Parliament has decided on this law of the Czech Republic:

1. In Paragraph 1 (3), the words "European Communities' are replaced by the words" European Union '.
2. footnote 1 shall read:
"(1) Regulation (EC) No 883 / 2004 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems. Regulation (EC) No 987 / 2009 of the European Parliament and of the Council of 16 September 2009 laying down detailed rules for the application of Regulation (EC) No 883 / 2004 on the coordination of social security systems. Regulation (EU) No 1231 / 2010 of the European Parliament and of the Council of 24 November 2010 extending the scope of Regulation (EC) No 883 / 2004 and Regulation (EC) No 987 / 2009 to third-country nationals not yet covered by these Regulations solely on grounds of their nationality. Regulation (EU) No 492 / 2011 of the European Parliament and of the Council of 5 April 2011 on the free movement of workers within the Union. '.
3. in Article 3 (2) (d), the words "the European Community" shall be replaced by the words "the European Union";
4. in Article 3 (2), the following point (l) is inserted after point (k), including footnote 69:
"(l) persons entitled to benefit from directly applicable European Union1) or persons employed, self-employed, persons holding such status and their family members entitled to equal treatment under European Union69);
69) Article 7 (3) and Article 24 of Directive 2004 / 38 / EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, amending Regulation No 1612 / 68 and repealing Directives 64 / 221 / EEC, 68 / 360 / EEC, 72 / 194 / EEC, 73 / 148 / EEC, 75 / 34 / EEC, 75 / 35 / EEC, 90 / 364 / EEC, 90 / 365 / EEC and 93 / 96 / EEC. ';
5. In Article 3 (2), at the end of the final part of the provisions, the sentence "The residence condition shall not apply to the persons referred to in (l)."

„§ 44
Conditions for entitlement to maternity benefits
(1) A woman who has given birth to her first or second live child shall be entitled to childbirth, unless the income in the family does not exceed the product of the amount of the family's living minimum and the coefficient of 2,70.
(2) She is not entitled to childbirth if she has been entitled to childbirth twice before childbirth by taking a child up to 1 year of age into permanent care replacing the care of parents or if she has already had one living child and the other has taken custody of the parents until 1 year of age, unless otherwise specified.
(3) The father of the first or second child born live shall also be entitled to childbirth if the woman who gave birth to the child or children died and fulfilled the conditions set out in paragraphs 1 and 2 on the date of birth and the child was not paid to her or to another person.
(4) A father who has already been entitled twice to childbirth by taking a child up to 1 year of his age into permanent care to replace the care of his parents shall not be entitled to the maternity allowance referred to in paragraph 3.
(5) The entitlement to the childbirth allowance arises on the day of the birth of the child, unless otherwise specified. "
7. Paragraph 45 (1) reads as follows:
"(1) A person who has taken into permanent care a child under 1 year of age is entitled to childbirth, and that child was the first or second child of that person, whether or not the first child has given birth to or taken into permanent care of the parent. The entitlement to childbirth shall be the day on which the child is taken into permanent care replacing the parent's care, the date on which the child is taken over being legally entitled to permanent care. The condition is that the applicable income in the family of that person does not exceed the product of the amount of the minimum life of the family and the coefficient of 2,70. '
8. In Paragraph 45, the words ", (b) and (d) 'shall be added at the end of paragraph 3.
9. Paragraph 46 (1) reads:
"(1) The amount of the childbirth allowance is CZK 13,000 for the first child and CZK 10,000 for the second child."
10. in Article 64a (1) and (2) and in Article 64a (4) (a), the words "European Communities, 54b)" shall be replaced by "European Union1)," and in Article 64a (4) (b), the words "European Community54b) shall be replaced by" European Union1 ";
footnote 54b is deleted.
Čl. II
Transitional provision
If the child is born or taken into permanent care replacing the parent's care before 1 January 2015, the childbirth allowance is payable pursuant to § 44 to 46 of Act No. 117 / 1995 Coll., as effective before the date of entry into force of this Act.
Čl. III
Efficacy
This Act shall take effect on 1 January 2015.
