DECLARATION
of 25 July 2013
amending Decree No. 347 / 2006 Coll., implementing certain provisions of the Financial Conglomerates Act
The Czech National Bank provides pursuant to Section 34 of Act No. 377 / 2005 Coll., on the Supplementary Supervision of Banks, Savings and Credit Cooperatives, Electronic Money Institutions, Insurance and Securities Traders in Financial Conglomerates and on the Amendment of Certain Other Acts (Financial Conglomerates Act), as amended by Act No. 228 / 2013 Coll.:
Decree No. 347 / 2006 Coll., implementing certain provisions of the Financial Conglomerates Act, is amended as follows:
1. in Articles 1 (d) and 15 (1), the word "experience" shall be replaced by "competence."
2. in Article 2 (a), the word "engagement" is replaced by "exposure."
3. In Article 2 (b), the word "exposure 'is replaced by" exposure'.
4. In Paragraph 3 (1), "up to 8 'is replaced by" and 7';
5. In Article 5 (1), "(d) 'is replaced by" (c)';
6. Article 8 shall be deleted, including the title.
7. in § 9 (a), § 10 (3) of the introductory part of the provision, § 10 (3) (b) and Annex 4 (3) (a) to (d), the word "exposure" shall be replaced by "exposure."
8. In Section 10 of the heading reads "Great exposure."
9. in § 10 (1) of the introductory part of the provision, § 10 (1) (b) to (d) and § 10 (2), "exposure" is replaced by "exposure."
10. in Article 10 (1) of the Introductory Part of the provision, Articles 10 (1) (b) to (d), 10 (4) and (5) and Annex 4 (3) (a) and (b), the word "involvement" shall be replaced by "exposures."
11. in Article 10 (3) (b), the words "the deduction method of accounting value and capital requirements" shall be deleted;
12. in Article 10 (3) (b), "(d)" is replaced by "(c)";
13. in Paragraph 10 (4), the word "engagement" is replaced by "exposures."
14. in Article 10 (5), the word "exposure" is replaced by "exposures."
15. in Article 15 (2) (f), "experience" is replaced by "competence."
16. in Annex 4, point 1 (b) and point 3 of the introductory part of the provision, the word "engagement" shall be replaced by "exposures."
Efficacy
This Decree shall take effect on 1 October 2013.
