DECLARATION
of 2 August 2013
on the extent of data in the records of surface and groundwater status and on the way in which such data are processed, stored and transmitted to public administration information systems
The Ministry of Agriculture provides pursuant to § 21 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll. and Act No. 150 / 2010 Coll.:
Basic concepts
For the purposes of this decree:
(a) the natural flow of water measured by the flow of water, adjusted by the amount of sampling, discharges and other available data on its effect, to correspond to the natural hydrological regime of the water flow;
(b) an object on the water flow transverse barrier, such as a dam, a dam of a small water tank or pond, eat, a degree preventing the natural migration of aquatic animals, or a construction used to observe the state of surface water situated in a watercourse or on a plot adjacent to the watercourse;
(c) by positioning the coordinates of the point (s) of the line, and their link (s) or the coordinates of the polygon (s) and their link (s) which determine the position of the registered element; the coordinates are determined in the reference coordinate system of the Single Trigonometric Catastral Network;
(d) by the spatial determination of the position designation, supplemented by the points height data in the reference High System of the Baltic - after compensation,
(e) identification of the water legal structure of the distribution of water lines surface or groundwater (19) and its marking in length from its source or beginning to its introduction into another line or leaving the territory of the Czech Republic or until its natural completion, including the direction of its flow;
(f) by identifying the hydrological structure of the water line surface or groundwater (19), a description of the hydrological breakdown of the water line from its source or beginning to its introduction into another line or to leaving the territory of the Czech Republic or to its natural completion, including the direction of its flow.
(1) The basic source of spatial identification of waterlines and water bodies is the basic base of geographical data of the Czech Republic (1). The basic source of names is the information system of geographical nomenclature.
(2) In case of use of a source other than that referred to in paragraph 1, the water flow manager shall notify the administrator of the base base of the geographical data of the Czech Republic and shall provide it with an accurate location or spatial determination including information on the measurement method used to determine the semi-hourly and height data.
Records of water courses, their water catchment areas and other water lines
(1) Water flows and other water lines are recorded in the form of a line representation. The identification of the water legal structure of the watercourses and other waterlines is determined by the river basin managers and the state enterprise Forests of the Czech Republic (hereinafter referred to as "Forests").
(2) The water flows shall be recorded in the scope of their name, number identifier of the water structure, number identifier of the hydrological structure, length, direction of flow, administrator and location.
(3) The hydrological catchment areas of the watercourses are recorded in the form of polygon in the range of their numeric identifier and area size and determined on the basis of the hydrological structure of the waterlines. Identification of hydrological basins is determined by the Czech hydrometeorological institute.
(4) The other water lines shall be recorded in the range of data on their number identifier of the water structure, the number identifier of the hydrological structure, direction of flow, length and location.
(5) Forests process the name, number identifier of the water structure, length, administrator and location determination of the water flow they manage under Section 48 of the Water Act and store the processed data in the public administration information system.
(6) The river basin management authorities shall process the name data, the number identifier of the water structure, the length, the administrator and the location of the water flow within their territorial scope, excluding the watercourses registered in accordance with paragraph 5, and shall store the processed data in the public administration information system.
(7) The river basin managers and Forests shall record the data on the number identifier of the water legal structure, length and location of the other water lines and store the processed data in the public administration information system.
(8) The Research Institute of Water Management T. G. Masaryk, a public research institution, determines the identification of the hydrological structure of waterlines (1), processes data on the numerical identifier of the hydrological structure of waterlines and stores the processed data in the public administration information system.
(9) The Czech Hydrometeorological Institute, in cooperation with the river basin managers, Forests and the Research Institute of the Water Management T. G. Masaryk, a public research institution, processes data on the number identifier of the water system, the number identifier of the hydrological structure, the size of the area and the location of the hydrological water distribution plant and the number of hydrological order, and stores the processed data in the public administration information system; use the data referred to in paragraphs 5 to 8 for that purpose.
(10) The data of the public administration information system shall be accessible to the controllers of the base base of geographical data to the extent necessary to ensure the location determination of the watercourses and other waterlines.
