THE LAW
of 16 September 1993
on the second increase in pensions in 1993 and the increase in pensions granted in 1994
Parliament has decided on this law of the Czech Republic:
Increase in pensions granted before 1 January 1994
(1) From the payment of the pension due after 31 October 1993, pensions awarded before 1 November 1993 shall be increased by a fixed amount, which shall be:
(a) 300 CZK if old-age, disabled or in service of years,
b) 180 CZK, if it is about widower's pensions,
(c) 150 CZK, if there is a partial invalidity or orphan of an orphan child,
(d) 90 CZK, if it is an orphan's pension for a unilaterally orphaned child,
(e) half of the amounts referred to in points (a) to (d), if the pension is provided for in connection with another pension1) or with income from gainful activities.
(2) Old-age, invalidity, partial invalidity, for the service of years, widow's and orphan's pensions granted from 1 November 1993 to 31 December 1993 shall be increased from the date on which the amount referred to in paragraph 1 is granted.
Increase in pensions granted in 1994
Old-age, invalidity, partial invalidity, for service of years, widower's and orphan's pensions granted from 1 January 1994 to 30 November 1994 shall be increased by 30% of the monthly amount of the pension to which the citizen was entitled on the date of the pension.
Increase in widower pensions
(1) The amount of the widower's pension according to § 48a of the Social Security Act 2) CZK 930 per month.
(2) The widower's pensions paid on the date of application of this Act shall be adjusted in accordance with paragraph 1 from the payment of the pension due after 31 October 1993.
Increase in pensions that are the only source of income
(1) The limits of pensions, which are the only source of income, are CZK 1940 per month under Section 54 (1) and Section 68 (1) of the Social Security Act (2) and Section 54 (2) and Section 68 (2) of the Social Security Act (2) CZK 3220 per month.
(2) Pensions paid on the date of application of this Act, which have been adjusted as a single source of income, will be increased without application from the payment of the pension due after 31 October 1993.
(3) Pensions of old-age, disabled, widower, widower and orphan orphan children who have not yet been adjusted as a single source of income and which are below the level laid down in paragraph 1 shall be adjusted at the request at the earliest from the payment of the pension due after 31 October 1993.
Increase in social pensions
(1) The amount of the social pension provided for in Section 52 (2) of the Social Security Act (2) shall be no more than CZK 1940 per month for the individual and no more than CZK 3220 per month for the family member.
(2) Social pensions under Paragraph 52 (2) of the Social Security Act (2) may be granted or increased up to the amounts referred to in paragraph 1 on request, at the earliest from the payment of the pension due after 31 October 1993.
Increase in the highest rates of total pensions (benefits)
The highest rates of the sum of pensions paid (benefits) referred to in § 56 paragraphs 2, 4 and 5, § 64 paragraphs 5, § 70 paragraph 2 and § 139 paragraph 1 of the Social Security Act (2) are increased by CZK 300.
Common provisions
(1) The increase in pension is also above the highest pension or total of pensions and above the highest pension or total of pensions and the increase in pension for helplessness; However, the amount of the pension or the total of the pensions, including the increase in the pension for helplessness, must not exceed CZK 4500 per month after the increase under this law.
(2) The provisions of § 2 (4), § 5 (1) and (3), § 6 to 8 of Act No. 46 / 1991 Coll., on the increase of pensions apply mutatis mutandis.
(3) Widows' and orphans' pensions are not increased in accordance with Sections 1 and 2 if they have been calculated from pensions raised under this Act.
Efficacy
This Law shall take effect on 1 November 1993.
