of 29 November 1949
on the return of Czechoslovak citizenship to persons of German nationality.
The Government of the Czechoslovak Republic hereby orders the President of the Republic, pursuant to § 3 of Decree of 2 August 1945, No. 33 Coll., on the modification of Czechoslovak citizenship of persons of German and Hungarian nationality:
People of German nationality who have lost Czechoslovak citizenship pursuant to § 1 of Decree No. 33 / 1945 Coll., the Regional National Committee may, on a proposal from the District National Committee, return Czechoslovak citizenship if they are resident in the territory of the Czechoslovak Republic and have not violated the obligations of the Czechoslovak citizen, in particular they did not act hostile to the popular democratic establishment.
(1) An applicant who has submitted a request for the return of Czechoslovak citizenship to the District National Committee in due time shall be certified by the District National Committee as being a Czechoslovak citizen, if the obstacles referred to in § 1 are not known, and according to the applicant's conduct, he shall be expected to become a proper citizen involved in the building effort of the Czechoslovak working people; This certificate shall also be issued under the same conditions to family members included in the application.
(2) The Regional or Regional National Committee may withdraw this certificate during the procedure if it finds, in addition, that the applicant does not meet all the conditions set out in the preceding paragraph and in § 1.
(1) Spouses may request the return of citizenship in a joint application; each spouse's application shall be examined separately. Children under the age of 15 who have been admitted to their application by one of the parents shall acquire citizenship with him.
(2) The return of citizenship becomes effective for persons over 15 years of age only by making the following promise: "I promise in my honour and conscience that I will always be faithful and committed (faithful and devoted) to the Czechoslovak Republic and its popular democratic establishment, and that I will fulfil all the duties of its citizen (her citizens)." Only in exceptional cases can the composition of the national citizens' promise be forgiven by the Ministry of the Interior.
The Regional National Committee shall exercise the powers set out in Sections 1 and 2 of the Guidelines of the Ministry of Interior.
The Government Decree of 13 April 1948, No 76 Coll., on the Return of Czechoslovak Citizenship to Persons of German and Hungarian nationality, is hereby repealed.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Home Secretary in agreement with the participating members of the Government.
