of 30 September 2015
amending Decree of the Ministry of Transport and Communications No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended by Act No. 478 / 2001 Coll., as amended
The Ministry of Transport provides pursuant to § 62 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., Act No. 374 / 2007 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 230 / 2014 Coll.:

The Decree of the Ministry of Transport and Communications No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., as amended by Decree No. 152 / 2003 Coll., Decree No. 298 / 2006 Coll., Decree No. 156 / 2008 Coll. and Decree No. 284 / 2013 Coll., is amended as follows:
1. In Section 1 of the introductory part of the provision, the words "European Community1) 'are replaced by the words" European Union1)'.

Commission Directive 2012 / 36 / EU of 19 November 2012 amending Directive 2006 / 126 / EC of the European Parliament and of the Council on driving licences Commission Directive 2014 / 85 / EU of 1 July 2014 amending Directive 2006 / 126 / EC of the European Parliament and of the Council on driving licences. ';
2. in Paragraph 14 (1) (b):
"(b) knowledge of the control and maintenance of the vehicle, safety in the handling of the load, economic management in terms of fuel consumption, operating costs and environmental friendliness, technical characteristics of vehicles and their components, in particular steering, tyres, brakes, lights, and physical characteristics of vehicles, in particular speed, friction, dynamics and energy, ';
3. In Article 14 (1) (c), the words ", consistency and consistency of the evaluation 'shall be inserted after the words" Gesticulation'.
4. In Paragraph 15, the sentence "The applicant for a driving licence shall demonstrate a high level of knowledge and skills in driving motor vehicles of those groups for which he is entitled to carry out the driving licence tests' is added at the end of paragraph 5.
5. In Article 17 (4), the words "the means of safe driving in tunnels' shall be added at the end of the text of point (e).
6. In Article 17 (6), the words "and basic knowledge of the provision of first aid 'shall be added at the end of the text in point (d).
7. Paragraph 17 (6) (j) reads as follows:
"(j) the basic structure and function of the combustion engine, fuel system, electrical system, ignition system and transmission system, the operating fluid function, the principles of their control, addition and replacement, the principles of lubrication of individual parts of the vehicle and their control and maintenance within the framework of the protection against freeze (only for vehicle groups C1, C1 + E, C + E, D1, D1 + E, D, D + E),";
8. in Article 17 (6) (k), the word "construction" shall be inserted after the word "principles."
9. in Article 17 (6) (l):
"(l) types of braking systems, their functions, main components, connection, use and daily maintenance of braking systems and speed controls, use of brakes with anti-lock system,"
10. in Article 17 (6) (m), the words "essential parts including their involvement, use and daily maintenance" shall be replaced by "functions, essential parts, engagement, use and daily maintenance."
11. in Article 17 (6) (o), the word 'regular' is replaced by 'normal';
12. in Article 17 (6) (p), the word "transport" shall be inserted after the word "loading."
13. in Article 19 (1) (a), the words "except for categories of vehicles AM, A1, A2 and A" shall be added at the end of the introductory part of the provision after the word "vehicles."
14. in Article 19 (1) (a) (1), the words "and the head restraint" shall be inserted after the word "seat."
15. in Paragraph 19 (1) (b):
"(b) before commencing, in the case of a group of vehicles AM, A1, A2 and A, check the state of the tyres, brakes, steering, exterior lighting of the vehicle, direction lights, warning lights switches, if available, to properly attach the protective helmet to the head and carry out the following special driving forces, such as secondary chain, propeller or shaft, engine oil levels and brake fluid levels, to adjust the protective equipment, including gloves, boots and clothing, to the seat of the passenger:
1. remove the motorcycle from the centre stand, guide it without using the engine forward and backward with turning left and right, with parking in limited space and build the motorcycle on the centre stand; where the motorcycle is only made with support stand, the support stand shall be used;
2. conduct a low-speed ride, including following the test commissioner at a speed of walking in the straight direction, a safe 180 ° turn by a U-shaped turn, a slalom, a "8" track, a repeated run with one foot on the foot, moving the other foot to the foot and stopping with a subsequent support of one or both legs to maintain the stability of the motorcycle,
3. carry out higher speeds involving a slalom at a speed of not less than 40 km.h-1 and avoiding an obstacle at a speed of not less than 50 km.h-1 (for a group of vehicles AM at 45 km.h-1);
4. carry out an accuracy of at least 50 km.h-1, an emergency braking at a specified distance of at least 50 km.h-1 (45 km.h-1 for the category of vehicles AM.) ';
16. in § 19 (2) (a) (1):
"1. the ability to control a motor vehicle in road traffic conditions, in particular to maintain the correct direction of travel, driving with a view to reducing fuel consumption and emissions, accelerating the vehicle up to the appropriate speed and maintaining this speed even during the shift of the different gears, turning the vehicle into an intersection and running it safely, adjusting the speed of the vehicle when turning left and right, driving on the road in the right direction, passing the anti-driving vehicles, including sections with limited space, adjusting the speed of the vehicle to the conditions of traffic on the road, including, where applicable, the use of other vehicles, the right distance between the vehicles on the left and on the right side, turning off the road, moving after parking, if possible, driving around obstacles, for example parked vehicles, compliance with safe lateral distance, or overtaking other vehicles;
17. in Article 19 (2) (a) (2), the words "transit through the highway junction and tunnel" shall be inserted after the words "crossing the lane with slower moving vehicles."
18. in Paragraph 19 (2) (a), at the end of point 2, comma is replaced by "a" and the following point 3 is added:
'3. the implementation of the necessary safety measures when leaving the vehicle; ';
19. in Article 19 (2), point (b) is deleted;
Points (c) and (d) shall be renumbered (b) and (c).
20. in Paragraph 19 (2) (c), the word 'not exceeding' is replaced by 'not exceeding';
21. Paragraph 19 (4) reads:
"(4) The assessment of the practical driving test shall include:
(a) safe, predictable, considerate, adaptable and resolute driving;
(b) compliance with driver's obligations on road traffic, adaptation of road conditions and nature, current weather effects and other road conditions;
(c) respect for other road users, correct and timely response to their behaviour, with caution towards children, pedestrians, cyclists, persons with reduced mobility and other vulnerable road users;
(d) the ability to control the vehicle with regard to the correct setting and use of safety belts, rear-view mirrors, head restraints, seats, the correct use of lights, the ability to control the warning direction indicator lights, wipers, heating fan, air conditioning and other equipment of the vehicle;
(e) the correct use of controls with regard to the driving mode and quality, control of clutch, gearbox, accelerator, steering, braking system including auxiliary braking systems, if fitted by the vehicle, the use of other deceleration procedures than braking and the use of the parking brake to safely start the slope;
(f) the ability to control the vehicle under different conditions and at different speeds, taking into account the type, characteristics, mass and dimensions of the vehicle or combination; for vehicle groups B + E, C1 + E, C, C + E, D1, D1 + E, D, D + E, D + E the ability to control the vehicle with respect to mass and type of load, for vehicle groups D1, D1 + E, D, D + E the ability to ensure the comfort of passengers while driving, without sudden speed increase, with continuous steering and continuous gear shifting, and without severe braking,
(g) for vehicle groups B, B + E, C1, C1 + E, C + E, C + E, D1, D1 + E, D, D + E, ability to drive economically and sparingly to the environment, taking into account engine speed per minute, gear shift, braking and acceleration;
(h) early deceleration, braking and stopping as appropriate, predictability, for vehicle groups C1, C1 + E, C, C + E, D1, D1 + E, D, D + E the ability to use different braking systems;
(i) observational ability, panoramic vision, correct and timely use of rear-view mirrors, long, medium and short-distance vision in relation to the ability to react in a timely and correct manner;
j) observance of the priority in driving at crossroads and highways, giving priority in driving in other circumstances, such as changing direction, crossing between lanes, special driving operations;
(k) the ability to evaluate light-signalling, road signs and other markings, compliance with the correct light-signalling behaviour, compliance with traffic traffic control instructions, correct behaviour by road signs, for example, bans or commands, adequate action by road marking;
(l) the ability to maintain distance, to maintain a safe distance from the vehicle, to keep a safe side distance on the sides of the vehicle, sufficient and safe distance from other road users;
(m) the ability to maintain the direction of travel and the correct location on the road when placing into lanes, on roundabouts, in corners, appropriately according to the type and characteristics of the vehicle or combination and the ability to predict the change of classification;
(n) the ability to observe and not exceed the maximum permissible speed when not exceeding the maximum permitted speed, not to drive excessively low speed at optimum speed conditions, to adjust the speed of weather and road traffic conditions, to choose such speed as to be able to stop the vehicle safely at a distance to which it can view;
(o) the ability to give signs correctly and in a timely manner, in particular to change the direction of travel, to adequately respond to all signs given by other road users, including light warning signs. ';
22. In Article 19, the following paragraph 5 is added:
"(5) The practical driving test record shall include the following elements:
(a) the name, surname and date of birth of the applicant for a driving licence or holder of a driving licence;
(b) groups of vehicles for which the practical driving test is carried out;
(c) registration mark of the training vehicle or training vehicles connected to the combination;
(d) indication of the date and duration of the practical driving test;
(e) information on the knowledge, skills and behaviour tested in the practical driving test and their evaluation;
(f) the name, surname and number of the Examination Commissioner;
(g) signature and stamp of the examiner,
(h) signature of the applicant for a driving licence or holder of a driving licence;
(i) the signature of the driving instructor only if the applicant for a driving licence or the holder of a driving licence refuses to sign the test record of the practical driving; and
(j) the time limit for shredding the document in accordance with the law governing the performance of the file service. "
23. the following Annex 7 is inserted after Annex 6:

