THE LAW
of 22 July 2011
amending Act No. 248 / 2000 Coll., on the Promotion of Regional Development, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 248 / 2000 Coll., on the promotion of regional development, as amended by Act No. 320 / 2002 Coll., Act No. 109 / 2006 Coll., Act No. 138 / 2006 Coll., Act No. 186 / 2006 Coll., Act No. 66 / 2007 Coll., Act No. 154 / 2009 Coll. and Act No. 199 / 2010 Coll., is amended as follows:
1. Paragraph 16d (1) to (5), including footnote 6f, read:
"(1) The members of the Committee shall be elected from among their regional councils, which shall form a region of cohesion, no later than 90 days from the date on which the constituent meeting of the regional councils took place or from the date on which the office of member of the committee referred to in paragraph 2 was terminated. If the cohesion region is one region, the Committee has 15 members. If the cohesion region consists of more than one region, each region in the committee shall be represented by 8 members. The representative of the county may withdraw a member of the committee.
(2) The function of a member of the Committee shall cease to be:
(a) the termination of the mandate of a member of the Regional Council;
(b) by appeal; or
(c) by resignation.
(3) If the competent council of the county does not elect a member of the Committee within the time limit laid down in paragraph 1, the Minister for Regional Development may appoint an alternate member of the Ministry's staff for an vacant seat on the Committee. The alternate shall have the rights and duties of a member of the Committee until he is replaced by a new elected member of the Regional Council.
(4) The function of a member of the Committee is public function 6f). A member of the Committee shall be obliged to attend the meetings of the Committee and to perform the tasks assigned to him by the Committee.
(5) The Committee shall act by a resolution. In the case of a region of cohesion consisting of a single region, a quorum shall be available if an absolute majority of all Committee members are present. In this case, an absolute majority of all members of the Committee shall be required to adopt the resolution.
6f) Sections 5, 200 and 201 of the Labour Code. ';
2. in Article 16e (1) (a) and (b):
"(a) the programme document and the implementing document of the Regional Operational Programme, including amendments thereto;
(b) calls for projects, including documentation and possible changes to calls or documentation for individual calls, ';
3. in Article 16e (2):
"(2) The Committee shall be responsible for approving the budget of the Regional Council, the budgetary perspective of the Regional Council and the final account of the Regional Council. The final account of the Regional Council, together with a report on the results of the review of the management of the Regional Council for the previous calendar year, shall be discussed by the Committee by 30 June of the following year and shall take measures to remedy any deficiencies. ';
4. In Article 16f (1), the second sentence is replaced by the following: "In the case of a region of cohesion comprising several counties, the number of Vice-Presidents shall be determined in such a way that each county shall be represented on the Committee either on the chair's behalf or on behalf of the Vice-President."
5. In Article 17 (5), the words "as part of the budget of the Regional Council 'shall be inserted after the words" the budget of the Authority'.
Efficacy
That law shall take effect on the first day of the second calendar month following its publication.
