GOVERNMENT REGULATION
of 31 July 2013
amending Government Regulation No 197 / 2005 Coll., laying down the conditions for granting aid for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Government Regulation No 197 / 2005 Coll., laying down the conditions for granting a subsidy for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, as amended by Government Regulation No 285 / 2007 Coll., Government Regulation No 373 / 2010 Coll. and Government Regulation No 173 / 2011 Coll., is amended as follows:
1. footnote 1 is deleted, including the footnote reference.
2. In Article 4 (1) (d), the words "for bee breeders' shall be inserted after the words" the establishment '.
3. in Article 4 (1) (e) of the introductory part of the provisions and in Article 4 (4) (e), the words "organisation of lectures" shall be replaced by the words "management of apiculture rings."
4. In Article 4 (1) (f), the words "of the type Langstroth, Dadant or of the type with the frame dimensions 390 x 240 mm 'are deleted.
5. in Article 4 (2) (a) to (d) and (f), the words "number and" shall be deleted;
6. in Article 4 (2) (e), the words "number and topics of lectures" are replaced by the words "topics of apiculture rings."
7. In Article 4 (3), the words "officially certified 'are deleted.
8. in Article 4 (4) (a) (1), the words "led by at least two speakers who have" shall be replaced by the words "led by a lecturer who has," the words "in the field of beekeeper" shall be replaced by the words "acquired," the words "hold" shall be replaced by the words "holding," the words "approval" shall be replaced by the words "approved" and the words "or indication" shall be replaced by the words "and the said."
9. in Paragraph 4 (4) (a) (2), "6 hours" is replaced by "4 hours";
10. in Articles 4 (4) (a) (2), 4 (4) (b) (2), 4 (4) (c) (2) and 10 (1) (b) and (c), the word "calendar" shall be deleted;
11. in Article 4 (4) (c) (1), the words "beekeeper" shall be replaced by the words "beekeeper"; the words "or" said "shall be replaced by the words" and the words "course carried out" shall be replaced by "lecture carried out."
12. in Paragraph 4 (4) (e) of the introductory part of the provision, the word "lectures" is replaced by "apiculture rings."
13. in Article 4 (4) (e), at the end of the text of point 1, the words "or listed in the list submitted to the applicant by 31 January of the calendar year in which the management of the ring is to be carried out, shall be added to the civil association continuously active in the field of bee breeding for at least 3 calendar years immediately preceding that calendar year."
14. in Paragraph 6 (2) (a), "10" is replaced by "20."
15. Paragraph 6 (3) reads:
"(3) The Fund shall grant a grant for the acquisition of a new bee-keeping establishment as referred to in paragraph 1 if, by 31 August of the relevant calendar year at the latest, the applicant demonstrates the acquisition of such an establishment by the bee-keeping operator referred to in paragraph 2 (a), who undertakes to hold and operate that establishment for at least 5 years, while at the same time demonstrating the medical fitness of the bee-keeping operator to be traded in the relevant calendar year. ';
16. in Article 7 (2) (b), the words "officially certified" shall be deleted;
17. in Paragraph 8 (1):
"(1) The subsidy under the renewal measure may be granted for breeding of bees from a recognised breeding programme (11) in the Czech Republic."
18. In Article 8 (2) of the Introductory Part of the provision, the words "on the subsidy referred to in paragraph 1 'shall be inserted after the word" applications'.
19. in Article 8 (2) (a) and (b), the words "and if the subsidy referred to in paragraph 1 (a)" shall be deleted;
20. in Paragraph 8 (2), the comma at the end of point (b) shall be replaced by a dot and points (c) and (d) shall be deleted;
21. In Article 8 (3), the words "breeding" shall be replaced by the words "breeding" and after the word "year," the words "lists of breeders of bees of mothers included in a recognised breeding programme" shall be inserted.
22. in Paragraph 8, paragraphs 4 and 5 are deleted;
23. in Paragraph 10 (1), the words "up to a maximum of 2 practical courses conducted by the lecturer in one day" shall be added at the end of the text of point (a).
24. In Paragraph 10 (1), at the end of the text of point (d), the words "no more than 2 lectures held by the speaker in one day 'shall be added.
25. in Paragraph 10 (1) (f), "10 000" is replaced by "15 000" and the words "holding lectures" are replaced by the words "keeping a single apiculture ring."
26. in Paragraph 10 (5):
"(5) The amount of the grant for the measure provided for in Section 8 is CZK 300 per bee mother sold from breeding from a recognised breeding programme (11)."
27. in Article 10 (6), "Article 14a" is replaced by "Article 14," "paragraph 2" is replaced by "paragraphs 2, 4 and 5" and "paragraphs 1, 3 to 5" is replaced by "paragraphs 1 and 3."

Where, for the relevant calendar year, the total amount of revenue of the Fund's budget allocated to subsidies under this Regulation is reduced in relation to the previous calendar year, the subsidy rates provided for in this Regulation shall be reduced by the percentage by which the total amount of the Fund's budget has been reduced compared to the previous calendar year. ';
Article 29 (14a) is deleted.
30. footnotes 6 to 8 are deleted.
31. In Annex 1, Part In point 3, the words "prevention and 'shall be inserted after the word" system'.
32. In Annex 1, Part In point 6, the words "prevention and 'are inserted after the words" in'.
33. In Annex No 1, Part A, the following point 7 is added:
'7. A course for economic and control activities in the field of bee breeding, legislation relating to beekeeping, organisation of bee treatment, with a particular focus on varroasis and pestilence, bee breeding and working with children and youth in bee rings for children and youth. '.
34. In Annex No 1, Part B, the words "civil associations operating 'are replaced by the words" applicants'.
35. In Annex No 1 to Part C, the words "for bee breeders, children and youth 'are replaced by the words" and apiculture rings'.
36. In Annex No 1, Part C, point 6, the words "and nature close 'shall be inserted after the words" Ecological'.
37. In Annex 1, Part C, point 11 reads as follows:
"11. Operating methods for the breeding of more than one colony, the diving of hives. '
38. In Annex No 2, Part A, points 15 and 16 are added:
"15. A single-purpose mechanical beekeeper.
16. Hole weight with platform up to 650 x 650 mm and weight up to 200 kg. "
39. In Annex No 2, Part B, the following point 7 is inserted after point 6:
"7. APIGUARD A.U.V. (gel)."
Point 7 is renumbered point 8.
Transitional provision
Applications initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No 197 / 2005 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on 1 September 2013.