Registration of objects on water courses and other water lines
(1) The transverse obstacles higher than 1 m evaluated in the river basin management plans under Section 24 of the Water Act shall be recorded in the scope of their type, number identifier and location of the obstacle location.
(2) The structures used for the observation of surface water status shall be recorded in the scope of data on their type, number and owner of the object, the owner of the measuring technology, the data processor and the location of the object.
(3) The river basin managers process and store the data referred to in paragraph 1 in the public administration information system.
(4) The river basin managers and the Czech Hydrometeorological Institute process the data referred to in paragraph 2 for the buildings with which they are entitled to manage and store the processed data in the public administration information system.
Registration of hydrogeological sites
(1) The hydrogeological zones shall be recorded in the scope of data on their location of the hydrogeological zone with polygon, name, number identifier, identifier and name of the relevant bodies of groundwater and name of the international river basin area in the Czech Republic.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by the Czech Hydrometeorological Institute.
(1) The river basin managers shall process and store in the public administration information system, except water tanks as referred to in paragraph 2, information on:
(a) water tanks whose permitted volume of air or accumulated water exceeds 1 000 000 m3, their name, number identifier, position determination of the level of maximum polygon load and position determination of the intersection of the centre of the dam and of the water flow axis, location determination and other data set out in the Annex to Decrees 2), with the exception of waterwork management data;
(b) water tanks for which the permitted volume of air or accumulated water does not exceed 1 000 000 m3 and for which they have the right to farm, their name, number identifier, position determination of the level of maximum polygon load and the point of intersection of the centre of the dam and of the water flow axis, location determination, peak, total volume and flooded area at the level of the operating area;
(c) water tanks the dam of which is classified in category I to IV with regard to technical safety oversight pursuant to Section 61 (5) of the Water Act, with the exception of the water tanks referred to in points (a) and (b), their name, number identifier, location of intersection between the centre of the dam and the water flow axis and the location.
(2) Forests process and store in the public administration information system for water tanks whose permitted volume of air or accumulated water does not exceed 1 000 000 m3 and for which they have the right to manage, data on their name, number identifier, position determination of the maximum load level with polygon and position determination of the centre of the dam and water flow axis, position determination, maximum level, total volume and flooded area at the level of the controllable area.
Registration of water bodies including strongly affected water bodies and artificial water bodies
(1) The surface water services shall be recorded in the scope of their location identification by polygon, name, number identifier, category and type, name of sub-basin and name of the international river basin area in the Czech Republic.
(2) The bodies of groundwater shall be recorded in the scope of the data on their location by polygon, name and number identifier, name and number identifier belonging to the hydrogeological zone and their jurisdiction with the international river basin area, sub-river basin, river basin administrator, county administrative district or regions.
(3) The data referred to in paragraphs 1 and 2 are processed and stored in the public administration information system by an authorised expert body.
Registration of surface water quantities
(1) The amount of surface water shall be recorded in the range of data on measured water flow and natural water flow data in water flows in selected horizontal stations and in embedded water flow profiles according to the hydrological balance output of the water quantity according to the Water Balance Regulation (3) and the location of the surface water monitoring area.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by the Czech Hydrometeorological Institute.
Surface water quality records
(1) The quality of surface water is recorded in the evaluation results (4) in the surface water quality monitoring profiles and their location determination data.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by the Czech Hydrometeorological Institute.
Registration of groundwater quantities
(1) The quantity of groundwater is recorded in the range of data on natural groundwater resources for hydrogeological areas within the sub-basins and international river basin areas of the Czech Republic according to the hydrological balance of water output (3), the groundwater level regime according to the outputs obtained from the monitoring network of the quantitative groundwater status (5) and the location of the objects of the monitoring network of the quantitative groundwater status.
(2) The data referred to in paragraph 1 from the buildings of the monitoring network of the quantitative status of the monitoring of groundwater is processed and stored by the Czech Hydrometeorological Institute in the public administration information system.
