DECLARATION
Ministry of Finance
of 2 October 1997
laying down the rules governing the admission procedure and adjusting certain details concerning the rank of customs officers
The Ministry of Finance provides for the Customs Act, as amended by Act No. 113 / 1997 Coll.:
Rules governing the admission procedure of customs officers
§ 1
(1) The admission procedure shall be initiated on the date of receipt of the citizen's written application (hereinafter referred to as "the tenderer ') for admission to service. The application shall be submitted to the Ministry of Finance and shall be accompanied by a completed personal questionnaire and a CV.
(2) Before carrying out the entrance examination, which is part of the admission procedure, the applicant shall submit a personal questionnaire and a CV to verify the data contained in the application.
(a) identity card,
(b) an extract from the criminal record of no more than three months old;
(c) certificate of educational attainment, 1)
(d) a military book, if the applicant is subject to the obligation of service under the special legislation.2)
§ 2
Admission test
(1) The acceptance test is part of the admission procedure.
(2) The acceptance test shall determine the state of general, professional and, where appropriate, special knowledge, knowledge and skills, the quality of communication with people and the assumptions of the applicant for the performance of the service in the customs administration.
(3) The acceptance test shall consist of the written part and the oral part. The written section identifies the state of general knowledge and knowledge and the extent of basic knowledge from one world language. The oral section shall identify the state of professional and, where appropriate, special knowledge, knowledge and skills, the ability to communicate with people and the assumptions of the applicant for the service in customs.
§ 3
Decision-making of the application
(1) The Staff Officer entitled to decide on the admission of a candidate to service (hereinafter referred to as the "Staff Officer") shall decide on the admission of a candidate to service.
(2) The staff officer of the applicant for the outcome of the admission procedure shall notify the applicant in writing (3) at the latest within 30 days of the date of the examination. Notification shall not be justified if the tenderer is not accepted.
(3) The admission procedure shall end with the withdrawal of the application by the tenderer or by informing the tenderer of the outcome of the admission procedure.

§ 4
The period of service of years in rank shall be:
(a) when primary or secondary vocational education is achieved
1. one year for the rank of customs agent,
2. four years for the rank of customs officer,
(b) when achieving full secondary education, full secondary vocational education or higher vocational education
1. one year for the rank of customs officer,
2. three years for the rank of customs officer,
3. Four years for rank Chief Customs Officer,
4. five years for the rank of customs assistant,
5. Seven years for the rank of customs controller,
(c) upon reaching higher education
1. one year for the rank of customs assistant,
2. two years for the rank of customs controller;
3. Three years for the rank of Chief Customs Controller,
4. Four years for the rank of customs inspector,
5. Four years for the rank of Chief Customs Inspector,
6. Five years for the office of the Customs Council,
7. Five years for the rank of High Customs Council,
8. 5 years for the rank of Ministerial Customs Council.
§ 5
(1) The term of service of the years in rank shall be taken into account for the period of service of the years in the rank to which the customs officer is appointed, including the period in the previous service or employment relationship in which the customs officer was entitled.
(2) Time shall not be counted until the years in rank have been served.
(a) duty leave without entitlement to an income or leave without compensation of a salary lasting more than one month;
(b) additional maternity leave, 4)
(c) the execution of the custody if the prosecution has not been suspended or ended with a final acquittal judgment;
d) discharge of the service if he ends up releasing the customs officer for the reasons set out in § 106 (1) (d) or (e) or § 106 (2) (b) or (c) of the Czech National Council Act No. 186 / 1992 Coll., on the service relationship of members of the Police of the Czech Republic, as amended, or loss of rank,
(e) temporary incapacity to serve for sickness or accident, for which the customs officer is not entitled to an occupational income in sickness or sickness. 5)
§ 6
(1) A citizen who has already been a customs officer shall be appointed, on reentry, to the rank which he has reached on the day of termination of the service or employment in which he was a customs officer, but not more than the rank laid down for the office in which he is appointed or appointed.
(2) If it is more advantageous for a customs officer, he shall be appointed to the rank in accordance with Paragraph 17 (1) of the Act when he is recruited.
§ 7
Final provision
This decree shall take effect on the day of its publication.