"Annex No 7 to Decree No 167 / 2002 Coll.
Special driving manoeuvres for the first part of the test of practical driving of motorcycles classified in the category of vehicles AM, A1, A2 and A
Paragraph 19 (1) (b) (1).
1.1 Removing the motorcycle from the centre stand and leading it forward without using the engine with turning left, then parking back into the restricted space and position of the motorcycle on the centre stand. Remove the motorcycle from the centre stand and remove it from the restricted space on the right. If the motorcycle is only made with support stand, the support stand shall be used.

Article 19 (1) (b) (2).
2.1 low speed driving - following the Commissioner at a walking speed of about 4 km.h-1 in direct direction (track length about 12 m)

2.2 A safe 180 ° turn through the "U" shape curve at a walking speed of about 4 km.h-1

2.3 Slalom at walking speed approx. 4 km.h-1

2.4 Driving along the "8" track at walking speed approx. 4 km.h-1

2.5 Repeatedly starting with one foot on the foot and moving the other foot to the foot and stopping with one or both legs to maintain the stability of the motorcycle

2.6 Rail for slow-speed operations

3.1 Driving at higher speeds, slalom at 40 km.h-1

3.2 Obstacle avoidance at initial speed of at least 50 km.h-1 (45 km.h-1 for AM group)

Article 19 (1) (b) (4).
4.1 Braking to accuracy in a specified section of at least 50 km.h-1 (45 km.h-1 for AM group)

4.2 Emergency braking over a specified distance from a speed of at least 50 km.h-1 (45 km.h-1 in the AM group)

4.3 Railroad for high speed operations

This Decree shall take effect on 1 November 2015.
