authorising finance and national defence ministers to restore entitlement to such salaries to certain former beneficiaries of resting and providing salaries.
The Government of the Czechoslovak Republic hereby orders, pursuant to § 15, paragraph 1 of the Act of 23 February 1949, No 63 Coll., on the regulation of the legal situation of certain public servants and recipients of retirement (provision) salaries who remained in the period of unfreedom in the territory of the Czechoslovak Republic occupied by foreign powers ("the Act '):
The Finance and National Defence Ministers are hereby authorised to renew, in their fields of competence, the right to a retirement (provision) salary which is deemed to be deceased under Section 1 (2) of the Act, to those former beneficiaries for whom the conditions of Section 2 of this Regulation are met.
Only those beneficiaries whose pension arrangements were taken over by the German Empire at the time of the occupation, who had already been released after 5 May 1945 to pay their pension benefits on the basis of the finding that they were not assessed in accordance with § 1, paragraph 4 of the Decree of 2 August 1945 of the President of the Republic, No 33 Coll., as Germans, after having not acquired German nationality or applied for German nationality and having a positive relationship to the popular democratic establishment.
(1) The financial effectiveness of the measure taken pursuant to Article 1 of this Regulation is due to the release of pension benefits, even if it was only an advance payment.
(2) Exceptionally, the Minister for Finance, after the Minister for National Defence, may, in agreement with the Minister for Finance, postpone the financial effectiveness of this measure to an earlier date.
This Regulation shall enter into force on 12 March 1949; They shall be implemented by finance and national defence ministers in agreement with participating members of the Government.
