DECLARATION
of 18 September 2007
amending Decree No 582 / 2004 Coll., implementing certain provisions of the Act on Insurance Intermediaries and Insurance Liquidators, as amended by Decree No 40 / 2006 Coll.
The Czech National Bank provides, pursuant to § 16 (2), § 18 (10) and § 22 (2) of Act No. 38 / 2004 Coll., on insurance intermediaries and individual liquidators of claims and on the amendment of the Commercial Act (Act on Insurance Intermediaries and Insurance Liquidators), as amended by Act No. 444 / 2005 Coll. and Act No. 57 / 2006 Coll.:
Decree No. 582 / 2004 Coll., implementing certain provisions of the Act on Insurance Intermediaries and Insurance Liquidators, as amended by Decree No. 40 / 2006 Coll., is amended as follows:
1. In Paragraph 3 (3), the first sentence is replaced by the sentence "The certificate of registration shall be stamped with the round stamp of the Czech National Bank and the signatures of the two mandated employees of the Czech National Bank, indicating their names, surnames and positions."
2. In Paragraph 7 (2), the word "Ministry 'is replaced by" Czech National Bank'.
3. in § 7 (2), (3) and (10), the word "Ministry" shall be replaced by "Czech National Bank";
4. In Paragraph 7 (9), "Ministry 'is replaced by" Czech National Bank'.
5. In Paragraph 7 (9), "Ministry 'is replaced by" Czech National Bank'.
6. In Section 8, the word "Ministry 'is replaced by" Czech National Bank'.
7. in Article 9 (1) (a):
"(a) his name or, where appropriate, his name, his surname, his title, and, if applicable, his business name and business name are involved,"
8. in Article 9 (2) (d), the words "except for a tied insurance agent," shall be deleted;
9. Paragraph 9 (6) and (7) reads as follows:
"(6) The activity report is submitted to the Czech National Bank in electronic form through the application of the Czech National Bank for data collection, which is available in a way that allows remote access. The electronic form of the activity statement shall be provided by the insurance agent or insurance broker by a verification code, which the Czech National Bank shall assign and notify within 30 days of the date of registration. If it is registered at the same time as an insurance agent and as an insurance broker, the Czech National Bank will assign a verification code separately for each registration.
(7) The insurance agent or insurance broker shall also draw up a report in paper form and shall affix it to the date of its drawing up and signature of the authorised person. If the insurance agent or insurance broker is a legal person, the statement shall also be signed by its responsible agent. The paper business statement shall be kept by the insurance agent or insurance broker for the purpose of overseeing the business of insurance intermediaries. ';
