DECLARATION
of 19 August 2011
amending Decree No 337 / 2010 Coll., on emission limits and other conditions for the operation of other stationary sources of air pollution by emitters and using volatile organic substances and on the way products containing volatile organic substances are handled
The Ministry of the Environment provides pursuant to § 55 (2) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 385 / 2005 Coll., Act No. 212 / 2006 Coll., Act No. 180 / 2007 Coll., Act No. 25 / 2008 Coll. and Act No. 483 / 2008 Coll.:
Decree No. 337 / 2010 Coll., on emission limits and other conditions of operation of other stationary sources of air pollution by emitters and using volatile organic substances and on how products containing volatile organic substances are handled are amended as follows:
1. Paragraph 3, including the title, reads:
Volatile organic substances
For the purposes of this Decree, volatile organic substances are divided into:
(a) volatile organic substances classified as carcinogenic, mutagenic and toxic for reproduction and assigned to the hazard statements H340, H350, H350i, H360D or H360F with the exception of petrol;
(b) volatile organic substances classified as carcinogenic, mutagenic and toxic for reproduction and assigned risk phrases R45, R46, R49, R60 or R61 with the exception of petrol;
(c) halogenated volatile organic substances assigned to the hazard statements H341 or H351;
(d) halogenated volatile organic substances to which risk phrases R40 or R68 are assigned;
(e) petrol and volatile organic substances not falling within points (a) to (d). ';
2. In Article 4 (4), "§ 3 (a) or (b) 'is replaced by" § 3 (a), (b), (c) or (d)';
3. In Article 5 (3), the words "or (b) 'shall be inserted after the words" Article 3 (a)'.
4. In Article 5 (4), "§ 3 (b) 'is replaced by" § 3 (c) or (d)';
5. in Article 6 (1) (a), "§ 3 (a) and (b)" shall be replaced by "§ 3 (a) to (d)";
6. in Article 6 (1) (b), "§ 3 (c)" is replaced by "§ 3 (e)";
7. In Article 6 (3), the words "organic solvents' are replaced by" volatile organic substances'.
8. Paragraph 6 is amended as follows:
"(6) The source operator referred to in Annex 1 to this Decree, using volatile organic substances referred to in § 3 (a) or (b) or mixtures containing such substances, shall continuously replace those substances or mixtures containing less harmful substances or mixtures where technically and economically feasible. ';
9. In Annex No 1, in the title of point 2.1, "§ 3 (a) and (b) 'is replaced by" § 3 (a), (b), (c) or (d)'.
10. In Annex 1, in point 2.1, in note 1, under Tables 1 and 2, the words "or (b) 'shall be inserted after the words" Paragraph 3 (a)'.
11. In Annex 1, in the heading 2.2, "§ 3 (c) 'is replaced by" § 3 (e)';
12. In Annex No 1, point 2.2.1, "§ 3 (a) and (b) 'is replaced by" § 3 (a), (b), (c) or (d)'.
13. In Annex 5, Part II, table In the explanatory notes, "more than 15% by weight 'is replaced by" 15% by weight or more'.
14. In Annex 5, Part II, Table B, in the explanatory notes, the words "more than 15% by weight 'are replaced by the words" 15% by weight or more'.
Efficacy
1. This Decree shall take effect on the 15th day following its publication.
2. Paragraph 3 (b) and (d) of Decree No 337 / 2010 Coll., as amended by that Order, shall expire on 31 May 2015.
