DECLARATION
of 22 May 2006
on the extent and manner of processing of major accident reports and final reports on the occurrence and impact of a major accident
According to Article 26 (5) of Act No. 59 / 2006 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemical preparations and amending Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related acts, as amended, and Act No. 320 / 2002 Coll., on the amendment and repeal of certain laws in connection with the cessation of the activities of district offices, as amended, (Act on the Prevention of Major Accidents):
Preliminary provisions
This Regulation (1) implements the relevant European Communities2) and regulates the way in which major accident reports and final reports on the occurrence and impact of a major accident are processed.
Written report of major accident
The written report on the occurrence of a major accident shall be processed to the extent specified in Annex 1.
Final written report on the occurrence and impact of a major accident
The final written report on the occurrence and impact of a major accident shall be prepared to the extent specified in Annexes 2 to 4.
Method of processing the written report on the occurrence of a major accident and the final written report on the occurrence and impact of a major accident
The written report on the occurrence of a major accident and the final written report on the occurrence and impact of a major accident shall be submitted in one original copy and in electronic form.
Transitional provision
The written report on the occurrence of a major accident and the final written report on the occurrence and impact of a major accident that occurred or occurred before the entry into force of this Order shall be carried out in accordance with Decree No 7 / 2000 Coll., determining the extent and manner of processing of the major accident report and the final report on the occurrence and consequences of the major accident.
Efficacy
This Decree shall take effect on 1 June 2006.

Instructions for completing notes
DESCRIPTION OF SERIOUS HAVARIA
Note 1: Accident type
If necessary, provide further information, additional data expressed by code A1 (a). In cases where more than one accident has occurred, indicate the link between the code numbers by the text in the note.
Note 2: Complete list of hazardous substances
Please provide a list of hazardous substances and their quantity in the inclusion proposal (Section 3 of Act No. 59 / 2006 Coll.) and indicate how they are used in the building or equipment.
The default materials are those used as raw materials in the building or equipment.
Semi-finished products are products that will be further processed for further use.
Normally manufactured products are products which have been produced under normal conditions or substances brought into the establishment only for storage [i.e. required end products, unwanted but normal emerging preparations (by-products) with low commercial value and waste without commercial value].
Products resulting from an accident are products or dangerous substances which, in theory, may have been or have already been produced and accumulated in an object or plant when a major accident occurs as by-products (e.g. dioxin in a fire in 1976 in Seves).
Note 3: List of hazardous substances directly involved in a major accident
List of dangerous substances directly involved in a major accident, including an indication of their actual or anticipated quantity.
The actual amount means the amount of substances that have been proven to have escaped, burned or otherwise lost.
The expected quantity means maximum possible releases (losses) of dangerous substances. An absolute quantity whose losses can be estimated and justified under normal operating conditions is considered, even if this quantity has not been captured (removed) in the remediation operation.
Note 4: List of substances indirectly involved in a major accident
List of substances indirectly involved in a major accident, including an indication of the quantity actually found or expected. Substances are involved in the accident as the initiator of a major accident or are involved in its subsequent phases, but do not directly interact with their hazardous properties (e.g. a flammable or explosive substance may be involved in the formation of a fire or explosion to initiate the release of toxic gases which are then a direct cause of poisoning).
The designation of the actual or anticipated quantity shall have the same meaning as in note 3.
Note 5: Comments on hazardous substances
Indicate all special storage or process conditions (e.g. those involving cooling, high pressure or temperatures) and how dangerous substances have been used in these conditions and explain the important circumstances concerning their actual or anticipated quantity.
Hazardous substances generated and accumulated during a major accident or otherwise not classified elsewhere should be evaluated (classified) in accordance with existing rules and all their characteristics considered due to the risk of a major accident.
Note 6: Comments on the source of the accident
Discover the coded information from item A3 (b) with a focus on details of the type of equipment or part of the crashed equipment, its production and age, the time since the last modification or repair, the standards used in the project, storage or manufacturing conditions, whether production or repair was taking place at the time of the major accident, etc., or any other specific circumstances.
Note 7: Meteorological conditions
Comment on the state of climate conditions as they were normal due to the occurrence and impact of a major accident, including weather factors in the days preceding the major accident that may have affected its occurrence (persistent rain, prolonged drought, etc.). If the weather conditions have changed significantly during the accident, indicate the main changes, including the identification of the weather station to which the observation relates.
Note 8: Comments on the causes of the accident
Dispose of the coded information from point A5 (a) and indicate its importance. Please give details of exercises and training which could be related to the human factor (knowingly and unconsciously).
Note 9: Major accident comment
Provide a short chronological overview of the main events and provide the basic information referred to in Section A, where possible, on the occurrence and course of the major accident. The information should be supplemented by a description of the site referred to in Section A3 (a).
IMPACTS OF SERIOUS HAVARIA
Note 10: Comments on the affected area
Dispose of the abbreviated information referred to in point B1 in order to specify the extent of the encroachment of the territory. The extent of damage to buildings or the concentration of the gas cloud (etc.) at different distances from the centre of the accident is useful to indicate mainly in the map, but detailed considerations on the extent of damage caused by the major accident belong to Part B5.
