DECLARATION
of 26 September 2007
amending Decree No 277 / 2004 Coll., on determining the medical fitness to drive motor vehicles, medical fitness to drive motor vehicles with the condition and formalities of a medical certificate certifying the medical reasons for which the safety belt cannot be fastened on the seat of a motor vehicle (Ordinance on medical fitness to drive motor vehicles)
According to Section 137 (3), the Ministry of Health provides for the implementation of Section 85 (7) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended:
The Ordinance amending Decree No. 277 / 2004 Coll., on the determination of medical fitness to drive motor vehicles, medical fitness to drive motor vehicles, with the condition and requirements of a medical certificate certifying health reasons for which the safety belt cannot be fastened on the seat of a motor vehicle (Ordinance on medical fitness to drive motor vehicles) is amended as follows:
1. Paragraph 4 (1) reads as follows:
"(1) The report shall be clear and shall not contain a diagnosis of the disease; it shall always contain the particulars set out in the assessment models set out in Annex 2 to this Regulation. The opinion may also be given in a format and arrangement other than that shown in the model. ';
2. In Paragraph 4, the following paragraph 2 is inserted after paragraph 1:
"(2) According to the model of the opinion set out in Annex 2
(a) Part II shall proceed;
1. if the person under consideration is a driver who drives a motor vehicle in an employment relationship and the driving of a motor vehicle is a type of work agreed in the employment contract, or the driving of a motor vehicle is the subject of self-employment;
2. if the person referred to in § 87 (1) (a), (d) or (e) of the Act is also the person referred to in point 1,
(b) Part I shall be followed in other cases and also where the person referred to in point (a) is assessed with the conclusion that he is not fit to drive a motor vehicle of the group or subgroup of driving licences in question, the driving of which is the type of work agreed in the employment contract or the subject of a gainful activity, or is fit to drive that motor vehicle on condition. ";
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
3. In Article 5 (1), the words "where there is a reason for being unfit to drive a motor vehicle of the person referred to in Article 4 (2) (a) for the long-term disposal of a medical fitness (1a) to carry out the work or activity of driving a motor vehicle, that reason shall also be indicated."

"(1a) Sections 41 (1) (a), 52 (e) and 235 (3) (c) of the Labour Code."
4. In Article 5, the designation in the order of the second paragraph "(3) 'is replaced by" (2)'.
5. In Article 7, the designation in the order of the third paragraph "(2) 'is replaced by" (3)'.
6. Annex 2 shall read as follows:
"Annex No 2 to Decree No 277 / 2004 Coll.
If, prior to the date of entry into force of this Order, no assessment has been given on the basis of the medical assessment provided for in the present Order, the assessment shall be carried out in accordance with the present Order as amended by that Order.
This decree shall take effect on 1 December 2007.
