of 20 July 2011
amending Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Law) and amending and supplementing certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the Amendment and Addition of Certain Acts, as amended by Act No. 83 / 1998 Coll., Act No. 71 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 13 / 2002 Coll., Act No. 253 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 158 / 2003 Coll., Act No. 223 / 2004 Coll., Act No. 296 / 2007 Coll., Act No. 124 / 2008 Coll., Act No. 189 / 2008 Coll., Act No. 186 / 2006 Coll., Act No. 342 / 2006 Coll.
1. In Article 24, the following paragraph 5 is added:
"(5) The person who applies to the Authority for authorisation of the activity referred to in Article 9 (1) in which radioactive waste is to be generated shall be registered with the Administration as the future producer of radioactive waste; indicate the data necessary for its unambiguous identification, if applicable, of the legal person, as well as the data to identify the members of the statutory authority, and the activity to be authorised and the expected type and quantity of radioactive waste to be generated. The data from the register shall be kept for 5 years after the payment of the contributions has been completed in accordance with Section 27. ';
2. In Paragraph 26 (1), the word "individual 'is replaced by the word" relevant'.
3. In Article 26 (3), the dot at the end of point (l) is replaced by a comma and the following point (m) is added:
"(m) the provision of contributions to municipalities pursuant to § 27."
4. In Paragraph 27 (2), the last sentence shall be replaced by the sentence "Unless otherwise provided for in this law, the levy shall be administered in accordance with the tax rules."
footnote 23 is deleted.
5. In Paragraph 27, the following paragraphs 4 and 5 are inserted after paragraph 3:
"(4) The levies referred to in paragraphs 2 and 3 shall be paid:
(a) a monthly advance payment on the basis of a levy which, for the originators operating nuclear power plants, is the annual electricity generation measured at generator terminals and for the originators operating research nuclear reactors with a heat output greater than 0,1 megawatt hours, is the annual heat energy generation; the amount of the advance is derived from the production in the month in question and the rate of the levy laid down by the Government Decree,
(b) one-off agents other than those referred to in (a) (hereinafter referred to as "small quantities of radioactive waste"), at the level laid down by the Government's regulation under the conditions for receiving radioactive waste for storage or storage (§ 31); the amount of the levy shall be increased annually but not more than 7% from the year immediately preceding; the originators of a small quantity of radioactive waste shall pay the levy on the receipt of radioactive waste by the Administration, provided that the charge for radioactive waste which does not meet the conditions for storage or storage is determined by the Administration accordingly.
(5) The award of the levy referred to in paragraph 4 (a) shall be lodged on its form by 31 January of the following year. "
Paragraphs 4 to 6 shall be renumbered paragraphs 6 to 8.
6. Paragraph 27 (7) reads as follows:
"(7) The government shall determine the amount and method of disbursement of funds to the nuclear account, in particular the basis of the levy, the rate of payment, the period of payment, the maturity of the levy, the filing of the levy and the advance payment and the method of administration, including the method of accounting by payers, the rules under which small amounts of radioactive waste will be allowed to be paid by the originators by means of a regulation. '
7. In Section 27, paragraphs 9 to 11 are added, including footnote 41:
"(9) The contribution from the nuclear account belongs to the municipality in whose cadastral territory it is
(a) a designated exploratory area for special intervention in the earth's crust for the storage of radioactive waste in groundwater (41);
(b) a protected area for special intervention in the earth's crust for the storage of radioactive waste in groundwater (3); or
(c) authorised to operate radioactive waste storage sites.
(10) The contribution referred to in point (a) or (c) of paragraph 9 does not apply to citizens who belong in a calendar year. The allowance shall be granted ex officio after the time limit for bringing an action against a decision by an administrative authority within the meaning of paragraph 9 has expired.
(11) The contribution from the nuclear account is up to CZK 4,000,000 per year. The Government shall lay down rules on the granting of the contribution and the amount of the contribution referred to in paragraph 9 (b) and (c), as well as the method of calculating the contribution referred to in paragraph 9 (a), taking into account the size of the exploratory area for special intervention in the earth's crust for the storage of radioactive waste in underground areas.

Efficacy
This Act shall take effect on the 15th day following its publication.