Note 11: Impact of a major accident on persons
The overall threat shall include persons who have proven to be at risk of serious accident.
Instant or subsequent deaths include deaths directly related to a major accident.
The treatment of injuries in the hospital covers injuries, poisoning, chemical or other burns, trauma from injury or other psychological or mental impairment of persons requiring hospitalisation for more than 24 hours (cases other than observation / preventive examination only).
Other serious injuries include injuries clearly requiring medical intervention without hospitalisation for more than 24 hours.
Observations shall include those who complain of health problems related to the effects of the accident and whose health is subsequently observed.
Note 12: Comments on the effects of a major accident on persons
Dispose of B2 (a) information and provide the types of injury or other information that can be used to assess the impact of a major accident (e.g. the susceptibility of individual age categories to a certain type of injury, the health status of persons or the place where the injury occurred). If no person has been affected with medical consequences, please indicate why.
Note 13: Comments on environmental damage
Section B3 focuses on the environmental aspects of the affected environment. Discover here the abbreviated information on the type and amount of environmental damage (number of animals killed and destroyed, contaminated areas, contaminated soil / water volumes, concentration of pollutants in soil / water, distance of spread of pollution, extent of population affected,% impact on population / territory, affected species, etc.). If no such environmental damage has been recorded, please provide and explain why. Any costs of remedial measures will be listed in section B5. Indicate the likely time horizon of corrective actions (immediate, medium-term - 3 years, long-term).
Note 14: Comments on damage to cultural heritage
Indicate what has been damaged or destroyed and specify the type and value of the damage. All available cost information should be provided in section B5. In the absence of damage to the cultural heritage caused by a major accident, please indicate why.
Note 15: Property damage
Estimate the damage to property in CZK thousand.
Property damage includes actually quantified damage to buildings, vegetation, material or other property (including productive animals, crops, etc.) which have been caused by a cause of a major accident. The cost of repairs or other repairs or production losses is not included here. The costs of repairs of buildings and demolition can only be reported here if they have a direct impact on the damage caused.
The cost of intervention and rendering - repairs include the current or estimated cost of rescue and rendering work. In the event that the estimate of the repair costs of buildings has been calculated as losses on property (especially for the operator), it should not be reconsidered here.
Note 16: Comments on property damage
Please provide in detail what is included in the damage quantified in point B5. If the damage to property cannot be separated from the cost of intervention for example, please stress this and indicate the total number. If costs have not been incurred or details of costs are not available, give reasons.
Note 17: Commentary on interference in the life of persons living around the facility or facility
Provide details of the abbreviated information referred to in points B5 (a) to (c), e.g. the number of persons whose life rhythm has been somewhat reduced by the consequences of a major accident, the reasons for evacuation, the reasons for interruption of energy and water supply and other impacts. If no one has been compromised under points (a) to (c), give the reason.
Note 18: Comments on the impact of a major accident
Please provide further information on impacts not covered by Section B which may be used to analyse the impact of a major event.
LIABILITIES AFTER SERIOUS HAVARIES
Note 19: Comments on emergency work in major accidents
Please provide a brief chronological list of all intervention activities described in codes and in abbreviated form in points A to C. Describe in detail the number and orientation (type) of the intervening and whether their numbers and orientation were consistent with the major accident. Please provide details of the health and environmental monitoring and of the special rendering work carried out or further required. The price of the measures listed in this section should be given in section B5 and details of the assessment of the adequacy of the corrective measures should be given in section C2 (d) to (e).
Note 20: Comments on the assessment of obligations under the Major Accident Prevention Act
Provide details of the information required under C2 in abbreviations and explain the reasons for decisions taken and their adequacy, etc. Where obligations have been fulfilled in accordance with the requirements of the law, in particular in point C2 (c) on security of safety management, it is important to explain how this has been achieved, e.g. by approving the programme, by a certificate that complies with the applicable legislation.
Note 21: Legal implications
Please provide all information concerning the police and judicial investigation and other legal acts related to the consequences of the major accident. Details of the investigations carried out (including proposals for investigations), their results, the imposition of penalties or the agreed financial compensation, etc.
Note 22: Other measures
Indicate all other official / administrative steps and penalties imposed, their detailed description and results.
Note 23: Measures taken to avoid recurrence of a major accident
Describe any practical organisational measures or other means which have been assessed as important to prevent a recurrence of the described major accident.
Note 24: Measures to reduce the impact of a major accident
Please describe any practical organisational measures or other means which have been assessed as important in terms of minimising the consequences of the major accident described.
Note 25: Applicable materials (literature)
Please provide an evaluation of the specific mathematical models dealing with the forecasting of the consequences of the major accident that have been used, the results of which have to be revised or have proved invalid from the point of view of the accident. Provide other published reports, technical publications, models, etc., which are related to the major accidents described and are applicable to understanding what has happened.
Note 26: Intervention / discussion on response to a major accident
Provide any additional information not yet provided and may be appropriate to understand the causes and impacts of the major accident.
