of 29 April 1992
on court fees for proceedings before the Supreme Court of the Czech and Slovak Federal Republic and military courts
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Purpose of the law
The purpose of the Act is to determine the judicial fees (hereinafter referred to as "fees') for acts or proceedings (hereinafter referred to as" the charge ') carried out by the Supreme Court of the Czech and Slovak Federal Republic and military courts (hereinafter referred to as "the Court').
Subject matter of fee
The subject of the fee shall be the charge in the tariff of charges (hereinafter referred to as the tariff list), as annexed to this Act.
Taxpayers
(1) The payer shall be the natural or legal person who has submitted an application for a charge or, where appropriate, the natural or legal person to be decided by the court in the cases provided for by law.
(2) If more than one taxpayer is required to pay the fee jointly, the fee shall be paid jointly and severally.
Exemption from fees
(1) The following shall be exempt from fees:
(a) Czech and Slovak Federal Republic, Czech Republic and Slovak Republic;
(b) municipalities and urban areas in the capital of the Czech and Slovak Federal Republic of Prague and in the capital of the Slovak Republic of Bratislava in cases where the charge relates to the performance of the administration which is transferred to them;
(c) budgetary organisations and foundations;
(d) the diplomatic representative of foreign states, provided reciprocity is guaranteed;
(e) natural and legal persons under international agreements or agreements by which the Czech and Slovak Federal Republic is bound.
(2) In addition, the fees shall be exempt from the following actions:
(a) matters relating to sickness insurance, health insurance, social security and the provision of health services;
(b) in respect of damages caused by an unlawful decision or by maladministration;
(c) cases of electoral complaints;
(d) in disputes concerning jurisdiction between courts of one Republic and state notaries or authorities of the other Republic, as well as between courts, state notaries and federal authorities of the State;
(e) determining the jurisdiction of the court, if it is a matter falling within the competence of the Czechoslovak court but the conditions of local jurisdiction are lacking or cannot be ascertained;
(f) in cases of judicial rehabilitation pursuant to special provisions (1)
Rates of fees
The fee rates shall be fixed and shall be a percentage of the basis of the fee and shall be set in the tariff for each subject of the fee.
Basis of fee
(1) The basis of the fee fixed by the percentage is the price, (2) where applicable, the value of the subject matter of the charge which is customary at the place and time of payment of the charge. The price or value shall be communicated to the court by the taxpayer.
(2) If the debtor fails to disclose the price or value of the subject-matter of the charge, or the price or value appears to be low, the court shall determine it at the expense of the debtor.
(3) If the subject matter of the action is extended at the hearing, the court shall measure the fee if the amount of the fee is more than 100 CZK. If the subject matter of the charge is limited before the first hearing, the court shall return the corresponding part of the charge as an excess.
(4) If more than one claim is applied, a fee equal to the sum of the fees set out in the tariff shall be charged for each act to be charged in the application.
(5) Where the fee is subject to a repayable transaction, the fee shall be the sum of the prices or values of all repayable transactions. If the performance is for more than three years, for an indefinite period or for life, the price or value of the performance shall be considered to be three times the price or value of the annual performance.
(6) The price and, where applicable, the value of the accessories of the subject-matter of the charge shall be included in the basis of the charge if the accessories are subject to the charge.
(7) The basis of the fee shall be rounded up to the whole hundred crowns and the whole crown down.
The creation of a fee obligation
The fee obligation shall be:
(a) making an application for a charge;
(b) by making a submission to the court;
(c) in other cases, by decision of the court.
Validity of the fee
(1) The fee is payable by the occurrence of a charge obligation. In cases where a charge is imposed by a judgment of a court, the court shall set in the decision a time limit for payment of the charge which shall not exceed 15 days from the date on which the decision becomes final.
(2) The payer shall prove to the court the payment of the fee.
Payment of the fee
The fees shall be paid by postal order or transfer from the taxpayer's account to the court. Fees not exceeding 500 CZK may also be paid in cash in court.
(1) Fees are the income of the Federation State Budget.
(2) Fees paid on behalf of a court shall be transferred each past quarter of a calendar year to the account of the Federation State Budget held by the Territorial Financial Authority responsible for the location of the court, but not later than the fifth day of the calendar month following the end of the quarter.
Consequences of non-payment of the fee
(1) If the fee due was not paid when the application was lodged or when the application was written in the Protocol, even after the time limit laid down by the court, the court shall not carry out a charge. If, on the basis of the application lodged, the court takes action, it shall determine or measure the fee in the decision. If the court has not taken action on the substance of the case, the proceedings shall cease.
(2) In the event of a resolution terminating proceedings for the non-payment of a charge of legal authority, the charge shall cease.
Repayment of the fee
(1) The Court of First Instance shall decide on the refund of the fee and / or part thereof (overpayment) if it has been paid by a person who is not obliged to do so or has been paid more than the amount due (overpayment) or, if the subject matter of the charge has been limited after the application has been lodged, before the first hearing (overpayment).
(2) The Court of First Instance shall decide whether the fee is to be refunded even in cases where the procedure has been terminated or the application has been withdrawn before the first hearing, or the application has been rejected for delay or inadmissibility or because the application has been lodged by the person who is not entitled to do so.
(3) The fee referred to in paragraph 2 shall not be refunded unless it exceeds 100 CZK.
(4) The entitlement to refund of the fee or excess shall expire three years after the end of the calendar year in which the fee was paid.
Termination of the right
(1) A fee or a supplement to a fee cannot be charged or enforced after three years from the end of the calendar year in which the facts relevant for the maturity of the fee occurred.
(2) Where an action is carried out within that period to measure or recover a fee or a arrears, the measurement or recovery period shall run again from the end of the calendar year in which the payer was informed of that action; However, the fee or arrears may be charged and recovered at the latest within 10 years of the end of the calendar year in which the events relevant for the maturity of the fee occurred.
(3) The action to recover a fee or a supplement is also a reminder to the taxpayer to pay a fee or a supplement.
Management
In proceedings relating to charges, the court shall decide and proceed in accordance with the Civil Code, unless otherwise provided for in that law or, where appropriate, by specific provisions on proceedings relating to taxes and charges.
Control of fees
When checking the correct and timely measurement, collection and payment of fees, 3) unless otherwise provided by this law or the Civil Code.
Transitional provision
(1) Charges shall be levied in accordance with the provisions of the existing regulations for the actions to be carried out before this Act is effective.
(2) The arbitration fee paid before the application of this Act under the applicable provisions of the present Act shall be credited to the fee under this Act. Any overpayment shall not be refunded or any underpayment shall not be measured.
The following shall be deleted:
1. Order of the Minister of Finance No. 78 / 1958 Coll., establishing arbitration fees.
2. Guidelines on the payment of arbitrage fees, as laid down in Decree of the Minister of Finance No 78 / 1958 Coll., which provides for arbitration fees (amount 24 / 1961 Ú. l.).
Efficacy
This Act shall take effect on 1 June 1992.