Groundwater quality records
(1) The quality of groundwater is recorded within the scope of the data obtained from the monitoring network of groundwater chemical status (5) and the location of the objects of the monitoring network of groundwater chemical status.
(2) The data referred to in paragraph 1 from the objects of the groundwater monitoring network are processed and stored by the Czech Hydrometeorological Institute in the public administration information system.
Registration of water bodies
(1) The status of surface water bodies is recorded within the scope of data on their numeric identifier and the classification of their chemical and ecological status.
(2) The status of groundwater bodies is recorded in the scope of data on their numeric identifier and the classification of their chemical and quantitative status.
(3) The data referred to in paragraphs 1 and 2 are processed and stored in the public administration information system by an authorised expert body.
Registration of the ecological potential of heavily affected and artificial aquatic bodies
(1) The ecological potentials (6) of the heavily affected bodies of surface water and the essentials of the survey and assessment programme for the state of surface water of strongly affected and artificial aquatic bodies are recorded in the scope of the data on their numeric identifier and its classification.
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
Records of surface water sampling
(1) The samples of surface water covered by the reporting obligation for the water balance (7) shall be recorded in the scope of the surface water sampling data set out in Annexes 1 to 4 to Regulation (8) and the location determination data.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Groundwater sampling records
(1) The groundwater sampling covered by the reporting obligation for the water balance (7) shall be recorded in the scope of the groundwater sampling data set out in Annexes 1 to 4 to Regulation (8) and the location determination data.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Registration of waste water discharge
(1) Data on waste water discharges covered by the reporting obligation for the water balance (7) shall be recorded in the scope of the waste water discharges data set out in Annexes 1 to 4 to Regulation (8) and the location of discharges.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Loading of mining water
(1) The data relating to the discharge of mining waters covered by the reporting obligation for the water balance (7) shall be recorded in the scope of the data for the discharge of mining waters set out in Annexes 1 to 4 to Declation8) and of the position determination of the discharge point.
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Evidence of accumulation of surface water in water tanks
(1) The data on the accumulation of surface water in water tanks subject to the reporting obligation for water balance (7) shall be recorded in the range of data for the accumulation of surface water in water tanks set out in Annexes 1 to 4 to Regulation (8).
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Registration of international river basin areas in the Czech Republic and sub-basins
(1) Parts of international river basin management areas on the territory of the Czech Republic and their sub-river basin shall be recorded in the scope of the location determination data of the river basin with polygon and the data provided for in the guideline on the regions of poji9).
(2) The data referred to in paragraph 1 shall be processed and stored in the public administration information system by river basin managers.
Registration of protected areas of natural water accumulation
(1) The protected areas of natural water accumulation are recorded in the scope of the position determination data of the polygon area and those laid down by the Government Regulation (10).
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
Registration of water source protection zones
(1) The protection zones of aquatic resources shall be recorded in the scope of the location identification data of the protection zone with polygon and those laid down in the Water Register Regulation (11), with the exception of names, surnames, permanent residence and natural person's birth number.
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
Records of surface water sources used or expected to be used as drinking water sources
(1) The sources of surface water used as drinking water sources shall be recorded within the limits of the location of the source, the name of the watercourse or the water tank, the name and code of the cadastral territory, the raw watercategory (12) and the collection identification number.
(2) The sources of surface water which are expected to be used as a source of drinking water shall be recorded within the limits of the location of the source, the name of the watercourse or water tank and the name and code number of the cadastral territory.
(3) The data referred to in paragraph 1 shall be processed and stored by the Ministry of Agriculture in the public administration information system.
(4) The data referred to in paragraph 2 shall be processed and stored in the public administration information system by the river basin managers under the Water Law on the basis of approved national river basin management plans.
Records of groundwater resources used or expected to be used as drinking water sources
(1) The sources of groundwater used as a drinking water source shall be recorded in terms of the location of the source, name and code number of the cadastral territory, raw watercategory 12) and the collection identification number.
(2) The sources of groundwater which are expected to be used as a source of drinking water shall be recorded in the extent of the location of the source and the name and code number of the cadastral territory.
