DECLARATION
of 15 August 2023
amending Decree No. 355 / 2006 Coll., laying down the methods and conditions for registration, operation, testing of historical and sports vehicles and the methods and conditions for testing of road vehicles registered in the register of road vehicles, as amended
The Ministry of Transport provides pursuant to Article 91 (1) of Act No. 56 / 2001 Coll., on the conditions for the operation of vehicles on the road, as amended by Act No. 103 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 170 / 2007 Coll., Act No. 297 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 239 / 2013 Coll., Act No. 63 / 2017 Coll., Act No. 193 / 2018 Coll., Act No. 337 / 2020 Coll., and Act No. 432 / 2022 Coll. ("Act ') for the implementation of § 79a (6), § 79b (8) and § 79c (4) Act:
Decree No. 355 / 2006 Coll., on the determination of the method and conditions of registration, operation, method and conditions of testing of historical and sports vehicles and the manner and conditions of testing of road vehicles, which is registered in the register of road vehicles, as amended by Decree No. 144 / 2012 Coll. and Decree No. 163 / 2017 Coll., is amended as follows:
1. In Paragraph 2 (1), the words "the President of the Regional Test Committee registered 'are replaced by the words" the said'.
2. In Paragraph 2 (1), the sentence "The validity of the testing and the result of the technical inspection of the historical vehicle shall be verified locally by the competent authority and marked in the certificate of the historical vehicle when it is issued. ';
3. Paragraph 2 (4) reads as follows:
"(4) The competent authority shall place in the file of the historical vehicle the original registration documents and documents of origin, if any, and an application for testing of the historical vehicle containing the positive test report and, where appropriate, other documents submitted. In the register of historical and sports vehicles, the competent authority shall, locally, enter scanned copies of such documents. ';
4. In Article 3 (1), the words "vehicle technical licence 'are replaced by the words" register of historical and sports vehicles';
5. In Paragraph 3 (1), the words "indicate the assignment of a special registration mark 'are replaced by the words" register the assigned special registration mark'.
6. In Section 4, the words "is equipped with a prescribed number of lighting sources under a special legislation (1) and, if not fitted with them by the vehicle manufacturer, the vehicle shall be equipped with a prescribed number of additional lighting sources located on the illuminating ramp 'shall be replaced by the words" meets the technical requirements for outline lights applicable to the category of vehicle at the time of the first approval of the technical competence of the vehicle in the Czech Republic'.
7. footnote 1 is deleted.
8. In Section 4, the first sentence is inserted: "In the event that the vehicle is not equipped with the prescribed number of position lights from the vehicle manufacturer, it shall be equipped with two white position lights at the front and two red position lights at the rear, with the exception of one-stop vehicles which shall be equipped with one white colour at the front and one red colour at the rear. '
9. In Section 4, the words "in the application for testing of a historical vehicle, the Chairman of the Regional Test Committee 'are replaced by the words" locally competent authority'.
10. In Section 6, the words "or road" shall be inserted after the word "historical."
11. in Paragraph 6 (1):
"(1) The testing of a historical or road vehicle shall be carried out by a legal person authorised by the International Federation of Historical Vehicles pursuant to the International Technical Code of the International Federation of Historical Vehicles - FIVA, International Technical Code (hereinafter referred to as the International Technical Code), as amended, or by the International Automotive Federation, according to Annex K to the International Regulations of Sports - FIA, Appendix K to the International Sporting Code (hereinafter referred to as the International Regulations of Sports). ';
12. in Paragraph 6 (2):
"(2) The legal person who carried out the testing of the vehicle for historical originality shall provide the Ministry electronically with vehicle data that has been tested with a positive result, within the scope of the factory brand, type, vehicle identification number (VIN), owner and operator, and a scanned copy of the complete and validated application for testing of the historical vehicle. ';
13. in Paragraph 6 (3):
"(3) When testing a historical or road vehicle, its historical originality shall be verified. The result of the testing of a historical or road vehicle shall be marked by a legal person in the application for testing of a historical vehicle and in the certificate of a historical vehicle, if issued. ';
14. In Article 6, paragraphs 4 to 6, including footnote 2, are deleted.
Paragraph 7 shall become paragraph 4.
15. in Article 6, the following paragraphs 5 and 6 are added:
"(5) For the testing of a road vehicle, Annex 6 to this Decree shall apply mutatis mutandis.
(6) The model of the application for recognition of the testing of a road vehicle is set out in Annex 7 to this Regulation and the model of the evidence of recognition of the testing of a road vehicle on historical grounds is set out in Annex 8 to this Regulation. '
Article 16 (6a) is deleted.
17. in Article 7 (4), the words "sports vehicles" shall be inserted after the words "licences."
18. Annexes 2 and 3 shall read as follows:

Rules for uniform testing of historical vehicles
1. In order to maintain the uniformity of testing of historical vehicles for historical originality, this testing is carried out in the Czech Republic according to the International Technical Code or the International Sports Code.
2. According to the International Technical Code, a mechanical vehicle of at least 30 years old, the type of which is no longer produced and which is stored and maintained in the historical state and the technical characteristics of its main components have not been subject to substantial changes and is therefore part of the technical and cultural heritage.
3. The applicant for testing the vehicle for historical originality, together with the completed application for testing the historical vehicle in accordance with the model set out in Annex 3 to this Regulation, shall present the vehicle for verification of the actual state of the vehicle and at the same time prepare documents to verify the data in the application and to verify the historical originality which may arise in the testing. The colour photographs of the vehicle attached to the application may be in electronic form or the size of 6 x 9 cm on hard glossy photo paper.

Transitional provision
Forms made in accordance with the models set out in Annexes 2 to 5 and 7 to Decree No. 355 / 2006 Coll., as effective before the date of entry into force of this Order, may be used until stocks are exhausted, but until 31 December 2028 at the latest.
Efficacy
This Decree shall take effect on 1 September 2023, with the exception of Article I (4) and (19), which shall take effect on 1 January 2024.
