devices
(1) Mechanical means of defence means, in particular, door safety systems, safety locking systems, bars, safes, safety glasses and safety foils.
(2) In order to ensure the protection of the boundary of the object and of the entrances to the object, emergency routes and other passages and passages into the object, only certified mechanical means of defence under special legislation are used. 1)
§ 7
Technical means of security
(1) Technical means of security are:
(a) means of electrical signalling to detect and evaluate unauthorised intrusion into the premises (hereinafter referred to as "alarm devices");
(b) special television equipment and systems for the detection, transmission and display of movement of persons and means of transport (hereinafter referred to as "monitoring devices");
(c) electrical locking devices and systems for securing inputs to objects;
(d) means and systems used to provide electronic evidence of the authenticity and identity of persons entering the premises;
(e) means of electrical fire alarm.
(2) Only certified technical means of security under specific legislation are used to ensure the protection of the boundary of the object and the inputs to the object. 1)
(3) In accordance with paragraph 2, emergency routes and other passages and passages shall also be secured for category A objects, category B objects and category C objects.
§ 8
Scheme measures
Framework measures shall mean:
(a) a system of entry and exit of persons and means of transport which provides:
1. the authorisation of persons and means of transport to enter the premises, the exit and the way in which they are checked; and
2. the conditions and method of control for the removal and balance of classified items and materials from the premises;
(b) the arrangements for the movement of persons, means of transport, classified items and materials in the premises and parts thereof on working and out-of-work hours;
(c) a key handling regime which, in particular, determines the system and the way in which the keys are marked, allocated and surrendered, their storage and registration, the deposit of duplicates and the way in which they are used.
§ 9
Entrance permission
(1) The list of persons authorised to enter the premises (hereinafter referred to as authorised persons) and the list of the means of transport authorised to enter the premises are laid down in the rules laid down in Paragraph 14 (1) (d).
(2) The authorisation to enter the premises shall be issued by the statutory authority of the operator of the premises or by the person authorised by it.
(3) The right to enter the premises of persons or means of transport shall be demonstrated in the manner laid down in the rules laid down in Paragraph 14 (1) (d).
(4) The method of proving the authenticity of entry into the premises of persons or means of transport shall enable them to be clearly identified.
(5) According to local conditions, the statutory authority of the premises operator shall establish specific measures to prevent visits to the unauthorised disclosure of classified information. The receiving person shall be responsible for compliance with the measures laid down.
(6) In category A objects, category B objects and category C objects, visitors are only allowed to move in accompanied by the receiving person or by the authorised person.
§ 10
Control and security measures when entering the building
(1) Upon entering the premises, the security of the premises shall be carried out in accordance with the rules set out in Section 14 (1) (d).
(2) If more than 1 entry into the building is necessary from an operational point of view, a circle of persons or a list of means of transport authorised to use these inputs in the building shall be established, their use is time-limited and their surveillance secured at the time of use.
§ 11
External object protection
(1) External object protection means the implementation of a set of security measures referred to in § 4 (1) to ensure the protection of the object border, access to the object and protection of emergency routes and other passages and passages into the object.
(2) To protect the boundary of objects category A mechanical means of defence and at least 1 alarm device and 1 monitoring device shall be used for local conditions.
(3) In order to protect the boundary of category B objects and category C objects, mechanical means of defence and at least 1 alarm device must be used for local conditions.
(4) Mechanical means of defence must be used to protect the border of category D objects, taking into account local conditions.
(5) During working hours, the security measures used to protect certain parts of the building boundary may be disabled under operating conditions. In such cases, however, measures must always be taken to prevent the unauthorised person from becoming acquainted with classified information.
(6) In the out-of-work period, the entire boundary of the building shall be secured continuously by the security measures laid down in Section 4 (2).
(7) The entrance to the building must be secured at a time when it is not used in accordance with § 4 (2). For category objects A minimum of 1 alarm device and 1 monitoring device shall be used in addition to mechanical means of arrest. In the case of category B objects and category C objects, at least 1 alarm device shall be used in addition to the mechanical means of defence. For category D objects, mechanical means of defence shall be used.
(8) Emergency routes and other passable and penetrable openings to the object must be secured in a manner such as access to the object.
§ 12
Internal object protection
(1) The internal protection of the object means the method of securing rooms and other building-based spaces inside the object which prevents the unauthorised person from accessing classified information.
(2) Rooms and other construction enclosed spaces within the premises where classified information is stored or processed must be secured from an unauthorised person. The method of security shall be determined by the statutory authority of the operator of the premises under local conditions and taking into account the importance of the subject of the protected interest.
(3) The scope and conditions of the internal protection of the building are determined by the statutory authority of the operator of the building on the basis of the required mode of movement of persons and means of transport in the building.
(4) The security measures referred to in Section 4 (1) shall apply when ensuring internal protection of the object.
(5) The meeting rooms within category A objects or category B objects where classified information marked INCLUDING SECRET or SECRET classification is regularly discussed shall be protected against passive and active eavesdropping and against viewing or eavesdropping by an unauthorised person from outside the room.
(6) Protective measures in the negotiating rooms against passive wiretaps and the implementation of the anti-active wiretaps measures will be ensured by the operator of the premises after prior approval by the National Security Authority.
(7) At the end of the working time, internal security checks are carried out on category A objects and category B objects.
§ 13
In the event of a natural disaster and in other similar emergency situations where a security information may be leaked, lost, degraded or destroyed, the protection of the premises shall be carried out according to the plan, procedure and instructions established by the statutory authority of the operator.
§ 14
Object security documentation
(1) In order to ensure and carry out object security, the statutory body of the operator of the object shall process:
(a) a security project for the protection of the object, including in particular the location and manner of storage of classified information in the object and the use of security measures for the external and internal protection of the object;
(b) technical documentation of object safety, containing technical data, instructions and rules on the installation and use of technical means of security;
(c) operating rules, setting out the mode of movement of persons and means of transport in the object, the mode of movement of classified items and materials in the object and the mode of handling of keys,
(d) rules for the exercise of the surveillance of an object, including the entry and exit mode of persons and means of transport and other instructions for the physical surveillance of an object;
(e) an object protection crisis plan containing instructions for the protection of classified information in the event of an emergency.
(2) The individual parts of the Object Security Documentation which contain classified information shall be classified in the classification level and shall indicate the appropriate classification level.
(3) The documentation of the object security shall be filed with the statutory authority of the operator of the object or of the authorised person. Its content is continuously updated in accordance with the actual security status of the object.
§ 15
Transitional provision
Paragraph 4 must be fulfilled within 18 months of the date of entry into force of this Decree.
§ 16
Efficacy
This decree shall take effect on the day of its publication.