(3) The data referred to in paragraph 1 shall be processed and stored by the Ministry of Agriculture in the public administration information system.
(4) The data referred to in paragraph 2 shall be processed and stored in the public administration information system by river basin managers on the basis of approved national river basin management plans.
Records of sensitive areas
(1) Sensitive areas are recorded in the range of location data for a sensitive area with polygon and those laid down by the Government Regulation (13).
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
Records of vulnerable areas
(1) Vulnerable areas are recorded in the range of location data for the vulnerable area with polygon and those provided for by the Government Regulation (14).
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
Registration of bathing surface water areas
(1) The surface waters used for bathing listed under the Public Health Act (15) shall be recorded in the scope of the location determination data of the area of polygon, surface water identifier used for bathing, administrative district of the county, administrative district of the municipality with extended competence, village identifier, municipality name, bathing area name or natural swimming pool name, number of water flow identifier, water flow name, hydrological order number, tank identifier and surface water profile used for bathing 16).
(2) The data referred to in paragraph 1, with the exception of the surface water profile used for bathing, are processed and stored in the public administration information system by an authorised expert body.
(3) Data on surface water profiles used for bathing are processed and stored in the public administration information system by river basin managers, including the surface water identifier used for bathing in accordance with paragraph 1.
Records of surface water which are or are to become permanently suitable for the life and reproduction of native fish and other aquatic animals
(1) Surface waters which are or are to become permanently suitable for the life and reproduction of native fish species and other aquatic animals shall be recorded within the limits of the data on the location of the water line or surface water polygon which are or are to become permanently suitable for the life and reproduction of native fish species and other aquatic animals and the data set out in the Annex to the government17).
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
Registration of main drainage and main irrigation installations
(1) The main draining and main irrigation facilities owned by the State are to be recorded in the scope of the location of the waterline and those laid down in the Water Register Regulation (11).
(2) The data referred to in paragraph 1 shall be processed and stored by the State Property Office in the public administration information system.
Registration of flood areas
(1) The designated flood zones are to be recorded in the scope of data on the location of the flood area by polygon, the name of the water stream, the water flow manager, the hydrological river identification number, the water flow identification number, the starting and end of the water flow section of the established flood area, the cadastral territory on whose territory the flood area is established, the name of the water authority which established the flood area and the date and number of the negotiations for the establishment of the flood area by the water authority.
(2) The data referred to in paragraph 1 shall be processed and stored by an authorised expert body in the public administration information system.
(3) The recording of the location of the flood area takes the form of a uniform layer resulting from the merging of the sub-location of the flood areas.
Method of processing, storage and transmission of data to public administration information systems
(1) Data registered under this decree are processed, transmitted and stored in the public administration information system administered by the Ministry of Agriculture pursuant to § 22 (3) of the Water Act or the Ministry of the Environment pursuant to § 22 (4) of the Water Act in the structure to allow data sharing through a defined reference, shared and secure interface (18), including in a way that allows remote access.
(2) The data provided for in Sections 3 to 6, 11, 12, 18 to 20 and 23 to 29 are kept in the public administration information system on an ongoing basis, data provided for in Sections 7 to 10, 13 to 17 and 21 and 22 are stored for the previous calendar year no later than 30 June of the calendar year.
(3) The basis for the registration carried out under this Order is in particular:
(a) basic base of geographical data of the Czech Republic,
(b) the basic water map of the Czech Republic 1: 50 000; and
(c) data maintained in information systems of river basin managers, forests, Czech hydrometeorological institute and other authorised professional bodies.
Repeal
Decree No. 391 / 2004 Coll., on the scope of the data in the records of surface and groundwater status and on the way in which these data are processed, stored and transferred to public administration information systems, is hereby repealed.
Efficacy
This Decree shall take effect on 1 September 2013, with the exception of the provisions of Sections 3 and 5 (4) which become effective on 1 September 2014, and the provisions of Sections 2 (4) and 5 (7) which become effective on 1 January 2016.
